Physical Injuries Incident Scenario

On November 23, 2020, 10:25 of the evening, the two brothers are walking along the road
named Jason Cabuyaw, and Mark Cabuyaw in front of no. 55 Silangan, San Mateo, Rizal. Jason
and Mark are come from a party of their friends in AFP Housing, and they are slightly drunk.
When they are walking in the said place, they saw a group of three people walking towards them
laughing while looking intense at them like drunk. Jason and Mark knew that the group of drunk
people towards them had the bad intentions because of their actions, murmuring and laughing.
When that group of people came near to them, they suddenly punch and kick Jason and Mark
continuously until they are down to the ground. But it did not stop them, one person on that
group get the 2x2 wood in an abandon house and he hit Jason in his body and arms that cause
him a right arm fractured. After that, when that group of people saw Jason yelling intensively in
pain, they run quickly to an unknown direction and left the two brothers in the laying ground. The
residents of that place saw them laying in the ground and they came out to help them and
brought them to the police station in silangan. They arrive on or about 10:40 PM at the police
station 10. Mark report to the police officers the incident and tell them what happened. Jason who
is badly injured brought to the hospital by the police officers for medical attention, and after that
together with Mark the police officers conduct a follow up operation to arrest those suspects.

2. WHEN : Incident at about 10:25 PM of November 23, 2020 and referred to this at about
10:40 AM of the same date.

3. WHERE : Located along the road in front of No. 55 Silangan, San Mateo, Rizal.

4. WHO : Victim/Witness: Jason Cabuyaw y Alonzo, 20 years of age, born on august 2,

2000, single, student of Pamantasan ng Lungsod ng Marikina, native of Bicol, presently residing at Block 15
lot 20 Sta. Barbara villas 1, Silangan, San Mateo, Rizal.
Mark Cabuyaw y Alonzo, 22 years of age, born on April 1, 1998,
single, student of Pamantasan ng Lungsod ng Marikina, native of Bicol, presently at residing at Block 15 Lot
20 Sta. Barbara villas 1, Silangan, San Mateo, Rizal.

5. How: Initial investigation disclosed that on the said TDPO, while the two brothers named
Jason, and Mark Cabuyaw walking on the said place when the incident happens along the road in front of
No. 55 Silangan, Silangan, San Mateo, Rizal. The group of drunk people consist of three persons are
walking towards them, when suddenly punch, kick, and hit them with the 2x2 wood that resulted to a
fractured right arm of Jason. After that, the suspects run quickly away from the scene. The residents help
the two brothers and brought them to the police station.
Further, at about 10:40 PM when Jason and Mark Cabuyaw arrive at the police station 10 in
Silangan. The police officer conducted a report and brought Jason Cabuyaw to hospital for medical
attention. After that, the police officers conduct a follow up operation together with Mark Cabuyaw to
arrest the suspects.
The victims Jason Cabuyaw and Mark Cabuyaw was examined by Dr. Jose Rizal for physical
examination. The initial findings of the medical examination are that the two victims received a multiple
contusion in their heads and bodies. One of the victims Jason Cabuyaw also receive a bone fractured in his
right arm located at his wrist.
The suspects of the crime were unidentified by the victims. The motive of the incident is
undetermined, and the case is still under investigation.
CCTV Cameras installed at nearby establishment were requested for possible identification of the

2. This pertains to the Serious Physical Injuries Incident that transpired at No. 55 Silangan, San
Mateo, Rizal at around 10:25 in the evening of November 23, 2020. Be informed that the victim Jason
Cabuyaw y Alonzo, 20 years of age, born on August 2, 2000, single, student of Pamantasan ng Lungsod ng
Marikina, Native of Bicol, presently residing at Blk 15 lot 20 sta. Barbara Villas 1, Silangan, San Mateo,
Rizal. And Mark Cabuyaw y Alonzo, 22 years of age, born on April 1, 1998, single, student of Pamantasan
ng Lungsod ng Marikina, Native of Bicol, presently residing at blk 15 lot 20 sta. Barbara Villas 1, Silangan,
San Mateo, Rizal, was physically injured by a group of drunk people.

3. That one of the Victim suffered a fractured in his right arm located at his wrist that was
conducted by Dr. Jose Rizal was brought to Amang Rodriguez Memorial Medical center at Sumulong
Highway Sto. Nino, Marikina City for Medical Examination on November 24, 2020.

4. The Police Officers together with the victim Mark Cabuyaw conducted a follow up operation
on November 24, 2020, 07:00 in the morning at No. 55 Silangan, San Mateo, Rizal to investigate the
incident and identify the suspects.

5. The suspects were arrested at their houses during hot-pursuit operation conducted, they are
known because of the help of the victim/witnesses Mark Cabuyaw who identify them and the CCTV around
the area. The 2x2 wood also was recovered at the place where the crime was committed. The suspects are
identified and counted of 3 persons in their legal age.

6. Further development will be sent to that office as soon as obtained.

AFFIDAVIT OF ARREST

I PCPL James Ortiz y Gonzales, 32 years of age, married, police officer

assigned at and with postal address of Police Station 10, San Mateo Municipal Police Station,
after having sworn to according to law do hereby depose and state:

I am assigned as a desk officer personnel at Police Station 10, San Mateo

Municipal Police Station from 6:00 of the evening to 6:00 of the morning.

That on November 23, 2020 at about 10:40 of the evening while I was doing a
written report about a certain case. A concern citizen came to me and brought the victims one
Jason Cabuyaw y Alonzo, 20 years of age, born on August 2, 2000, single, student
of Pamantasan ng Lungsod ng Marikina, Native of Bicol, presently residing at Blk
15 lot 20 sta. Barbara Villas 1, Silangan, San Mateo, Rizal, and one Mark Cabuyaw y
Alonzo, 22 years of age, born on April 1, 1998, single, student of Pamantasan ng
Lungsod ng Marikina, Native of Bicol, presently residing at blk 15 lot 20 sta.
Barbara Villas 1, Silangan, San Mateo, Rizal to report the alleged physical assault of a
group of drunk people at No. 55 Silangan, San Mateo, Rizal.

According to the victims while they are walking at the said place, they saw a group
of drunk people that consist of three (3) persons walking towards them. Then eventually
when they are close to them the victims were punch, kick and hit by a 2x2 wood in their
bodies by that group of people. After that, the suspects immediately run to an unknown
direction leaving the victims laying on the ground.

That the victims arrive at our Police Station, we immediately assist them and
brought one of the victims Jason Cabuyaw y Alonzo to the hospital in Amang Rodriguez
Memorial Medical center at Sumulong Highway Sto. Nino, Marikina City for Medical
Examination on November 24, 2020 after receiving a right arm fractured and bruises. And the
other victim Mark Cabuyaw y Alonzo, help us to identify the suspects.

Wherein, after the incident, we conducted a follow-up operation at the said place
together with the victim/witness Mark Cabuyaw y Alonzo. We conducted an interview to
the residents, and we found out a CCTV video in one of the houses near the incident. The
victim positively identified the suspects thru the CCTV video, and we immediately proceed to
the resident of the suspects and eventually arrested them at their house at No. 12 Silangan,
San Mateo, Rizal.

That, I immediately inform them of their offense (suspects) and their constitutional
rights the language known to them;
1. The right to remain silent, and any statement they make, can and it will be used
against them in any court of law in the Philippines;
2. The right to have a competent and independent lawyer in their own choice. If they
cannot afford the hire of lawyer, the Government will give or provide one.
And thereafter, the suspects and victim/witness Mark Cabuyaw y Alonzo were brought to the
Amang medical center for Medical examination specifically the alcohol test for the suspects
and later, brought to the Police Station 10, San Mateo Municipal Police Station for
investigation

Upon the investigation, the suspects were identified themselves as Mac Reyes y
Buenafe, 20 years of age, single, jobless, native of Davao City, presently residing
at No. 12 Silangan, San Mateo, Rizal, Juniel Reyes y Buenafe, 22 years of age,
single, mechanic, native of Davao City, presently residing at No. 12 Silangan, San
Mateo, Rizal, and Razle Reyes y Buenafe, 24 years of age, single, jeepney driver,
native of Davao City, presently residing at No. 12 Silangan, San Mateo, Rizal, Which
also identified by the witness Mark Cabuyaw y Alonzo who is one of the victims. The
connection of the suspects is that they were biologically siblings.

That, I am executing this affidavit of arrest to the foregoing statement and for the
purposes of filing appropriate charges against the three (3) suspects for violation of Article
263(4) of the Revised Penal Code (Serious Physical Injuries).

III. FACTS OF THE CASE

8. On or about 10:40 PM of November 23, 2020, when a concern citizen came to the desk
officer to bring the victims Jason Cabuyaw y Alonzo, 20 years of age, born on August 2, 2000,
single, student of Pamantasan ng Lungsod ng Marikina, Native of Bicol, presently residing at Blk 15
lot 20 sta. Barbara Villas 1, Silangan, San Mateo, Rizal, and Mark Cabuyaw y Alonzo, 22 years of
age, born on April 1, 1998, single, student of Pamantasan ng Lungsod ng Marikina, Native of Bicol,
presently residing at blk 15 lot 20 sta. Barbara Villas 1, Silangan, San Mateo, Rizal. To report the
alleged Serious Physical Incident, happen at No. 55 Silangan, San Mateo, Rizal.

9. The Police Officers conduct a blotter report for the incident that the two brothers were
going home from the party they attended are walking at the said place and slightly drunk when a
group of three drunk people are walking towards them. Mark Cabuyaw y Alonzo and Jason Cabuyaw
y Alonzo feels that the people who are walking towards them had a bad intention against them and
when that group of drunk people moves near to them, they suddenly punch, and kicks the victims
cause them to lay into the ground. One of the suspects picks up the 2x2 wood in an abandon house
and hit Jason Cabuyaw y Alonzo in his arm that resulted to right arm fractured. After that, the
suspects of the crime quickly run in an unknown direction. The residents of the said place saw the
two brothers laying in the ground. They immediately help them and brought them at the Police
Station 10.

10.After the report, the Police Officers brought the victims to Amang Medical Center at
Sumulong Highway Sto. Nino, Marikina City for medical attention. Dr. Jose Rizal conducted a medical
examination to the victims. The medical examinations of the victims shows that they receive the
following injuries:

10.1 Multiple contusion to the heads and bodies

10.2 Less severe Trauma to internal organs
10.3 Jason Cabuyaw y Alonzo received a right arm fracture at his lower wrist

IV. DISCUSSION

11.The suspects were identified as Mac Reyes y Buenafe, 20 years of age, single,
jobless,
native of Davao City, presently residing at No. 12 Silangan, San Mateo, Rizal, Juniel Reyes y
Buenafe, 22 years of age, single, mechanic, native of Davao City, presently residing at No. 12
Silangan, San Mateo, Rizal, and Razle Reyes y Buenafe, 24 years of age, single, jeepney driver,
native of Davao City, presently residing at No. 12 Silangan, San Mateo, Rizal. They are biological
siblings that had a record of severe drinking of intoxicating liquor at their residents.

12. Based on own background investigation and interview to their neighbors, they
gradually
want to fight other people or make violence when they are drunk. Sometimes they are always
reported to the barangay for alarm and scandal and unjust vexation for their actions. The people in
their residents call them as “basagulero” or hardheaded because they are always drunk, and it is like
a hobby for them. These history can help to prove the suspects guilt to the crime.

13.When the suspects were arrested in their house after the Hot pursuit operations
conducted by the police officers and the victim/witness Mark Cabuyaw y Alonzo. They deny the
allegations of the victims that they did not do anything about them. The CCTV video of the resident
near the incident positively identity them as the suspects of the crime. And the alcohol test conducted
by the competent doctor prove that they are under the influence of intoxicated liquor.

14.The denial of the suspects against the incident was prove wrong by the evidence that
was collected under the investigation of the police investigator. It is clearly show that the suspects
committed a crime and violation of Article 263(4) of the Revised Penal Code (Serious Physical
Injuries).

V. CONCLUSION

15.After the careful and honest evaluation of the case, the suspects Mac Reyes y
Buenafe,
Juniel Reyes y Buenafe, and Razle Reyes y Buenafe were found out that they committed a
violation of Article 263 of the Revised Penal Code (Serious Physical Injuries).

VI. RECOMMENDATION

16.Strongly recommend that the investigation of this case will be referred to the Office of
the Prosecution for filing of the appropriate case against the suspects.
