The Code Department coordinated a meeting via Teams with Mr. Bazak and leadership from the Building and Zoning
departments, and the City Attorney’s Office on September 25, 2020. At that meeting, all of the Department heads
explained to Mr. Bazak in detail the steps that needed to be taken to address his outstanding violations and bring the
property into compliance with the City Code. He has not taken steps to bring the property into compliance.
Mr. Bazak has been running a rooming house without any City permits or licenses since 2014, collecting rent from his
tenants throughout that time period. His property was a rooming house, however, he allowed the Certificate of Use to
lapse and under Miami 21, rooming houses are not allowed in the City of Miami. Therefore, he would have to bring the
property up to current Code.
The property is in violation of multiple aspects of the City Code.
There are open Building cases on the property. Violations from the Unsafe Structures division of the Building Department
include: having a structure that is unsafe, unsanitary, or deficient and work without a permit. The property owner never
completed the 40-50 Year Recertification, as required, and that Building case has been open since 2013.
The Department of Code Compliance brought a case before the Code Enforcement Board on 2/26/2020. The property
was found guilty in absentia, and there has been a $250 daily fine running that is now in the amount of $76,250. Mr.
Bazak requested from Hearing Boards to reset the case one or two days before the case was scheduled to be heard. No
reset was granted and Code Compliance would not have recommended a resetting of the case given the public safety
and health concerns attendant on the property. Mr. Bazak did not send a representative in his place to speak on behalf of
his property.
There are also numerous Solid Waste violations for illegal dumping and littering on this property.
