JUDICIAL AFFIDAVIT
(of Lydio C. Suringa)
I, LYDIO C. SURINGA of legal age, Filipino, married and a resident of
Brgy. Bunga, Baybay City , Leyte after having sworn to in accordance with law
hereby depose and state in judicial affidavit format :
1. I am a witness in this case
2. My testimony is obtained by Atty. Lucille M. Teves at Teves Law
Office, San Mauro Street, Baybay City, Leyte. I am fully conscious that
I answer the questions under oath and that I may face criminal liability
for false testimony or perjury. My testimony is in question – and-
answer.
PURPOSE
The testimony of the witness Lydio C. Suringa is being offered :
1. To identify the real property subject of the case .
2. That the circumstances surrounding the incident do not constitute
Forcible Entry.
3. The prior possession of the disputed part of the real party by the
defendants.
With the Permission of the Honorable Court.
Question Please state your name, age, civil status, residence,

Answer I’ am LYDIO C. SURINGA, married , of legal age ,
(A) Filipino and a resident of Bryg. Bunga , Baybay City,
presently, I used to be a farmer but now I’m a senior
citizen I can only do farming a bit.
Question Can you understand and speak English?

Answer I can hardly understand and speak English , I want
(A) my affidavit to be taken in Cebuano language.
3 Q For the record please state the name and address of
the lawyer who is now conducting or supervising
your examination and the place where the
examination is being held now?

4 Q Why are you here ?
(T) Nganong ania man ka karon ?
A Aron paghimo ug sinumpaang pamahayag
mahitungod sa lugar na gika gubtan ni Sps. Suringa
ug Sps. Castro
(T) To make a sworn statement about the lot or the area
wherein it is the subject of the dispute by Sps. Suringa
and Sps. Castro.
5 Q Do you know the plaintiffs and the defendants of this
case ?
(T) Nakaila ka ba sa nag reklamo ug ang gi reklamo?
A Oo , ang nag reklamo mao si Antonio Suringa ,ako
ng pag –umangkon ang gi reklamo amo pud ng
silingan ang mag – tiayong Castro.
(T) Yes, the plaintiff Antonio Suringa is my nephew , the
defendants Spouses Castro are my neighbors.
6 Q Do you know the property subject of the case?
(T) Nakahibaw baka sa lote na ilang gika gubtan?
A O, kahibaw kaayo ko sa lote
(T) Yes, I know very well the lot.
7 Q What lot are you referring?
(T) Unsa man na lote imong gipasabot.
A Kanang mga lote 7709, dry river bed ug 7708
(T) The lots 7709, the dry river bed and the lot 7708
8 Q What do you know about these lots
(T) Unsa may imong nahibaw - an ani nga mga lote
A Ang lote 7709 kami ang saop sa panahon ni Aseclo
Vega ang tag iya ana nga yuta , na gipalit ni Rosal
Nishiki ug gipalit ni Antonio Suringa ang sunod na
lote mao ang “dry river bed”ug ang sunod ang lote
7708 na gipanag iya sa mga Castro
(T) We were tenants of the lot 7709 which was previously
owned by Aseclo Vega , bought by Rosal Nishiki and
bought by Antonio Suringa. The next lot is the dry
river bed and the next is the lot 7708 owned by the
Castro.
9 Q If you were the tenant of Aseclo Vega on the lot
designated as lot 7709 , you mean you are familiar of
that part wherein the piggery of the Castros is built
and now it is being subject of the dispute?
(T) Kun kamo ang nag saop sa lote ni Aseclo Vega sa lote
na 7709 , naka hibalo ka sa parte nga gibutangan sa
piggery sa mga Castro nga karon nahimo nilang
gubot?
A O kahibalo ko ug familiar ko ana nga parte. Ang
piggery nila ni Castro diha na daan ,kana nga mga
portion diha apil na sa ilang gitikad, apil ang “dry
river bed” ug ang ilang lote na 7708 mao na ang ilang
gi tikad.
T Yes, I know and I am very familiar of that part. Even
before, the Castros already had their piggery
constructed in that portion, they had cultivated that
area, the dry river bed and their lot 7708 .
10 Q During the time of Rosal Nishiki that portion subject
of
the dispute was occupied by the Castros ?
(T) Sa panahon ni Rosal Nishiki kana ba na lugar na ilang
gika gubtan karon gi occupar ba na sa mga Castro.
A O , Attorney , ang mga Castro gihapon ang nag
atiman diha , wala may gi sulti si Rosal nga iya na
nga portion.
(T) Yes, Attorney, the Castros already occupied that
portion they had cultivated , Rosal never claimed that
part.
11 Q During the time of Aseclo Vega and Rosal Nishiki ,
was there any dispute between them and the Castros
regarding cultivation and possession of the said
portion of the real property?
(T) Sa panahon ni Aseclo Vega , Rosal Nishiki nagka
gubot ba sila bahin sa pag atiman o pagtikad sa parte
nga nahimutangan sa mga Castro karon?
A Wala man sila mag away mahitungod ana.
(T) No, there was no dispute regarding that.
I am executing the Judicial Affidavit to attest to the truth of the foregoing. I
reserve my right to further supplement my testimony when needed.
