APPLICATION FOR PROBATION

ACCUSED-APPLICANT RUBEN LAMBERTE CABASA, through


the undersigned counsel, most respectfully applies for probation under
the provisions of P.D. No. 968, as amended and states:

l. That the accused is of legal age, Filipino, and a resident of El Pardo,


Boljoon, Cebu;

2. That last March 2, 2020, the accused when re-arraigned, pleaded


guilty to the lesser offense under Section 12 of R.A. 9165 and was
sentenced to suffer the penalty of imprisonment for a period of nine
(9) months and meted a penalty of fine in the amount of Ten
Thousand Pesos (P10, 000.00);

3. That the crime for which the accused was convicted is not an offense
against the security of the state or the crime against public order;

4. That he has not been convicted by final judgment of any offense


punished by imprisonment of not more than six months and one day
and/or a fine of more than ONE THOUSAND (P1,000.00) PESOS;

5. That he has not been on probation once under the provisions of P.D.
No. 968, as amended;

PRAYER

WHEREFORE, foregoing premises considered, it is most


respectfully prayed of this Honorable Court to give due course to this
Application for Probation and place herein Applicant on probation in
accordance with law.
Other reliefs, just and equitable under the premises, are also
prayed for.
