Violators will be fined PHP 1,000 for the first offense, PHP 1,500 for the second offense, and PHP 2,500 or 6 months imprisonment for the third offense. Emergency vehicles responding to emergencies are exempted from this ordinance.

AN ORDINANCE PROHIBITING THE IRRESPONSIBLE AND RECKLESS BLOWING OF


HORNS, FLAGRANT USE OF MEGAPHONES, LOUDSPEAKERS, VIDEOKE MACHINES AND
VEHICLES WITH LOUD SOUND SYSTEM, AS WELL AS THOSE WITH MODIFIED
PIPES/MUFFLERS RESULTING TO THE EMMISSION OF EXCESSIVE AND
UNREASONABLE SOUND NOISE, WITHIN THE VICINITY OF CHURCHES, PLACES OF
WORSHIP, HOSPITALS, MATERNITY CLINICS AND OTHER HEALTH INSTITUTIONS
AND SCHOOLS, WITHIN THE TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF
STO. TOMAS, BATANGAS PROVIDING PENALTIES FOR VIOLATION THEREOF, AND FOR
OTHER PURPOSES

SECTION 1. For purposes of this ordinance, the following terms shall be understood to
mean as follows;

a. HORN – a device for sounding warning signals: an automobile horn.

b. IRRESPONSIBLE AND RECKLESS BLOWING OF HORNS, INSTALLATION OF


MODIFIED PIPES/MUFFLERS and FLAGRANT USE OF MEGAPHONES,
LOUDSPEAKERS, VIDEOKE MACHINES, AND VEHICLES WITH LOUD SOUND
SYSTEM, AS WELL AS THOSE WITH MODIFIED PIPES/MUFFLERS RESULTING
TO THE EMISSION OF EXCESSIVE AND UNREASONABLE SOUND NOISE. – This
refers to the act or practice of blowing horns, utilizing loud sound system,
installation of modified pipes/mufflers, and flagrant use of the above-mentioned
sound instruments, that emit exceptionally loud, startling disagreeable, disturbing
or offensive noise or sound thus annoying the comfort, peace and convenience of
motorists, pedestrians, school children, school faculty and administrators, doctors,
patients and other medical staff or personnel, priests, churchgoers as well as
religious officials, and the likes;

c. EMERGENCY – an incident that poses imminent threat to life, health, property and
environment

SECTION 2. It shall be unlawful for motorists or drivers of motor vehicles, to irresponsibly


and recklessly blow their horns, utilize loud vehicle sound system, installation of modified
pipes/mufflers, as well as the prohibition to the flagrant use of the above-mentioned sound
instruments within ONE HUNDRED METERS (100) from the vicinity of churches, places of
worship, hospitals, maternity clinics and other health institutions, and schools, within the
territorial jurisdiction of our municipality, especially during school hours or when masses
are being held or when other religious or sacred rites or ceremonies are being celebrated,
except during emergency cases or abnormal situations which inevitably lead to the
making of loud and annoying noises. Likewise, police vehicles in hot pursuit, fire
trucks responding to fire incidence, and ambulance and other emergency health
vehicles are exempted from the coverage this ordinance.

SECTION 3. For violation of Section 2 hereof, the offender shall be punished by a fine of
ONE THOUSAND PESOS (PhP 1,000.00) for the first offense. For the second offense, the
offender shall be meted a fine of ONE THOUSAND FIVE HUNDRED PESOS (PhP
1,500.00), and for third offense, a fine of TWO THOUSAND FIVE HUNDRED PESOS (PhP
2,500.00) or be sentenced to an imprisonment of six (6) months or both at the discretion
of the court.

SECTION 04. Declaration of Intent to Conform with Law- This Ordinance is subject to
national laws, rules and regulations governing its subject matter.

SECTION 05. Separability Clause – If any part, section or provision of this Ordinance is
declared invalid or unconstitutional, other provisions not affected thereby shall remain in
full force and effect.

SECTION 06. Repealing Clause- All ordinances, rules and regulations or parts thereof,
which are inconsistent with, or in conflict with the provision of this ordinance shall be
deemed repealed, amended or superseded accordingly.

SECTION 07. Effectivity – This Ordinance shall take effect upon approval.
