Proposal from the PPSC

Rules and Regulations Implementing Republic Act No. 11279

Pursuant to Section 8 of RA No. 11279 (AN ACT TRANSFERRING THE PHILIPPINE


NATIONAL POLICE ACADEMY (PNPA) AND THE NATIONAL POLICE TRAINING
INSTITUTE (NPTI) FROM THE PHILIPPINE PUBLIC SAFETY COLLE (PPSC) TO THE
PHILIPPINE NATIONAL POLICE (PNP), AMENDING FOR THE PURPOSE SECTIONS 24,
35, 66, 67, AND 68 OF REPUBLIC ACT NO. 6975, OTHERWISE KNOWN AS THE
‘DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT ACT OF 1990’, AS
AMENDED) the following Implementing Rules and Regulations (IRR) are hereby
promulgated:

Section 1. Title. This shall be known as the “Implementing Rules and


Regulations (IRR) of Republic Act No. 11279 otherwise known as AN ACT
TRANSFERRING THE PHILIPPINE NATIONAL POLICE ACADEMY (PNPA) AND THE
NATIONAL POLICE TRAINING INSTITUTE (NPTI) FROM THE PHILIPPINE PUBLIC
SAFETY COLLEGE (PPSC) TO THE PHILIPPINE NATIONAL POLICE (PNP),” for the
purpose of prescribing the necessary rules and regulations for the transfer of
administrative and operational supervision and control over the Philippine National Police
Academy (PNPA) and National Police Training Institute (NPTI) from the Philippine Public
Safety College (PPSC) to the Philippine National Police (PNP).

Section 2. Declaration of Policy. The provisions of this Implementing Rules


and Regulations is to clarify the scope and application of the Act to ensure the smooth
transfer and transition of the PNPA and NPTI from the PPSC to the PNP in line with the
aim to have a highly efficient and competent police force.

Section 3. Scope and Application. The provisions of this Implementing Rules


and Regulations shall cover all matters relating to the transfer of administrative and
operational supervision and control over the PNPA and NPTI from the PPSC to the PNP
and the reorganization and the new composition of the Philippine Public Safety College
amending for the purpose Sections 24, 35, 66, 67, and 68 of Republic Act No. 6975,
otherwise known as the ‘Department of the Interior and Local Government Act of 1990’,
as amended.

I. Transfer of PNPA.

Section 4. Transfer of Administrative and Operational Supervision


and Control over the PNPA. To better achieve the goals of a highly efficient and
competent police force, the Philippine National Police (PNP) shall have administrative and
operational supervision and control over the Philippine National Police Academy (PNPA)
established pursuant to Section 13 of Presidential Decree 1184. Provided, however, that
the overall policy direction and academic oversight shall rest with the Secretary of the
Interior and Local Government as Chairman of the PPSC Board of Trustees and Ex-Officio
Chairman of the NAPOLCOM.
4.1 The PNPA shall be headed by a PNPA Director with the rank of Police Major General. A
Deputy Director with the rank of Police Brigadier General shall assist the PNPA Director in
the performance of his/her functions. The PNPA shall have a Dean of Academics and a
Commandant both with the Rank of Police Brigadier General.

4.2 The PNPA Cadetship Training Program. The PNP shall have the sole responsibility of
training the Cadets of the PNPA and shall provide the policy direction for the development
of the existing cadetship program.

4.3 Admission to the PNPA Cadetship Training Program. The PNP shall provide for the
necessary qualifications and standards for admission to the Cadetship Training Program of
PNPA.

4.4 The PNPA shall continue to exercise its power and authority to grant and confer the
degree in Bachelor of Science in Public Safety (BSPS) and other proficiency training
programs hereinafter authorized by the Chief, PNP with the concurrence of the
NAPOLCOM.

4.5 The Chief PNP shall create a PNPA Academic Board. The membership of which shall be
determined after the approval of the Revised Table of Organization for the PNPA. In the
interim, the current PNPA Academic Board shall remain to function as such until a new
Board is constituted consistent with the Transition Plan or the approved Revised Table of
Organization.

Notwithstanding this provision, the Chief, PNP may designate additional members of the
PNPA Academic Board provided that such additional members shall possess similar or
equivalent rank and status as its existing members.

II. Transfer of NPTI

Section 5. Transfer of Administrative and Operational Supervision


and Control over the NPTI. The National Police Training Institute (NPTI), which is an
administrative support unit, shall be responsible for the conduct of mandatory and
leadership training of all Police Non Commissioned Officers (PNCOs). The supervision
and control over the NPTI shall be established in the Revised Table of Organization and
equipment and staffing pattern under Section 68-B of RA No 11279.

The NAPOLCOM, in the exercise of its oversight functions, shall have supervision and
control over the formulation and implementation of the training programs of the PNTI
and the PNPA.

5.1. The following courses for PNCOs shall continue to be provided by the NPTI:

a. Mandatory and Leadership Courses

a.1. Public Safety Basic Recruit Course (PSBRC)

a.2. Public Safety Junior Leadership Course (PSJLC)

a.3. Public Safety Senior Leadership Course (PSSLC)

a.4. Public Safety Officers Candidate Course (PSOCC)


b. Other courses that may hereinafter be developed.

5.2. The NPTI shall be a National Administrative Support Unit (NASU) under Section 35,
RA 6975.

5.3. The NPTI shall be headed by a Director with the rank of Police Major General.

5.4. The Chief PNP shall create the NPTI Academic Board. The membership of which
shall be determined after the approval of the Revised Table of Organization for the PNPA.
In the interim, the current NPTI Academic Board shall remain to function as such until a
new Board is constituted consistent with the Transition Plan or the approved Revised
Table of Organization.

Notwithstanding this provision, the Chief, PNP may designate additional members of the
NPTI Academic Board provided that such additional members shall possess similar or
equivalent rank and status as its existing members.

COMMON PROVISIONS
FOR THE TRANSFER OF THE PNPA AND NPTI

Section 6. Creation of the Corps of Professors.– The PNP shall establish


and maintain a corps of professors for the PNPA, NPTI and other training , which shall be
primarily composed of the uniformed and non-uniformed personnel of the PNP and
complemented by practitioners in the justice, security and other allied sectors. The
qualifications of the members of the Corps of Professor shall be determined by the PNP
and shall have permanent employment status in the career service once appointed and
qualified. Provided further, that the existing personnel of the PNPA holding permanent
positions shall be given preference in the appointment as members of the Corps of
Professor subject to the qualifications hereinafter determined.

Section 7. Personnel. All civilian personnel occupying permanent plantilla


positions at the PNPA and the NPTI shall be transferred to the PNP and shall continue to
perform their respective duties and responsibilities and receive their corresponding
salaries and benefits. Provided, however, that holders of permanent plantilla positions
who will be displaced upon the designation of PNP uniformed personnel to hold such
positions shall have the option to be put on detailed service at the PPSC with the
concurrence of the PNP and approval of the DILG Secretary.

Existing positions at the PNPA, particularly the Chief Administrative Officer, the Supervising
Administrative Officer, Planning Officer V and Planning Officer IV, shall be retained by the
PPSC.

Within one hundred twenty (120) days from the effectivity of this Act, the Chief of the PNP
shall submit the revised organizational structure and staffing pattern of the PNPA and the
NPTI to the National Police Commission (NAPOLCOM) and the Department of Budget and
Management (DBM) for approval. Existing permanent plantilla positions which are not
included in the revised organizational structure and staffing pattern of the PNPA as
approved by the NAPOLCOM and the DBM shall be transferred to the PPSC to complement
its regular workforce.
Unfilled positions from the NPTI and its Regional Training Schools shall be retained with
the PPSC and reclassified into academic positions to form part of the academic workforce
of the restructured PPSC.

Finally, to avoid disruptions in the operations of the PPSC and to ensure the effective and
efficient delivery of its programs and courses, the PNP, BFP and BJMP shall make available
its qualified personnel and cause their detail service to the PPSC to augment its personnel
complement.

Section 8. Real Properties, Facilities and Equipment. By operation of law,


the management and administration of all real properties, to include building, structures
and equipment, and other training facilities within the compound of the PNPA shall be
transferred to the PNP. Provided, however, that real properties, permanent structures
and equipment situated within the compound of the PNPA and the NPTI which are being
utilized or intended to be utilized for the conduct of mandatory trainings for BFP and
BJMP personnel and Police Commissioned Officers under the supervision of the National
Police College, particularly the campuses in Magalang, Pampanga, Consolacion, Cebu,
Pasonanca, Zamboanga City and Mintal, Davao City shall remain to be administered and
maintained by the PPSC and shall be available for joint use and benefit of the PNP and
the PPSC.

For purposes of proper turn-over of properties, the following activities shall be


undertaken:

8.1. A joint-committee from the PNP, PPSC, PNPA and NPTI shall be created, the functions
of which is to conduct full inventory of the existing properties, facilities, records,
equipment, funds, appropriation, choses of action, rights, functions, other assets and
liabilities of the PNPA and the NPTI under the books of the PPSC;

8.2. The joint-committee shall identify the existing properties, facilities, records,
equipment, funds, appropriation, choses of action, rights, functions, other assets and
liabilities to be transferred to PNP.

8.3. The joint-committee shall likewise identify the properties to be retained by the PPSC,
its metes and bounds, such as but not limited to the existing properties where the NPC-
main campus and its campuses in Magalang, Pampanga, Consolacion, Cebu, Pasonanca,
Zamboanga City and Mintal, Davao City, NFSTI training center, Fire and Jail Training
Centers, among others, which said training centers/institutions have been retained by the
PPSC;

8.4. The joint-committee, after completion of the full inventory identifying the properties to
be transferred to the PNP as well as the properties to be retained by the PPSC, shall submit
a detailed report for approval of the heads of the PNP and the PPSC;

8.5. Thereafter, the management and administration of all real properties and the existing
building and structures thereon and other training facilities except the NPC-main campus
located within the premises of Camp Mariano Castaneda, Silang, Cavite and its campuses
in Magalang, Pampanga, Consolacion, Cebu, Pasonanca, Zamboanga City and Mintal,
Davao City, the NFSTI training center, the Fire and Jail training centers, shall be
transferred to PNP;
8.6 All records, equipment, funds, choses in action, appropriations, rights, functions,
liabilities and other assets pertaining to the PNPA and the NPTI, shall likewise be
transferred to the PNP.

Section 9. The Restructured Philippine Public Safety College. The


Philippine Public Safety College (PPSC) shall continue to be the premier educational
institution for the training, human resource development, and continuing education of all
personnel of the Bureau of Fire Protection (BFP) and Bureau of Jail Management and
Penology (BJMP) and the provider of select mandatory career courses of Police
Commissioned Officers and specialized courses for personnel of the PNP.

The College shall be under the direct supervision of a Board of Trustees composed of
the Secretary and three (3) Bureau heads and the PPSC President as ex-officio member
who shall likewise provide for Secretariat services to the Board.

Within one hundred twenty (120) days from the promulgation of this IRR, the PPSC
shall submit to the PPSC BOT its restructured organization plan for submission to the
DBM.

Section 10. Composition, Powers, and Functions of the PPSC.

10.1. Composition. The college shall be composed of the following units:

a. The National Police College (NPC), which shall be the provider of the mandatory
career courses for Police Commissioned Officers (PCOs), namely Public Safety
Officers Orientation Course (PSOOC), Public Safety Officers Basic Course (PSOBC),
Public Safety Officers Advance Couse (PSOAC), Public Safety Officers Senior
Executive Course (PSOSEC), the Master in Public Safety Administration (MPSA) to
satisfy the training and educational eligibility for purposes of promotion and of other
career courses and degree programs that may hereinafter be developed.

b. The National Forensic Science Training Institute (NFSTI), which shall provide the
Investigation and Detective Course (IDC), Traffic Investigation Course (TIC), and
Narcotics Investigation Course (NIC), and other specialized courses that may
hereinafter be developed for all security sector personnel.

c. The National Jail Management and Penology Training Institute (NJMPTI), which
shall provide the necessary courses for the personnel of the Jail Bureau.

d. The National Fire Training Institute (NFTI), which shall provide the necessary
courses for the personnel of the Fire Bureau.

e. Other Special Training Centers which may be created within the Department by the
DILG for purposes of training of the bureaus.

10.2 Powers and Functions. The College shall exercise the following powers
and functions:

a. Formulate and implement training programs for all personnel of the Fire and
Jail Bureaus and other allied agencies;

b. Formulate and implement mandatory career courses for Police Commissioned


Officers;

c. Formulate and implement specialized courses for personnel of the PNP;

d. Establish and maintain adequate physical training facilities;

e. Design and implement research and development processes to support


educational training programs;

f. Conduct an assessment of the training needs of all its clientele; and

g. Perform such other related functions as may be prescribed by the Secretary

Section 11. Transition.

11.1. Transfer of Funds Allocated to the PNPA and the NPTI.

a. Phase 1.
b. Phase 2.
c. Phase 3.
d. Phase 4.
e. Phase 5.

Section 12. Repealing Clause. All rules and regulations, office orders, circulars and
other issuances or parts thereof which are inconsistent with this IRR are hereby repealed,
amended or modified accordingly.

Section 13. Separability Clause. In case any provision of this IRR or any portion
hereof is declared unconstitutional, the remaining provisions shall not be affected
thereby.

Section 14. Effectivity. This IRR shall take effect after 15 days from its publication
in the official gazette and filing of a copy with the UP Law Center.
