Coven eas ws Donen ra Supplemental Guid ADMINISTRATIVE ORDER No. _3!2 Series of 2019 es in the Implementation of Tulong Panghanapbuhay sa Ating Disadvantaged/Displaced Workers (TUPAD) Program Relative to the Special Provisions of Republic Act No. 11260 (General Appropriations Act FY 2019) Pursuant to the special provisions of Republic Act No. 11260 (General Appropriations Act FY 2019), the following supplemental Guidelines is hereby issued relative to the implementation of the Tulong Panghanapbuhay sa Ating Disadvantaged/Displaced Workers (TUPAD) Program. |. Definition of Terms a b. Massive displacement — refers to the large-scale displacement of workers in the formal and informal sectors brought about by FORCE MAJEURE or EXTRAORDINARY CIRCUMSTANCES resulting in the serious disruption of means of livelihood. a.1. Extraordinary circumstances — refers to an event or occurrence or series of events or occurrences characterized by major disruption in the livelihoods of workers as a result of policy decisions/reforms and development efforts, i.e. Rehabilitation of Boracay Island, Rehabilitation of Manila Bay, Passage of Train Law, North-South Commuter Railway Extension Project, Public Transport Modernization Program, Resettlement of Informal Settlers, etc. a.2 Force majeure — refers to an event beyond the control of workers and/or owner of establishments, such as natural calamities, armed conflicts, economic crisis, etc, as the case may be, which have resulted to the displacement and loss of income of the affected workers. ‘Sub-professionals - individuals who hold the first level position under the Revised Administrative Code of 1987, which includes the clerical, trades, crafts, and custodial service positions requiring less than four years of collegiate studies, ll. Qualified Beneficiaries — The following are qualified as beneficiaries of the TUPAD Program: 1. Displaced workers caused by massive displacement brought about by force majeure or extraordinary circumstances; Self-employed workers, including farmers and fishermen, who have lost their livelinoods due to natural calamities/disasters, economic crisis, armed conflicts, and/or seasonality of work; Laid-off or terminated workers as a result of retrenchment or permanent closure of an establishment; 4. The underemployed, including sub-professionals involved in structured work in ‘support of office operations or those engaged in arts, crafts, and manual or clerical work. Only one member of a household shall be qualified to avail of the program for each year. However, a beneficiary can avail again in the event that he/she becomes a victim of another calamity/disaster. Ill, Period of Work - The TUPAD Program shall be implemented for a minimum of ten (10) days but not to exceed ninety (90) days depending on the nature of work to be performed. Eligible Projects Maximum No. of Days * Light works, such as street sweeping and cleaning of public | __15 facilities * Social community projects such as de-clogging of canals,{ 45 debris segregation and materials recovery, stockpiling and clearing during the aftermath of a calamity/disaster * Social community projects such as minor repair of common | 60 public facilities such as schools and health centers ‘+ Government projects requiring improvement of government | ___90 facilities and infrastructures such as health centers, irrigation canals, roads, evacuation centers, school buildings, and the like. * Economic community projects such as maintenance and/or rehabilitation of farm to market roads, bridges, post-harvest facilities, public markets, and common public facilities such as production and display centers, fish ports, etc. + Agro-forestry and eco-agriculture farming which include tree planting, seedling preparation, reforestation, and crop growing. + Field works, such as conduct of survey and profiling, in partnership with other government offices IV, Package of Assistance As provided for in Section 7 of D.O. 173-17, the following package of services will be provided to the TUPAD beneficiaries, which includes the following: (1) Payment of wages equivalent to 100% of the highest prevailing minimum wage in the region; (2) Coverage to micro-insurance; (3) Conduct of Basic Orientation on Safety and Health; (4) Provision of Personal Protective Equipment (PPE), except for those who will be engaged in office works; and (6) Cleaning tools for light works and social community projects of 10-45 days. V. Modes of Implementation The TUPAD Program shall be implemented either through Direct Administration or through Accredited Co-Partners (ACPs). The implementation of TUPAD program shall not require counterpart funding from the local government units (LGUs) or any of DOLE's accredited program partners, but they shall be able to provide technical assistance which could be in the form of identification of projects, profiling of beneficiaries, procurement, monitoring, and facilitating access of services from other agencies. TUPAD Projects involving 46-90 days, shall be implemented in partnership and/or complementation with agencies implementing public projects, such as the Department of Public Works and Highways (DPWH), the Department of Environment and Natural Resources (DENR), Local Government Units, as well as private sector entities willing to engage in public projects.
