PETITION
COMES NOW, the Petitioner by the undersigned counsel and unto
this Honorable Court, most respectfully alleges that:

1. Petitioner is single, of legal age, Filipino and a resident of Purok


Adelfa, Mahayahay, Iligan City;
2. Respondent is the office-in-charge, among others, with the official
record/document registered in the City of Iligan particularly
certificate of live-birth the office of which is located in the Local Civil
Registrar, Iligan City Hall, where it may be served with summons and
other legal processes;
3. Petitioner’s parents, namely, Juanito O. Macapatay and Christina B.
Macapatay, were married on January 27, 1984 in the City of Iligan. A
copy of their Marriage Contract is hereto attached as Annex “A” ;
4. One year after their marriage, petitioner was conceived by her
mother. On October 15, 1985, herein petitioner was born in Iligan
City;
5. In his Certificate of Live Birth under Entry No. 32, his name was
erroneously entered as “CHRISTINE NAKAPATAY” instead of
“CHRISTINE MACAPATAY.” A copy of Certificate of Live Birth is hereto
attached as Annex “B” ;
6. Petitioner’s true surname is “MACAPATAY” and not “NAKAPATAY.” As
reflected in his parent’s Marriage Contract (Annex “A”), his father’s
surname is “Macapatay” and not “Nakapatay.”;
7. Furthermore, the Certificate of Live Birth of petitioner’s father
Juanito O. Macapatay shows that the latter’s surname is
“MACAPATAY” and not “NAKAPATAY.” A copy of the Certificate of Live
Birth of Juanito O. Macapatay is hereto attached as Annex “C”;

WHEREFORE, premises considered, it is most respectfully prayed of this


Honorable Court that the instant petition be GRANTED, that the erroneous
name of the petitioner CHRISTINE NAKAPATAY reflected under Entry No. 32
of his Certificate of Live Birth be rectified and corrected to CHRISTINE
MACAPATAY dropping the surname “NAKAPATAY” and changing it to
“MACAPATAY,” his actual and legal surname.

Other reliefs and remedies available under the premises are likewise
prayed for.

may deem just and equitable in the premises.

I, Christine Macapatay, of legal age, Filipino Citizen, single and a


resident of Purok Adelfa, Mahayahay, Iligan City, after having been duly
sworn to in accordance with law, hereby, depose and say:

1. That I am the Petitioner in the above-entitled case;


2. That I have caused this Petition for correction of entry of name to be
prepared;
3. That I read and understood its contents which are true and correct of
my own personal knowledge and/ or based on authentic records;
4. That I have not earlier commenced a similar action against the
defendant for the same cause with any other court, tribunal or quasi-
judicial agency and, to the best of my knowledge, no such action or
proceeding is pending with any other court, tribunal or quasi-judicial
agency; and if I should learn that a similar action is pending before
any other court, tribunal or quasi-judicial agency, I hereby undertake
to notify this Honorable Court within five (5) days from such notice.
