This Tender Invitation is issued in accordance with the World Food Programme’s Rules and Regulations
governing Food Procurement.

This Tender Invitation does not constitute a binding or enforceable contract or agreement between the
Parties. It is merely a non-binding request for offer and there is no obligation for the World Food
Programme to accept any offer made following this Tender Invitation, even if such offer is fully matching
the terms of the Tender Invitation.

This Tender Invitation is subject to the Specific Terms detailed here below and to the World Food
Programme's General Terms and Conditions effective 25th July 2018 (the "General Terms & Conditions")
that are herewith attached and that form an integral part of the Tender Invitation.

IT IS MANDATORY FOR ALL BIDDERS TO COMPLETE ALL OFFER DETAILS IN THE “FOOD QUESTIONNAIRE”
IN IN-TEND TENDERING SYSTEM. ANY OFFERS WHICH ARE NOT COMPLETED IN THE “FOOD

Loading at anchorages is not accepted by WFP.
Offer to state carrying charges, if applicable, in case of presentation of the
vessel after the last day of the shipment period.
If carrying charges are not mentioned in the offer, it will be considered that
there are no carrying charges.
SELLER TO ALSO PROVIDE ANY APPLICABLE PORT/VESSEL RESTRICTIONS (SUCH
AS DRAFT, LOA, BEAM, ETC.).
SELLERS ARE TO ADVISE STOW TIER LIMITATION, IF ANY
STEVEDORES ARE NOT TO EMPLOY HOOKS FOR LOADING BAGGED CARGOES
AND TO FOLLOW THE MASTER’S INSTRUCTIONS FOR PROPER VESSEL STOWAGE
AND STABILITY.
Please refer to attached General Conditions for full delivery terms
requirements.

4) CONTAINERISED CARGO:
Clearly indicate gross weight and net weight/intake per full container load (20 foot).

account.

Offer to state carrying charges, if applicable, in case of presentation of the vessel after the

One seaway bill of lading should not contain more than 30 containers, and each Seaway
bill of lading must have its set of cargo certificates.

5) BULK / BREAKBULK CARGO ONLY:

a) Should there be any risk of or presence of ice, the suppliers agree to guarantee
safe/free navigation and movement of the vessel to/inside/from rivers and ports.
Any administrative/legal/material support required to achieve above conditions are
to be provided by suppliers at their risk/time and expenses.

All time to count as laytime, or time on demurrage if the vessel is on demurrage.


Whenever a conflict exists between this provision and clause 34 (ice) of WFP Charter
Party the latter shall prevail.

b) WFP chartered vessel(s) will only appoint WFP nominated agents. WFP will not
accept any other ship agents proposed by the suppliers/shippers.

c) As per “WORLDFOOD 2017” Charter Party, only WFP “Non-negotiable cargo receipt
(NNCR)” will be issued as cargo documents. Any other “Bills of Lading” and “customs
purposes only” documents will not be accepted.

d) The split of NNCRs will be according to WFP’s request and shipping instructions only.
WFP will not accept multiple NNCRs and/or any other split of documents due to
suppliers’ various sub-contractors/ local shippers requirements.

e) The Sellers shall be responsible for damage (beyond ordinary wear and tear) caused
by their stevedores (or stevedores contracted by their sub-suppliers) to any part of
the Vessel. Such damage shall be notified as soon as reasonably possible, but latest
when the vessel is sailing from her loading port, by the Master to the Sellers or the
Agents at loading port and to Sellers’ stevedores. The Master shall endeavour to
obtain the stevedores’ written acknowledgement of the damaged caused. However,
Sellers always remain ultimately responsible.

The Sellers have the right to repair any stevedore damage at any time prior to
completion of the voyage where practicable, or otherwise at a place mutually agreed
between the parties but must repair stevedore damage affecting the Vessel’s
seaworthiness or class before the vessel sails from the port where such damage was
caused or found. All additional expenses incurred shall be for the account of the
Sellers and any time lost shall be for the account of and shall be paid to the Owners
by the Sellers at the contracted demurrage rate.

f) Additional documentation required:

A Crop Year certificate for each lot to be attached to the shipping documents containing
following information:
• Production lot and quantity of the lot
• Crop Year yyyy

6. DELIVERY PERIOD (FOB Contracts) :

The Seller shall load the Commodity onto the vessel at the load port during the Shipment
Period (for CFR Contracts) or Delivery Period (for FOB Contracts):

16 July, 2020 – 16 August, 2020 (both dates included).

8. PACKAGING:

As per the attached General Terms & Conditions (ANNEX I) and the attached
Packaging/Marking Specifications (ANNEX III).

Commodity markings must be approved by WFP before printing the packaging.

9. MARKING:

As per the attached General Terms & Conditions (ANNEX I) and the attached
Packaging/Marking Specifications (ANNEX III).

10. FUMIGATION:

As per attached General terms and Conditions (Annex I).

11. POTENTIAL OR ACTUAL CONFLICT OF INTEREST:

Please refer to General terms and Conditions (ANNEX II), Clause 21.

filled in, signed by the bidder and submitted as part of the offer.***

12. REMARKS:

12.1 Additional documentation required:


a) A Declaration/Production certificate for each lot to be attached to the shipping
documents containing following information:
• Production lot and quantity of the lot

12.2 Metal wire seal:


In case of jumbo bags, metal wire seal will be used and at supplier’s cost.

12.3 Document legalization***:


Currently, extra measures are being applied asking for legalization from neighbouring
countries, which is reflected that the documents must be legalized as following:

- Local Chamber of commerce for Commercial Invoice and Certificate of Origin in the
country of origin;
- Local agriculture directorate for Phyto-sanitary certificate in the country of origin;
- Ministry of Foreign Affairs (MOFA) in the country of origin (for all docs);
- Syrian embassy/consulate in the neighbouring country (for all docs).
- For details, please see ANNEX VI – CUSTOMS INFORMATION GUIDE.
- All local charges arising from documents attestation/legalization either in supplier’s
country or in the country of Origin or loading, or in neighbouring countries should be
handled by the supplier.

12.5 Customs Information Guides (CIG):


Before submission of the offer, the Seller needs to ensure that they can comply with
the requirements as stipulated in CUSTOMS INFORMATION GUIDES (CIG/ANNEX VI)
which are essential for smooth import customs formality at the port of discharge and
at the destination point.

12.6 Performance bond:

The Seller shall submit a Performance Bond valued at 5% (five percent) of the total
contract value with a wording approved by WFP as per WFP’s performance bond
format (ANNEX VII).

It is a condition of this Agreement that all Commodity delivered under this Agreement shall meet the quality
specifications set out in the relevant Specification for such Commodity and shall be fit for direct human
consumption, of good and satisfactory quality, of a colour proper to the Commodity and free from pests,
contaminants and abnormal smell, and shall conform to all applicable Public Health laws and regulations in
force at the time of Shipment (CFR Contracts ) or Delivery (FOB Contracts) in the country of origin.

A breach of this condition shall enable WFP to reject the Commodity and any extra-expenses or consequences
arising out from delivery of a non-conforming Commodity will be for the Seller’s account.

- otherwise conform to the quality standards of the source country

Other specifications shall be as per the standards of the country of origin. Full detail specification must be
clearly mentioned in the offer. Otherwise the offer may not be taken into consideration.

ANNEX III

PACKAGING/MARKING SPECIFICATIONS
PACKAGING:
Packaging (bags double-stitched top and bottom, cartons, tins, etc.) shall be made with new, strong materials,
of serviceable quality and shall be suitable in all respects for ocean and/or ground transportation of the
Commodity.

Commodity shall be packed in uniform (colour white), new anti-slip woven polypropylene bags with a minimum
weight of 120 gr and capacity to contain 50 kg net each. The bags must meet international export standard, EN
standard 277 (ANNEX VIII) or equivalent.

The Seller shall provide additional two (2%) per cent empty spare bags printed with the requested marking to
be shipped along with the cargo. Cost of which is to be included in the price quoted.

All bags must be clean, dry, undamaged and firmly sewn. Any bags that are identified by the Buyer or his
representative as being weak, old, torn, unserviceable or with poor quality stitching/sealing at the time of either
collection, delivery or loading, shall be replaced by the Seller, at the Seller’s expense.

About 15-20 bags of silica gel of at least 1 kg each should be placed in each container in order to absorb moisture.
In addition, craft paper should be laid all side of the containers (for containerized shipment)/holds (for break-
bulk shipment).

Alternatively, Calcium chloride-based desiccants, minimum recommended desiccant volumes (125-gram packs)
for a 20ft container are as followings:

Supplier is to ensure application of correct type and quantity of desiccants to interior carrier walls or on the
sheeting, based on the length of time in transit in carriers.

Jumbo bag specifications:


Jumbo bags shall have a duffle top and 4 handles, be of food grade, include a sealing system to allow the
sealing of the top of the bags. Jumbo bags shall be suitable for the weight and the planned intake of 100
x 10 kg bags, ISO approved and suitable for lifting and movement by sea and land transport.

All packing material costs and packing charges shall be borne by the Seller.

MARKING FOR SYRIA:

The following information should be available on all food items both in English and Arabic:
