SPECIAL CONDITIONS OF CONTRACT (SCC}
The Special Conditions of Contract as described in this document are intended to amplify the
General Conditions of Contract and shall be read in conjunction with specifications of work,
drawings and all other documents forrning part of this Contract wherever the context so
requires. The following clauses shall be considered as an extension and not in limitation of
obligation of the Contractor.
1, 'nGRlHA" Rating System
This project is to be executed for Certifications as per GRIHA (Green Rating for lntegrated
Habitat Assessment) National Green Building Rating System. At least 3 (three) Star rating
under the GRIHA (Green Rating for lntegrated Habitat Assessment) is to be ensured.
Accordingly, the Contractor must adhere to the GRIHA compliance aspects of construction
as well as documentation with respect to use of Material, Manpower, Machinery and other
mandatory requirements. The Contractor shall coordinate with the Consultant in obtaining
necessary certificate from concerned authorities. Nothing extra shall be payable over and
above the quoted rates as per the financial bid to comply with such requirements. Statutory
fees, if any, borne by the contractor shall be reimbursed on submission of necessary
receipts/ documentary evidence on actual basis.
2. Time Schedule and Progress (Ref. clause 16.0 and {7.0 of GCC)
The following is to read in reference with clause 16.0 and 17.0 in General Conditions of
Contract (GCC). "Within 10 (Ten) days of letter of award, the Contractor shall submit a
Time & Progress (CPM/ PERT/ Bar chart) for completion of work within stipulated time".
The chart shall be prepared in direct relation to the time stated and this chart shall be
based on the milestones given as mentioned under. This will be duly got approved from
Engineer-in-charge of NBCC. This approved chart shall form a part of the agreement.
Achievement of milestones as well as total completion has to be within the time period
allowed.
The non-achievement of physical and financial milestone in accordance with the approved
time & progress chart shall result in the amount to be withheld from any sum payable to the
Contractor under this contract or forfeiture of performance bank guarantee, as under: -

lf the contractor is able to make up for the missed deadline of any milestone at a later
stage, the amount withheld or forfeited bank guarantee (s) on account of non-achievement
of the earlier milestone, will be released; otherwise total amount shall be adjusted in the
amount levied for compensation for delay as per clause 8.0 of GCC. lf there are registered
delays for the reasons beyond the control of the contractor or as per relevant clauses of
GCC, the milestones will be amended accordingly as shall be finally decided by the
Engineer-in-charge whose decision in this regard shall be final & binding on the contractor.
3. Compensation for Delay
The clause no. 8.0 of GCC has been modified as under:
lf the contractor fails to maintain the required progress in terms of clause '16.0 or relevant
clause of GCC & Special Conditions of Contract, to complete the work and clear the site on
or before the contract or extended date of completion, he shall, without prejudice to any
other right or remedy available under the law to the NBCC on account of such breach, pay
as agreed compensation the amount calculated at the rates stipulated below as the
Engineer in charge (whose decision in writing shall be final and binding) may decide on the
amount of tendered value of the work for every completed day/ week (as applicable) that
the progress remains bdow that specified in Clause 16.0 or the relevant clause in GCC &
Special Conditions of Contract or that the work remains incomplete. This will also apply to
items or group of items for which a separate period of completion has been specified.
i) Compensation for delay of work @ lYo per fortnight of the cost of unfinished or
balance work
Provided always that the total amount of compensation for delay to be paid under this
condition shall not exceed 20% of the cost of balance work. The amount of compensation
may be adjusted or set-off against any sum payable to the Contractor under this or any
other contract with NBCC.
ln case, the contractor does not achieve a particular milestone mentioned elsewhere in the
tender document or the re-scheduled milestone(s), the amount shown against that
milestone shall be withheld, to be adjusted against the compensation levied at the final
grant of Extension of Time. With-holding of this amount or failure to achieve a milestone,
shall be automatic without any notice to the Contractor. However, if the contractor catches
up with the progress of work on the subsequent milestone(s), the withheld amount shall be
released. ln case the contractor fails to make up for the delay in subsequent milestone(s),

amount mentioned against each milestone missed subsequently also shall be withheld
However, no interest, whatsoever, shall be payable on such withheld amount.
4. Watch, Ward and Area Fencing
The following is to read in reference with clause 47.A of GCC.
The contractor at his own cost provide hard barricading upto 6m high around entire area
of land which includes writing & painting, arrangement for traffic diversion such as traffic
signals during construction at site for day and night, glow lamps, reflective signs, marking,
flags, caution tape as directed by the Engineer-in-Charge. The barricading provided shall
be retained in position at site continuously as required including its maintenance for
damages, painting, all incidentals, labour materials, equipments and works required to
execute the job. The barricading shall not be removed without prior approval of Engineer-
in-Charge for which no additional cost shall be paid.
5. Meetings/ Reports
There would be working level review meeting on site, in the Ministry and NBCC HQ. There
would be a review meeting every month convened by the Project Consultant of Ministry of
AYUSH for which the venue will be rotated between project site, NBCC's Office and
Ministry HQ. There would be a Steering Committee Review once every three months that
will be chaired by representative of Ministry of AYUSH. Nothing extra shall be payable over
and above the quoted rates as per the financial bid to comply with such requirements.
Contractor shall give daily report on deployment of category wise labour and equipment
alongwith the progress of work done on previous day in the proforma prescribed by the
Engineer-in-charge. Periodic reports (weeklyl fortnightlyl monthly/ annual) shall be
prepared and submitted by the Contractor for revieWapproval at various stages of the
contract. Atleast 5 (five) copies of reports (standard A4 size sheets properly printed &
bound using good quality paper) shall be prepared and submitted by the Contractor on a
weeklyl fortnightly/ monthly/ annually basis covering overall scenario of the work.
