TRAINEE OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into by and between:

______________________, a corporation duly organized and existing


under laws of the Republic of the Philippines with principal office address at
__________________________ represented by its _________,
_________________, hereinafter referred to as “Company”

And

____________________________, of legal age, Filipino and a resident of


______________________________, hereinafter referred to as “Trainee”

-WITNESSETH-

NOW IT IS HEREBY AGREED AS FOLLOWS: in consideration of the mutual


benefits and responsibilities specified in this Agreement, the receipt and sufficiency of which
consideration is hereby acknowledged, both parties to this Agreed as follows:

1. That under the terms of this Agreement, the Company agrees to provide the
Trainee with a Traineeship Program for identified learning objectives and the
Trainee agrees to provide all work and services reasonably required by the
Company.

2. That the Trainee is expected to attend the training period for Sales Promotional
Associate position, which will commence on __________________ and shall ended
on ________________, with review and evaluation of the position at the end of
every week during the traineeship Period.

3. That the Trainee will commit one (1) month to work on her trainee obligations
with minimum of ___ hours per day/week of the training period. She will be
trained for one (1) week at the Company’s office and will be deployed for three
(3) weeks at Mercury Drugstores.

4. That any task undertaken by the Trainee while on a traineeship period will have
the purpose of promoting the Trainee’s competence, understanding and
familiarity of the Company’s business as well as in the Trainee’s agreed learning
objectives.

5. That the Trainee will be under the obligation to the Company to make
satisfactory progress on the training period program.

6. That the Trainee will be expected to reach a reasonable standard of competence


and performance for each task for which she has been trained.

7. That no employer/employee relationship shall be construed from this Agreement.


The Trainee is responsible for his acts and omissions, and shall hold the
Company free and harmless from any and all claims and losses, costs and
expenses including attorney’s fees, arising from such acts or omissions, except for
claims and losses caused by the fault or negligence of Company. Moreover, the
Trainee is expected to behave as part of the Company and shall abide by all the
terms and conditions applicable to the Company’s own staff and respect the
Company’s policies, values and procedures.
8. That the Trainee will be given a per diem allowance with liquidation during the
traineeship period. Aside from the per diem allowance they will also be given sale
incentives.

9. That the Trainee must keep a record of all task through the daily task and time
record.

10. That the Company will designate an individual (Trainer) to train, mentor, and
monitor the Trainee. The Trainer shall primarily point of contact for the Trainee.
Any request from the trainee should be communicated to the Trainer.

11. That the Trainee wishing to terminate the traineeship period must give one-week
notice to the Trainer.

12. That the Company may terminate the Traineeship period during the training
period itself if the Trainee is unsatisfactory and by the discretion of the Trainer to
terminate the Trainee’s training.

13. Grounds for immediate termination as determined solely by the Company include
but not limited to the following actions or events:

a. Unauthorized absences or lack of communication


b. Incapacity to attend training experience
c. Inappropriate language or conduct to the Company’s customer or
employees
d. Inappropriate behavior to any Company’s customer or employees
e. Misuse of information of the Company
f. Failure to make progress in the skills and towards the goal set out between
the Trainee and Trainer
g. Fraud or any criminal offense
h. Breach of this agreement

14. That after the Trainee successfully and satisfactory reach the reasonable standard
set forth in this agreement, she will be recommended as probationary employee of
the Company for a period of five (5) months. During her probationary status she
will be receiving basic pay and commission beginning from the 4th month of her
Probationary period. A separate Probationary Contract will be executed and signed
by the parties.

15. That the progress and performance of the Trainee will be reviewed and evaluated
during and after the training period and performance review shall be conducted
with the following criteria:

a. Standard of work and behavior during training period


b. Reliability and performance
c. Timekeeping and Task Record
d. General Conduct.

NOW THEREFORE, this Agreement takes effect on _____________________


and shall last indefinitely until either party opts to terminate the same anytime. Any
pending transaction BEFORE said termination MUST however be completed and be
paid for.
