2. To cause the preparation and filing of any and all documents
necessary for or relative to the foregoing cases such as but not limited to the
Petition and the Verification and Certification Against Forum Shopping of said
petition, the reply and/or other necessary documents;
3. To engage, as he deems fit, the services of a legal counsel who
shall represent me in the foregoing cases and to sign the appropriate contracts
relative to such engagements;
4. To represent me in the mediation, conciliation, arbitration, pre-trial
and subsequent hearings of the civil case for recovery of possession and damages
for and any all purposes such as but not limited to the following:
a. To discuss and explore the possibility of an amicable
settlement and/or to enter into alternative modes of dispute
settlement, indicating the desired terms thereof;
b. To submit the case to arbitration;
c. To agree on a simplification of the issues;
d. To amend and/or agree to the amendment of the pleadings;
e. To obtain stipulations or admissions of facts and documents
to avoid unnecessary proof;
f. To limit the number of witnesses;
g. To refer issues to a commissioner;
h. To agree on the propriety of rendering judgment on the
pleadings, or summary judgment, or of dismissing the
action should a valid ground therefor be found to exist;
i. To agree on the advisability or necessity of suspending the
proceedings; and
j. To agree on such other matters and do such things as may
aid in the prompt disposition of the action.
5. To represent me in the preliminary conference, pre-trial and subsequent
hearings of the criminal cases for any and all purposes such as but not limited to the
following:
a. Plea bargaining;
b. Stipulation of facts;
c. Marking for identification of evidence of the parties;
d. Waiver of objections to admissibility of evidence;
e. Modification of the order of trial if the accused admits the
charge but interposes a lawful defense; and
f. Such matters as will promote a fair and expeditious trial of
the criminal and civil aspects of the case;
6. To sign, counter-sign, prepare, execute and/or submit (or cause the
preparation, execution and submission of any and all necessary documents and, in
general, to perform any and all acts necessary to effect any and/or all of the authorities
mentioned in this Special Power of Attorney.
HEREBY GIVING AND GRANTING unto my said attorney full power and authority
to do and perform all and every act requisite or necessary to carry into effect the foregoing
authorities, as fully to all intents and purposes as I might or could lawfully do if personally
present, with full power of substitution and revocation, and hereby ratifying and confirming all
my said attorney or his substitute shall lawfully do or cause to be done by virtue hereof.
