Preliminaries
1. This Judicial Affidavit is in Bisaya (with English translation), a
language known to and understood by the complainant.
2. The witness is JANJAN C. AZURA, Filipino, 35 years old, and a
resident of Purok 10, Sitio Agpangon, Brgy. Poblacion, La paz,
Agusan del Sur.
3. The Affidavit of Witness JANJAN C. AZURA is given on the
13th day of 2019 before Atty. Marceliano Monato III, at Patin-ay,
Prosperidad, Agusan del Sur.
Question: Ikaw ba o sulti sa kamatuoran og way lain kundi ang tibuok
kamatuoran?
(Do you swear to tell the truth and nothing else but the whole

(Do you know that you can be charged of perjury for any false
statement that you will make in this investigation?)

A: Ako naga saysay dinhi aron sa pagtestigo sa pagsunog ni Dany
Hawile og uban pa niyang mga kauban, sa payag ni Jose Buyante nga
taga Purok 5, Poblacion La pAz Agusan del Sur.
(I am executing this Affidavit to testify that Dany Hawile with others burned
the makeshift house/hut of Jose Buyante a resident of Purok 5, Poblacion La
pAz, Agusan del Sur.)

July 28, 2019 at around 12:00am)
3. Q: Kinsa mana si Danny Hawile og nganong naka ila man ka niya?
(Who is Danny Hawile and why do you know him?)
A: Si Danny Hawile, taga Purok 1, barangay Poblacion, La Paz,
kauban nako na mag treasure hunting sa una, mga isa (1) ka tuig mi
nag uban ana og barkada pud mi. Kana siya bayaw ni Tony Compedio
nga kabangi ni Jose Buyante sa yuta kung asa gisunog ang payag.
Sulogoon pud na siya sa mag asawang Gina og Tony Compendio sap
ag lampas sa gibangian nga yuta.
(Danny Hawile, a resident of Purok 1, barangay Poblacion, La Paz, is a
fellow and we were together in treasure hunting before for almost one (1)
year and we were friends. Dany is an in-law of Tony Compedio who has a
land conflict with Jose Buyante the owner of the burned hut/makeshift
house. He is the servant of spouses Gina and Tony Compendio in weeding
the conflicted land.)

July 28, 2019 sa may alas dose (12) ang takna sa gabii?
(What do you remember on July 28, 2019, at around 12am in the evening
?)
A: Niadtong petsa July 28, 2019, mga alas dose sa gabii (around 12:
00 midnight) and among iro sige og paghot, mao tong ni naog ko og ni
tan aw ko unsay gi paghotan sa iro. Naka matikod ko nga diha sa
karsada naay duha ka motor nga naay angkas tag duh aka tao. Ang isa
ka motor gi naog si Dany Hawile tungod sa payag ni Jose Buyante,
dayon ang motor nipalayo padulong sa ngit-ngit nga bahin sa karsada.
Tungod sa ang payag ni Jose Buyante naay atbang balay nga naay
suga, nakita nako og maklaro si Dany Hawile.
Sa pag naog ni Dany, naay siyay gi dala nga botelya sa litro og gi bubo
sa kilid sa payag. Iyang gi sindihan og lighter og nasunog ang payag. Ni
lakaw dayon siya padulong sa nag hulat nga motor didto sa unahan.
(On July 28, 2019 at around 12:00 midnight, our dog keep on barking, and I
went out to see around. In the road, I noticed two motorcycle with two (2)
riders each. One motorcycle dropped by Dany Hawile in front of the
makeshift house of Jose Buyante, then the motorcycle went away and stayed
from a distance with the other motorcycle. Just across the makeshift house is
another house with a light illuminating the area, so I can see Dany Hawile.
When Dany alighted from the motorcycle, he was carry sa bottle (liter) and
he pour the content beside the makeshift. He lighted a lighter and the
makeshift was set on fire. He walk away going to the motorcycle waiting
nearby. )

Hawile?

(Do you know a conflict between Jose Buyante and Dany Hawile?)
A: Oo sir. Kanang sa yuta nga naka tituto kang Jose Buyante og iyang
maguwang nga si Manolito, gi angkon na sa mag asawang Tony og
Gina Compendio. Diha sa yuta, nag tukod og payag si Jose niadton
Mayo 2019. Kana si Dany Hawile maoy ginasugo sa mag asawa para
tikaron ang yuta nga gi ilogan nila. Niadtong Aogsto 1, 2019 didto sa
pag husay sa barangay ingon si Dany kang Jose nga “Di ka mo tamak
diha sa among yuta” nga pina bahad ang tingog og gitudlo pud siya.
(Yes Sir. That land registered in the name of Jose Buyante and his brother
Manolito, has been claimed by spouses Tony and Gina Compendio. In that
land, Jose Buyante put-up a makeshift house/hut last May 2019. Dany
Hawile has been cultivating the land for the spouses. Last August 1, 2019
during a settlement in the barangay hall, Danny told Jose “Don’t set foot
on our land” while pointing finger in a threating manner)
6. Q: Sa dihang wala pa masunog ang payag ni Jose Buyante, naa ba kay
laing namtikdan o nadungog kang Dany Hawile nga sunogon niya ang
payag?
(Before the makeshift burn, did you notice or hear anything from Dany
Hawile that he will burn it?
A: Naa sir. Niadtong July 26, 2019, gi suholan ko sa akong silingan
nga gub-on ang iyang balay tapad sa payag ni Jose. Adtong adlawa
diha sa yuta nga gi tukuran og payag, nag lampas sila Dany og laing
mga tao nga taga barangay Comota La Paz. Samtang nag lampas sila,
akong na dunggan si Dany ni ingon “Sige pati nang payag sunoga
ninyo”.
( Yes sir. Last July 26, 2019, I was contracted by a neighbor to dismantle
his house near the makeshift of Jose. Dany Hawile together with men from
barangay Comota La paz, weeded the land on which the makeshift stood.
While weeding, I heard Dany saying “Burn it including the makeshift hut”.
)

A: Wala na sa pagka karon, kung naa man koy idugang, ako ra isulti
