Bellingham Municipal ‘SUSE ADMITTED OFFENSE: ‘ACQOMELIGE ADMATED OFFENSE: 2S RANE. No (soca arrewmo sequen: rani sea ‘AL. AND ME OF ARR. NARRATIVE: (Al) SMITH, JOSHUA T. DOB 1/14/1995 2326 Xenia St. Bellingham, WA (Al) JOSHUA SMITH hindered and delayed Bellingham Police Officers when ordered to stop and physically resisted BPD Officer’s attempts to detain him into handcuffs in violation of BMC 10.24.100. On 6/19/2017, at approximately 1718, Officers were dispatched to a report ofa domestic dispute at 3300 Plymouth Dr. The argument ‘was between a male and female, Dispatchers could hear the male half yelling inthe background ofthe 911 call, There was an involved vehicle ofa white Mitsubishi SUV. Officers were advised the parties left inthis vehicle ‘The vehicle was located in the 3100 block of Ellis St. A white female was on the sidewalk next tothe vehicle, siting down, crying hysterically. ‘She bad a bloody let knee, The male half, later identified as JOSHUA SMITH, exited the vehicle and approached the female, BPD Officer asked SMITH to step away ftom the female to talk a the concer was that she had possibly just been assaulted by SMITH. SMITH said he wanted to record with his phone and dove his hand in his pocket; he was ordered to take his hend out of bis pocket and refused. Officer told SMITH he was being detained, but SMITH walked away and tried to get inthe back passenger seat ofthe SUV. SMITH was given orders stop and refused. As I was turning onto Ellis Strest from E Sunset Drive 1 ittnessed a male, later identified as JOSHUA SMITH (Al), appearing to pull away from Officer Laughlin. At the time, Officer Laughlin was the lone officer on scan unidentified male and female standing neasby. ‘Thaze was an 1 turned on my body worn camera and ran up to his location, I witnessed JOSHUA SMITH ial) physically resisting Officer Laughlin's attempt to detain him by stiffening Ais poay up and pulling away towards a fence. I ran up to JOSHUA SMITH (Al) and piiboed his right arm. He was fecing a fence away from the roadway at this tine Officer Laughlin was on his left side. 1 advised JOSHUA SMITH (A1) to relax while Z held im by his forearm. He continued foyell and tense up his body. He seemed to be wanting to make a scene by yelling ‘and looking around at people in the area, poring this time T was also attempting to watch the young female who was crying end bleeding nearby and the other male who turned out to be @ cooperative neighbor. while grabbing JOSHUA SMITH (Al) right arm he stated "you broke my finger’ certain if he was referring to me or Officer Laughlin. rim not We were able to get JOSHUA SMITH (Al) detained in handcuffs, While Officer Laughlin SSeiea up his left hand I held onto his right hand. When Officer Laughlin was ready T brought JOSHUA SMITH (Al) right hand back to be cuffed. ‘once he was cuffed JOSHUA SMITH (AL) would not come down verbally. He was 8130 Chtremely tense. He pushed back against Officer Laughlin prompting me to grab @ fighter hold of his right arm. Officer Laughlin verbally stated to take him to the gzound. The location we were standing in was just off the sidewalk in the grass. Due to the fence 1 was unable to assist in taking JOSHUA SMITH (Al) to the ground. Officer fgughlin attenpted to but was unable to get JOSHUA SMITH (Al) to the ground. Rt one Zeige sosnua suz7a (Al) turned tovards me. 7 applied weight to the back of his neck Bttempeing to push him down using my body weight. That didn't work so T put the hack of his head under my right arm continuing to use my body weight. JOSHUA SMITH (Al), either on purpose or while falling over, caused my back to ehtide into the fence, The impact broke a 2x4x8 that was on the upper portion of {he fence. The owner was present. He continued to yell at officers When JOSHUA SMITH (A1) pushed against us, both cur body worn cameras came off and fein to the ground, Unfortunately, you can only see us on my BNC for a few seconds ister, vou can hear JOSHUA SMITH (Al) being verbal, officers giving commands, and 2 female crying. once more officers arrived on scene I assisted Sergeant Cristelli with escorting SOSHUA SMITA (Al) to a patrol vehicle. He walked with officers complaining that he had been punched and kicked in the balls. 1 held JOSHUA SHITH (A1) against a patrol vehicle while Sezgeant Cristelli searched JosHUA SMITH (Al) person. He was then seated in the rear of the patrol vehicle. The andows were initially rolled down for a while. He started to verbally taunt Officer Laughlin se I rolled up the passenger side window, While waiting on scene I approached the rear driver side of the patro) vehicle. The wehdow was se4ii down. I put my BWC into the rear of the patrol vehicle to record NOSHUA SMITH (Al) demeanor. I briefly spoke to JOSHUA SMITH (Al) while zecording pim but backed away when Sergeant Cristelli wanted to speak to him. once JOSHUA SMITH (Al) was transported to the Whateom County Jail T moved his Sanicle to a parking lot near St Joseph's Hospital, I then dropped off JOSHUA SMITH (Al) Keys and beanie at the Whatcom County Jail. ‘That concluded my time on this call.
