INTERIOR Division { \, \y Nomricarion “ “Islamabad, the 2nd April, 2002 S.R.O. 198(1/2002.—In exercise of the powers conferred by section 44 of the National Database and Registration Authority Ordinance,2000 (VIII 0 2000), read with clausg (b) of sub-section (4) of section 5, section 8, section 1! and sub, section (3) oP ection 17 thereof, the Federal Government is pleased to make the following rules, nately -— ; I Short title, commencement and application—(1) These rules may be called the National Database and Registration Authority (Pakistan Origin Card) Rules, 2002. (2) These shall come into force at once G) ‘These shall apply to all eligible foreigners of Pakistan Grigin and eligible family members as defined in these rules wherever they may be. (883) Pri (261 (2002) Ex. Gaz.) jetta Definitions.—(1) In these rules, unless there is anything repugnant in nteNty (a) “appligation” means an application specified under sub-rule (1) of rule iN " 7 (b) “card” means the Pakistan Origin Card , (c) “citizen of Pakistan” means a citizen as defined in the Ordinance (@) “eligible foreigner of Pakistan origin” means an eligible foreigner of Pakistan origin as specified in rule (c) “eligible family member” means an eligible family member as provided in rule 5; (f) “enemy country” means an enemy country so declared by the competent authority ; (e) “foreigner” means a foreigner as defined in the Ordinance ; (h) “Ordinance” means the National Database and Registration Authority Ordinance, 2000 (VIII of 2000) ; and ( “relative” means and includes, in respect of an applicant for a card, his rea! parent, real grandparent, real child, real grandchild, real brother _ or sister, real child or real grandchild of such real brother or sister, real brother of sister of any of real parents, first cousin, or real child or real grandchild of such first cousin. (2) The words and expressions used but not defined in these rules shall have the same meaning as in the Ordinance. 5 3. Registration: —(1) Any eligible foreigner of Pakistan origin desirous of obtaining a card may get himself registered with the Authority, and the Authority shall register him, in accordance with these rules. (2) Any eligible family member of an eligible foreigner of Pakistan origin,” whether such eligible foreigner of Pakistan origin is deceased or alive and, whether or not he gets himself registered under these rules, may get himself registered with the Authority, and the Authority shall register him, in accordance with these rales. Paxr ll} THE GAZETTE OF PAKISTAN, EXTRA.,APRIL3, 2002 885 le foreigner of Pakistan origin.—(1) A person shall be an cliyible foreigner of Pakistan origin if (a) heis a foreigner, and (b) he had been a citizen of Pakistan at any time during his life: Provided that he— (i) was not deprived of citizenship of Pakistan by an order passed by the Federal Government under sub-section (2) or (3) of section 16 of the Pakistan Citizenship Act, 1951 (Il of 1951); i) did not cease to be a citizen of Pakistan under sub-section (1) of section 16A of the Pakistan Citizenship Act, 1951 (II of 1951); (ii) was not a person who, being a citizen of Pakistan, at any time before the sixteenth day of December, 1971, and domiciled in the territories which before the said day constituted the Province of East Pakistan, continued to be a citizen of Pakistan under the proviso to sub-section (1) of section 16A of the Pakistan Citizenship Act, 1951 (I of 1951); (iv) was not discontinued to be deemed a citizen of Pakistan under sub-section (2) of section 16A of the Paksitan Citizenship Act, 1951 (II of 1951), upon meking an application made by him to the Federal Government, and the Federal Government granted him a certificate under the said sub-section (2) that he was a citizen of Pakistan on the date of such certiticate; (¥) sis not, and never was, a citizen or national of an independent, state or country, excluding Pakistan, comprising of any of the territories included in India on the thirty-first day of March, 1937; (vi) is not, and never was, a citizen or national of a state or country not recognized by Pakistan; and (vi) is not a citizen or national of an enemy country.
