MEMORANDUM OF UNDERSTANDING

This Understanding made and entered into this 24th day of __________ at
___________________________, Philippines, by and among:

The DEPARTMENT OF EDUCATION, an agency of the national government of the


Republic of the Philippines, created by virtue of Batas Pambansa (B.P.) No. 232 “The Education
Act of 1982” as amended by Republic Act (R.A.) No. 9155 otherwise known as “Governance of
Basic Education Act of 2001”, with principal office address at DepEd Complex, Meralco Ave.,
Pasig City, Metro Manila, represented by its Acting Schools Division Superintendent, Schools
Division of Calapan City, SUSANA M. BAUTISTA, herein referred to as “DepEd”;

-and-

ASSOCIATION OF BARANGAY CAPTAINS (ABC), duly organized and existing under the
laws of the Republic of the Philippines, with office address at ____________, Calapan City
represented in this transaction by its ABC Chairman – HECTOR AFRICA, hereinafter referred
to as the “ABC’’;

WITNESSETH: That

WHEREAS, the ABC has the responsibility for realizing the country’s goal of globally
competitive, innovative and disaster ready communities that contribute to inclusive growth
and development of community members;

WHEREAS, 1987 Philippine Constitution provides for the recognition and promotion of
other forms of education other than formal education. Article XIV, Section 2, Paragraph (1) declares
that the State shall establish, maintain and support a complete, adequate and integrated system of
education relevant to the needs of the people and society; and paragraph (4) concisely encourages
non-formal, informal and indigenous learning systems as well as self-learning, independent and
out-of-school study programs particularly those that respond to community needs.

WHEREAS, the Governance Act for Basic Education otherwise known as the Republic Act
9155 stipulates the establishment of the Alternative Learning System (ALS) to provide out-of-school
children, youth and adults population with basic education.

WHEREAS, the ABC an established organization which is committed to provide quality


assistance and services to other agencies of the government such as the Alternative Learning
System (ALS) of the Department of Education (DepEd) that promotes educational
opportunities to the Out-of-School Children (OSC), Out-of-School Youth (OSYs) and Out-of-
School Adults (OSAs);

WHEREAS, ABC has responded to the call of DepEd for public sector participation in
public education by developing a project entitled “_________________” which will serve as a venue

in strengthening the implementation of ALS programs and activities in the barangays in the
City of Calapan;

NOW THEREFORE, for and in consideration of the foregoing premises and the terms
and conditions herein set forth, the parties hereby agree as follows:

Section 1 Description of the Project


The lengthened support in advocating ALS Programs and Projects is a venue that will
strengthen the implementation of Alternative Learning System (ALS) to the OSC, OSYs and
OSAs in the ____ barangays of Calapan City.

Section 2 Rights and Obligations of the Concerned Parties

2.1The “ABC” shall:


2.1.1 Coordinate with ALS personnel in the advocacy of programs and
projects to their respective barangays;

2.1.2 Support in the implementation of Alternative Learning System (ALS)


in their respective barangays;

2.1.3 Provide assistance in mapping activity in identifying potential


learners for ALS;

2.1.4 Provide assistance in the identification and in tapping the support of


possible partners for resource mobilization.

2.2DepEd shall:

2.2.1 Provide policy and guidelines in the maintenance and operation of the
ALS center;

2.2.2 Coordinate in the monitoring of ALS programs and activities in the


learning center;

2.2.3 Support activities of barangays in relation to the promotion of


education in barangay level;

Section 3 Scope of the Project Beneficiaries


The project beneficiaries shall be the community members and learners of
Alternative Learning System (ALS) from respective barangays.

Section 4 Project Effectivity


This Memorandum of Understanding shall take effect upon its signing and shall
remain in full force and effect from January 2017 – December 2018.

Section 5 Capacity and Authorization. The parties herein warrant that they have the
capacity, power and requisite authorization to enter into this Understanding.

Section 6 Separability Clause. Should any part of this Understanding be judicially


declared null and void, such nullity shall not affect the validity of the remaining
provisions hereof.

Section 7 Breach of Contract. The violation or omission of any of the provisions of this
Understanding shall be a ground for legal or court action.

Section 8 Amendments. This Understanding may be revised, amended or modified only


through a written instrument duly executed and signed by all parties.
