On October 12, 2010, CREW filed an administrative appeal from the refusal of the Executive Office of U.S. Attorneys (EOUSA) to process CREW's request for records related to the Department of Justice's investigation into former PMA founder and owner Paul J. Magliocchetti. On February 14, 2011, CREW filed a complaint against the U.S. Department of Justice (DOJ) seeking the expedited release of records concerning DOJ's investigation and prosecution of Paul J. Magliocchetti, the founder and owner of PMA Group, Inc., for false statements, making illegal conduit campaign contributions, making illegal corporate campaign contributions, and other charges. Mr. Magliocchetti pled guilty to most of the charges against him, and the government made public the plea agreement he entered with DOJ and issued press releases announcing both the prosecution and the plea agreement. Nevertheless, in response to CREW's Freedom of Information Act (FOIA) request for documents related to the investigation and prosecution, the Criminal Division withheld all documents under Exemption 7(A), which protects records compiled for law enforcement purposes that reasonably could be expected to interfere with enforcement proceedings. Dear Ms. Weismann:

You appealed from the action of the Criminal Division of the United States Department
of Justice on your request for access to records pertaining to the investigation and prosecution of
Paul J. Magliocchetti.

After carefully considering your appeal, and as a result of discussions between Criminal
Division personnel and a member of my staff, I am remanding your request for further processing
of the responsive records. Although the Criminal Division invoked Exemption 7(A) of the
Freedom ofInfonnation Act, 5 US.c. § 552(b)(7)(A), to withhold in full all responsive records
at the time your initial request was processed, that exemption, which pertains to records or
information compiled for law enforcement purposes the release of which could reasonably be
expected to interfere with enforcement proceedings, is no longer applicable to withhold the
responsive records in their entireties. Consequently, the Criminal Division will send any and all
releasable records to you directly, subj ect to any fees. You may appeal any future adverse
determination made by the Criminal Division. If you would like to inquire about the status of
your remanded request, please contact the Criminal Division directly.

As part of the 2007 FOIA amendments, the Office of Government Information Services
