Re: Request for Issuance of a Written Bank Statement

Sir,

I write in behalf of my client RICHARD B.SERRA who opened in your branch office a
BDO cash card no. 5267 2700 2483 to request for the issuance of a written bank
statement for a period of three (3) months from the date of its last transaction with the
bank. Said request is made pursuant to the terms and conditions governing the use and
issuance of cash card, to wit:

“20. DISCLOSURE OF INFORMATION. The Cardholder expressly agrees


to the disclosure by BDO or its related company, as it deems fit, of any and
all information about the Cardholder, his/her Cash Card, and/or his/her
Cash Card transactions, to other companies, financial institutions, any
third party, and/or any government regulatory agency, without BDO or its
related company, incurring liability as a consequence thereof.”

Section 4 paragraph B of BSP Circular No. 649 Series of 2009 which is deemed
incorporated in the above-mentioned terms of conditions likewise provides:

“Sec. 4 B. EMI’s shall put in place a system to maintain accurate and


complete record of e-money instruments issued, the identity of e-money
holders, and the individual and consolidated balance thereof. The system
must have the capability to monitor the movement of e-money transactions
and link e-money instruments issued to common e-money holders. The
susceptibility of a system to intentional or unintentional misreporting of
transactions and balances shall be sufficient ground for the imposition by
the BSP of sanctions, as may be applicable.”
In view thereof, we respectfully request for the issuance of a written bank statement of
the aforementioned BDO cash card holder within a period of five (05) days from receipt
of this letter-request.
