The BAC is conducting the public bidding for this Contract in accordance with Republic Act No. 9184 and its
Implementing Rules and Regulations (IRR).
To be eligible to bid for this Contract, a contractor must meet the following major requirements: (a) Filipino Citizen or
75% Filipino-owned partnership/corporation with PCAB License for Size Range Medium A (Item 1) and Small B (Item
2-12) (b) completion of a similar contract costing atleast 50% of the ABC and (c) Net Financial Contracting Capacity
(NFCC) at least equal to the ABC. Mandatory use of the PhilGEPS Certificate of Registration and Membership under
Platinum Category is required.
The DPWH will use non-discretionary “pass/fail” criteria in the eligibility check, preliminary examination of bids,
evaluation of bids, post-qualification and award. “If at the time of the post-qualification procedure, the BAC verifies
that any of the deficiencies is due to the contractor’s fault or negligence pursuant to 34.3(b)(ii)(c) of the 2016
Revised Implementing Rules and Regulations of Republic Act No. 9184 (2016 RIRR of RA 9184), the Procuring Entity
shall disqualify the contractor from the award without any right to reimburse fees and incidental cost paid for the
procurement of infrastructure contract subject of the Bid”.

Bidders shall pay the BAC the amount stated above for the Bidding Documents. Bidders that downloaded the
documents from the DPWH/PhilGEPS website shall pay not later than the submission of their bids. Late bids shall not
be accepted.
In order to afford sufficient time to update contractor’s record in the CWA, all contractor’s are directed to submit to
the DPWH-Civil Works Application, their Class “A” documents and Financial Statement, at least seven (7) calendar
days, as well as their Technical Documents (completed and on-going projects) at least fifteen (15) calendar days,
respectively, before the deadline for the submission or opening of bids.
Prospective bidders shall present their ORIGINAL OFFICIAL RECEIPT OF PAYMENT for Bidding Documents (project
specific) to the BAC Secretariat of this office before deadline stated above for inclusion in the list of contractors for
eligibility processing. The Owner or Authorized Representative/s is required to present two (2) valid government
issued Identification Cards with photo and signature, for identity purposes.
All Bids must be accompanied by a Bid Security in any of the acceptable forms with the following schedule:
Form of Bid Security Minimum amount in % ABC
1. Cash or cashier’s/manager’s check issued by a Universal or Commercial Bank Two Percent (2%)
2. Bank draft/guarantee or irrevocable letter of credit issued by a Universal or Commercial Bank: Provided, however,
that it shall be confirmed or authenticated by a Universal or Commercial Bank, if issued by a foreign bank.
3. Surety Bond callable upon demand issued by a surety or insurance company duly certified by the Insurance
Commission as authorized to issue such security. Five Percent (5%)
4. Bid Securing Declaration that is an undertaking which states, among others, that the bidder shall enter into
contract with the procuring entity and furnish the required performance security within ten (10) calendar days, or
less, as indicated in the Bidding Documents, from receipt of the Notice of Award and committing to pay the
corresponding fine and be suspended for a period of time from being qualified to participate in any government
procurement activity in the event it violates any of the conditions stated therein as required in the guidelines issued
by the GPPB.
The DPWH-Catanduanes District Engineering Office reserves the right to accept or reject any bid and to annul the
bidding process any time before the Contract award, without incurring any liability to the affected bidders, in
accordance with provisions of Section 41 of RA 9184 and its IRR.
