DEED OF ASSIGNMENT AND TRANSFER OF RIGHTS
KNOW ALL MEN BY THIS PRESENTS:
This deed, made and entered into this 25th day of June, 2018 at the City
of Cebu, by and between:
ANA B. SAJOL, Filipino citizen, of legal age, married to Dante
M. Sajol with residence and postal address at Block 9, Lot 10,
Lessandra Talamban, Pulangbato, Cebu City, hereinafter referred
to as the "ASSIGNOR"
-and-
JOSEPH BENEDICT B. CAERMARE and SHERYL Y.
COLO, both Filipino citizens, of legal age, single with residence
and postal address at M. Ceniza St., Sitio Kulo, Casuntingan,
Mandaue City, hereinafter collectively referred to as the
"ASSIGNEES".
WITNESSETH that -
WHEREAS, the ASSIGNOR is an owner of a thirty-eight (38) square
meters parcel of land built with a two-storey residential house located at
Block 6 Lot 2, Pilit Cabancalan Mandaue City under a Memorandum of
Agreement between ULT Financialist and Pilit Cabancalan Mandaue City
Homeowners Association, Inc. (PCMC HOAI).
WHEREAS, the ASSIGNOR has offered to assign all her rights, title
and interest over the above property, as referred in said Memorandum of
Agreement and the ASSIGNEES hereby accept the assignment in
accordance with the terms herein set forth;
NOW, THEREFORE, for and in consideration of the foregoing
premises and the total sum of FIVE HUNDRED FIFTY THOUSAND
PESOS (P550,000.00), PHILIPPINE CURRENCY, which the
ASSIGNOR hereby acknowledged to have received from the ASSIGNEES
the partial amount of THREE HUNDRED THOUSAND PESOS
(P300,000.00) PHILIPPINE CURRENCY as down payment, the
ASSIGNOR hereby assigns, transfers and conveys unto the ASSIGNEES,
all her rights, title and interest to the aforementioned property and
appurtenant interest in the property pursuant to this Agreement and the
ASSIGNEES by these presents hereby accept the assignment and agree to be
bound by the terms and conditions of the Memorandum of Agreement and
the rules and regulations, and restrictions pertaining to the said property.

The ASSIGNOR hereby warrants to defend the peaceful ownership
and possession of the said property by the said ASSIGNEES from any and
all adverse claims of any person or party whatsoever.
The remaining balance of the total consideration in the amount of
TWO HUNDRED FIFTY THOUSAND (P250,000.00) PHILIPPINE
CURRENCY shall be paid in full by the ASSIGNEES to the ASSIGNOR
on July 07, 2018.
IN WITNESS WHEREOF, the parties have hereunto set their hands
on the date and place first above written.
