CONNECTICUT STATE FIRE SAFETY CODE ABATEMENT


ORDER OF FIRE/LIFE SAFETY HAZARDS

Dear Tim Conroy,

On August 26, 2021, at approximately 0900 hours, an inspection was conducted of the premises located at 37 Clark
Avenue East Haven, CT 06512 for the purposes of determining compliance with the Connecticut State Fire Safety Code
and the applicable referenced standards, adopted pursuant to Connecticut General Statutes §29-292 and §29-293. The
Code and said standards are available for your inspection at this Office.

The following violations were found on the date of inspection.


1. NFPA 1: 14.14.4* Power Source. Where emergency lighting facilities are required by the applicable provisions of
Chapters 11 through 43 of NFPA 101 for individual occupancies, the signs, other than approved self-luminous signs
and listed photoluminescent signs in accordance with 14.14.7.2, shall be illuminated by the emergency lighting
facilities. The level of illumination of the signs shall be in accordance with 14.14.6.3 or 14.14.7 for the required
emergency lighting duration as specified in 7.9.2.1 of NFPA 101. However, the level of illumination shall be
permitted to decline to 60 percent at the end of the emergency lighting duration[101: 7.10.4]
2. NFPA 1: 11.1.2.3 Permanent wiring abandoned in place shall be tagged or otherwise identified at its termination
and junction points as “Abandoned in Place” or removed from all accessible areas and insulated from contact with
other live electrical wiring or devices.
3. NFPA 1: 11.1.3.2 Multiplug adapters shall not be used as a substitute for permanent wiring or receptacles
4. NFPA 1: 11.1.5.5 Extension cords and flexible cords shall not be affixed to structures; extend through walls,
ceilings, or floors, or under doors or floor coverings; or be subject to environmental or physical damage.
5. NFPA 1: 11.1.5.6 Extension cords shall not be used as a substitute for permanent wiring
6. NFPA 1: 13.6.1.2* Where Required. Fire extinguishers shall be provided where required by this Code as specified
in Table 13.6.1.2 and the referenced codes and standards listed in Chapter 2.
7. NFPA 1: 13.6.4.3.1.1 Fire extinguishers shall be subjected to mainte‐ nance at intervals of not more than 1 year, at
the time of hydro‐ static test, or when specifically indicated by an inspection discrepancy or electronic notification.

8. NFPA 1: 13.6.4.2.4.1.4 Records for manual inspection shall be kept to demonstrate that at least the last 12 monthly
inspections have been performed. [10:7.2.4.1.4]
9. NFPA 1: 50.5.5 Inspection, Testing, and Maintenance of Listed Hoods Containing Mechanical, Water Spray, or
Ultraviolet Devices. Listed hoods containing mechanical or fire-actuated dampers, internal washing components, or
other mechanically operated devices shall be inspected and tested by properly trained, quali ‐ fied, and certified
persons every 6 months or at frequencies recommended by the manufacturer in accordance with their listings.

10. NFPA 1: 50.4.3.2* Cooking equipment that produces grease-laden vapors and that might be a source of ignition of
grease in the hood, grease removal device, or duct shall be protected by fire extinguishing equipment. [96:10.1.2]
11. NFPA 1: 60.5.1.2* Safety Data Sheets (SDS). Safety data sheets (SDS) shall be available on the premises for
hazardous materials regulated by this code. When approved, SDSs shall be permitted to be retrievable by electronic
access. [400:6.1.2]
12. NFPA 1: 13.7.3.1.1.2 System components shall be installed, tested, inspected, and maintained in accordance with
the manufacturer's published instructions and this Code. [72:10.3.2]
13. NFPA 1: 13.7.3.2.4.4 Periodic inspection and testing documentation shall be provided in accordance with 14.6.2
through 14.6.4 of NFPA 72. [72:7.6.4]
14. NFPA 1: 13.7.3.2.4.1 Test plan documentation shall be provided in accordance with 14.2.10 of NFPA 72. [72:7.6.1]
15. NFPA 101: 3.3.3.8.4* Within a smoke compartment, residential or commercial cooking equipment that is used to
prepare meals for 30 or fewer persons shall be permitted, provided that the cooking facility complies with all of the
following conditions: (1) The space containing the cooking equipment is not a sleeping room. (2) The space
containing the cooking equipment is separated from the corridor by partitions complying with 33.3.3.6.2 through
33.3.3.6.5. (3) The requirements of 33.3.3.8.3(1) through (10) are met.
16. NFPA 101: 33.3.3.8.3* Compliance with 9.2.3 shall not be required where all of the following conditions are met:
(1) Residential or commercial cooking equipment in a single kitchen per smoke compartment is used to prepare
meals for 30 or fewer persons. (2) The portion of the board and care facility served by the cooking facility is limited
to 30 beds and is separated from other portions of the board and care facility by a smoke barrier constructed in
accordance with 33.3.3.7.1 and with 33.3.3.7.7 through 33.3.3.7.8. (3) The cooktop or range is equipped with a
range hood of a width at least equal to the width of the cooking surface, with grease baffles or other grease-
collecting and clean out capability. (4)*The hood systems have a minimum airflow of 500 cfm (14,000 L/min). (5)
The hood systems that are not ducted to the exterior additionally have a charcoal filter to remove smoke and odor.
(6) The cooktop or range complies with all of the following: (a) The cooktop or range is protected with a fire
suppression system listed in accordance with ANSI/UL 300, Standard for Fire Testing of Fire Extinguishing
Systems for Protection of Commercial Cooking Equipment, or is tested and meets all requirements of UL 300A,
Extinguishing System Units for Residential Range Top Cooking Surfaces, in accordance with the applicable testing
document’s scope. (b) A manual release of the extinguishing system is provided in accordance with Section 10.5 of
NFPA 96, Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations. (c) An
interlock is provided to turn off all sources of fuel and electrical power to the cooktop or range when the suppression
system is activated. (7)*The use of solid fuel for cooking is prohibited. (8)*Deep-fat frying is prohibited. (9)
Portable fire extinguishers in accordance with NFPA 96 are located in all kitchen areas. (10)*A switch meeting all
of the following is provided: (a) A locked switch, or a switch located in a restricted location, is provided within the
cooking facility that deactivates the cooktop or range. (b) The switch is used to deactivate the cooktop or range
whenever the kitchen is not under staff supervision. (c) The switch is on a timer, not exceeding a 120-minute
capacity, that automatically deactivates the cooktop or range, independent of staff action. (11) Procedures for the
use, inspection, testing, and maintenance of the cooking equipment are in accordance with Chapter 11 of NFPA 96,
and the manufacturer’s instructions are followed. (12)*No fewer than two ac-powered photoelectric smoke alarms,
interconnected in accordance with 9.6.2.10.3 and equipped with a silence feature, are located not closer than 20 ft
(6.1 m) and not farther than 25 ft (7.6 m) from the cooktop or range. (13) The smoke alarms required by
33.3.3.8.3(12) are permitted to be located outside the kitchen area where such placement is necessary for
compliance with the 20 ft (6.1 m) minimum distance criterion. (14) A single system smoke detector is permitted to
be installed in lieu of the smoke alarms required in 33.3.3.8.3(12), provided the following criteria are met: (a) The
detector is located not closer than 20 ft (6.1 m) and not farther than 25 ft (7.6 m) from the cooktop or range. (b) The
detector is permitted to initiate a local audible alarm signal only. (c) The detector is not required to initiate a
building wide occupant notification signal. (d) The detector is not required to notify emergency forces. (e) The local
audible signal initiated by the detector is permitted to be silenced and reset by a button on the detector or by a switch
installed within 10 ft (3.0 m) of the system smoke detector. (f) System smoke detectors that are required by other
sections of this chapter to be installed in corridors or spaces open to the corridor are not used to meet the
requirements of 33.3.3.8.3(12) and are located not closer than 25 ft (7.6 m) to the cooktop or range
17. NFPA 101: 33.3.3.6.3.2 In buildings protected throughout by an approved automatic sprinkler system in accordance
with 33.3.3.5, walls shall be smoke partitions in accordance with Section 8.4, and the provisions of 8.4.3.5 shall not
apply
18. NFPA 101: 33.3.2.10 Marking of Means of Egress. Means of egress shall be marked in accordance with Section
7.10.
19. NFPA 101: 3.3.2.9 Emergency Lighting. Emergency lighting in accordance with Section 7.9 shall be provided in all
facilities meeting any of the following criteria: (1) Facilities having an impractical evacuation capability (2)
Facilities having a prompt or slow evacuation capability with more than 25 sleeping rooms, unless each sleeping
room has a direct exit to the outside of the building at the finished ground level.

You are hereby ordered to take the proper corrective action to remove or remedy all listed violations within 3 0
days from the day that this notice is received, unless otherwise noted on the attached inspection report.
If you believe that compliance with the Code will impose an unreasonable hardship, and that alternative methods of
achieving an equivalent level of life safety could be attained, you may request, in writing, a modification of the
requirements of said Code as outlined in Connecticut General Statute §29-296. If you believe compliance will take more
time than that specified, you may request an extension of time prior to the expiration of the 30 day period, unless
otherwise noted. Sample forms for application for modification and extension of time for compliance are available from
this office. In addition, you have the right to appeal this order pursuant to Connecticut General Statutes §29-309 for a
period of not more than thirty (30) days from receipt.

Plans/specifications for work to be done shall be submitted to this office prior to the commencement of any construction.
This review of all plans/specifications would avoid unnecessary expense that could result from non- complying changes.
Please note that the correction of certain violations may require proper permits and approval from the building official
and other local agencies prior to any construction.

This is the only order you will receive. This Office will conduct a re-inspection of the premises to determine
compliance with this order after the expiration of the 30 day notice or the time. Your failure to comply with this order
within the time period specified as determined by said re-inspection constitutes your failure to comply with the
Connecticut State Fire Safety Code which may subject you to criminal prosecution as prescribed by Connecticut General
Statute §29-306 with penalties of a fine not less than two hundred dollars ($200) nor more than one thousand dollars
($1,000) or imprisonment of up to six months, or both, as prescribed in Connecticut General Statute §29-295. Non-
compliance may also result in a civil proceeding against you as authorized in Connecticut General Statute §29-306.

This Office is looking forward to working with you in the interest of fire and life safety for the community and awaits
your timely response regarding this matter. This matter is also being referred to the Connecticut States Attorney’s Office
for further prosecution.
