CONTRACT TO SELL REAL PROPERTY
KNOW ALL MEN BY THESE PRESENTS:
This CONTRACT TO SELL is made, executed and entered into by:
_____________, of legal age, married to ______________, Filipino, and with residence
and postal address at _______________________, Zamboanga del Sur, hereinafter
referred to as the “SELLER/VENDOR”;
- AND -
_______________, of legal age, single, Filipino and with residence and postal address at
_____________________, Zamboanga del Sur, hereinafter referred to as the
‘’BUYER/VENDEE”.
WITNESSETH;
WHEREAS, the SELLER is the registered owner of a residential house and lot located at
______________________, Zamboanga del Norte, and covered by Transfer Certificate of Title
No. _________ containing the total area of ONE HUNDRED FORTY (140) SQUARE
METERS, more or less, and more particularly described as follows:
TRANSFER CERTIFICATE OF TITLE NO. ________
“… North along line 3-4 by Lot 13, Block 1, on the East along line 4-1 by road
Lot 3, 8.00 m. wide, on the South along line 1-2 …
WHEREAS the VENDOR has agreed to SELL the above-described residential lot to the
VENDEE, and the VENDEE agreed, as it is hereby agreed, to BUY the said house and lot.
WHEREAS, the Buyer would like to avail the said property through PAG-IBIG HOUSING
LOAN and the Seller is willing to grant such request.
NOW, THEREFORE, FOR AND IN CONSIDERATION of the foregoing premises and of
the following mutual covenants, undertaking, obligations, terms and conditions, the parties
hereto have agreed, as follows:
1. PURCHASE PRICE- The VENDEE agrees to pay the amount of ONE MILLION
THREE HUNDRED THOUSAND PESOS (Php 1,300,000.00) Philippine Currency,
which shall be paid upon the release of Vendee’s loan from PAG-IBIG;
2. TRANSFER OF TITLE- For the purpose of the loan, the VENDOR shall allow the
transfer of the Title in the name of the VENDEE, but only after the issuance of Letter
of Guarantee from PAG-IBIG;
3. That the vendee assumes all the responsibilities for the payment of amortizations to
the Home Development Mutual Fund (PAG-IBIG FUND); and
4. This contract shall be binding upon the heirs, successors, executors, administrators
and assigns of the respective parties hereto.
IN WITHNESS, WHEREOF, the PARTIES have hereunto affixed their signatures on this

The BUYER/VENDEE shall apply for a house and lot purchase loan
with PAG-IBIG in the amount of THREE MILLION NINE
HUNDRED THOUSAND PHILIPPINE PESOS (PHP3,900,000.00) to
pay the SELLER/VENDOR for the the house and lot. The
proceeds/check of the PAG-IBIG loan shall be paid to and in the name
of SELLER/VENDOR;
2. For purposes of the loan, the SELLER/VENDOR shall allow the
transfer of the title in the name of the BUYER/VENDEE, but only
after the issuance of a letter of guarantee from PAG-IBIG;
3. The capital gains tax and notarial fees shall be to the account of the
SELLER/VENDOR, while the transfer tax and documentary stamp

tax shall be to the account of the BUYER/VENDEE.
This Contract shall be binding upon the heirs, successors, executors,
administrators and assigns of the respective parties hereto.

ACKNOWLEDGMENT RECEIPT OF MONEY

The total agreed amount of the house and lot is Php 1,00,000.00 less 500,000.00 for the
down payment and 6________for the outstanding mortgage debt from PAG-IBIG, then the
