APPLICATION FOR PROBATION

ACCUSED, through the undersigned counsel, unto the Honorable


Court, and invoking the provisions of Presidential Decree No. 968 (PD
968), as amended, most respectfully states THAT:

1. Through a plea bargaining agreement, he was convicted in


the above-captioned cases for violation of Section 12,
Article II of RA 9165. Accused was sentenced to suffer a
straight penalty of ONE (1) YEAR FOR EACH COUNT
and was likewise ordered to pay a fine of TEN
THOUSAND PESOS ( Php 10, 000.00) for each case;

2. He desires to avail of the benefits of the Probation Law.


#0255, Brgy. Rizal Tramo, Sta. Rosa. Nueva Ecija;

3. He has not been sentenced to serve a maximum term of


imprisonment of more than six (6) years;

4. He has not been convicted of any offense against the


security of the state nor convicted by final judgment of
offense punished by imprisonment of not less than one (1)
month and one (1) day and/or a fine of not less than
P200.00;

5. He has not previously undergone probation under the


provisions of P.D. 968, as amended;

6. He humbly seeks indulgence of thy Honor to allow him to


enjoy the benefits of PD 968 or the probation law.

7. Accused likewise prays that the fine imposed be included


in the probation.
WHEREFORE, it is most respectfully prayed of the Honorable
Court that the above application for probation be favorably acted upon.
