Stamp Paper and Franking Overview

Stamp duty is a tax that is levied on legal documents, including those


that involve the sale of immovable property. The amount of stamp
duty could either be fixed or it could be a percentage of the sale value
in the case of property documents.

It is mandatory to pay stamp duty for a legal document and you can
be fined if you don’t pay it.

Franking, on the other hand, is a process that is used to stamp the


legal document. This is the process used to affix any type of mark or
stamp to a paper to indicate that the stamp duty has been paid.

Stamp Papers/ E Stamp Paper
There are majorly two kinds of stamp paper
Judicial that is used for legal and court work;
Non-judicial that is used for registration of various documents, insurance
policies, etc.

Judicial Stamp Papers:


In matters between parties, which concern court proceedings, the
parties have to file various affidavits and petitions; the courts levy duty
on these filings for the purpose of meeting expenses incurred in the
functioning of the court.
Judicial Stamp Papers are Stamped Papers and duty payable is to the
courts for the purpose of payment of court fee and other matters
expressly judicial matters

Non Judicial Stamp Papers:


Non-Judicial Stamp Papers are used in matters which concern
transactional arrangements between parties that are not judicial in
nature, such as an agreement to sell, affidavits, lease agreement,
amendment in the article of association, etc.

Franking

Franking, is a process of actually getting the documents stamped.


This process includes getting the documents marked or stamped,
indicating that the documents are legal and the stamp duty levied on
the documents has been paid.

For this, we have to first prepare the documents. These documents


are then taken to a Bank, or franking centre. Once the stamp duty is
paid, the centre will mark the documents to indicate that the stamp
duty has been paid. This process is called franking. The said
documents need to be signed after franking them.
