Subject: Application for Implementation of decision of Supreme court of Pakistan regarding


appointments on Gazetted Posts for Engineers, which states that only Engineers having PEC card
should be appointed against these posts not Diploma holders or B.tech holders.

Respected Sir, it is kindly stated

(1) That We are professional engineers having Bachelor of Engineering degrees (BE) and Pakistan
Engineering Council (PEC ) cards And working as Assistant Electric Inspectors (BPS:17) in Electric
Inspectorate E & P department KP.
(2) That there are two categories of Electical Professionals working in this department they are
(i) Electrical Engineers having Bachelor of Engineering(BE) Degrees and PEC cards who are
appointed as, Electric Inspectors (BS:19) , Deputy Electric Inspectors (BS:18) and
Assistant Electric Inspector (BS:17)
(ii) The second category is three years Electrical Diploma holders(DAE) after HSC(Metric),
they are appointed as Electric Sub Inspectors(ESI,BPS:11 & 12) they according to
Pakistan Engeneering Council Act are not Professional Engineers even if they get B.Tech
or Masters Degrees, Pakistan Engineering Council does not issue them PEC cards, they
are like Para Medical staff in hospitals who cannot be appointed as Medical Officers
even having PhD degrees.
(3) That in past unfortunately these Diploma holders (Electric Sub Inspectors BS 11 & 12)in Electric
Inspectorate Energy & Power Dep’t KP were directly promoted from BPS:12 to BPS:17 which
has severe consequences in shape of performance of these employees in resolution of Dispute
cases and Orders writings, they even cannot write two sentences in English further more DAE
Diploma is easily available on 24 thousand rupees by hundreds of private polytechnic colleges.
(4) That irrigation and C&W departments has reserved 15teen %quota for their promotion but in
our department it is 50% and that too directly from BPS 11 & 12 which is not fare.
(5) That now the Islamabad High Court has in its decision Published in (2018 PLC(CS) page 257)has
clearly laid down that only those Engineers who has 4 years Bachelor of Engineering (BE)
Degrees and valid PEC card shall be appointed against Gazetted posts reserved for engineers
and no diploma holder shall be promoted to those posts .
(6) That we have filed Writ petition in High Court for our regularization in which cases these diploma
holders has filed impleadment applications and has objected on our regularization although in
light of Supreme Court decision now they cannot be appointed as Assistant Electric Inspectors
BPS : 17.
It is therefor humbly requested that in light of decision of supreme court of Pakistan they may
not be promoted to the posts of Assistant Electric Inspectors BPS 17 or Regional Electric
Inspector BPS 18 being Engeneering posts reserved for Engeneers.
