MUNICIPALITY OF TANAUAN
SANGGUNIANG BAYAN
WHEREAS, one of the primary functions of the Municipal Local Government under RA 7160
otherwise known as the Local Government Code of the Philippines, is to protect vital
government properties under its jurisdiction.
WHEREAS, the National Irrigation Administration has constructed Irrigation Systems within the
Municipality of Tanauan which has contributed in the development of agriculture industry and
benefited our constituents in the Municipality.
WHEREAS, unabated abuses and destruction of irrigation infrastructures are rampant and
causes untold damages and thereby worsening the irrigation services;
WHEREAS, the joint effort of the National Irrigation Administration and the Farmer Irrigators’
Associations to regulate the use of irrigation considering their limitations for police power,
requires the support from the local government.
WHEREAS, irrigation water is vital to local development and it has become increasingly
necessary for the government to intervene actively in improving the management of water
resources;
SECTION 1. Title- the ordinance shall be known as the Irrigation Regulation Ordinance
SECTION 2. Scope – the ordinance shall apply only within the territorial jurisdiction of the
Municipality of Tanauan, Leyte.

DEFINITION OF TERMS
SECTION 4. To understand the terms used in the ordinance, the following are defined
operationally:
Irrigation Structures and Facilities – refers to all structures and facilities provided
in a particular irrigation system.
Water Delivery Request (WDR) – permit granted by NIA & IA to individual water
users for a particular cropping season.
Canal Embankments – refers to the canal earth bank, built to carry irrigation
water.
Canal & Road Easement – refers to the canal and service road right of way

REGULATIONS AND PROHIBITIONS ON THE OPERATION OF IRRIGATION SYSTEM
SECTION 5. The NIA and the Irrigators Association shall be required to furnish the LGU
concerned every cropping season a copy of the approved Cropping
Calendar and Pattern of Planting including Operation and Maintenance Plan and
Water Delivery and Distribution Plan.
SECTION 6. It shall be unlawful to use or divert irrigation water without an approved Water
Delivery Request from duly recognized Irrigators Association in
accordance to the rules and regulations set and duly approved by the latter and
by the National Irrigation Administration.
SECTION 7. It shall be unlawful to any person to undertake land preparation of any farm lots
using irrigation water with no approved Water Delivery Request.
SECTION 8. It shall be unlawful to construct, destroy, manipulate, take control and remove
any irrigation fixtures, facilities, structures, headgates, checkgates, turn-
outs and other appurtenant irrigation structures without authority from the
Irrigators Association and the National Irrigation Administration.
SECTION 10. It shall be unlawful to dump noxious, poisonous substances and garbage along
irrigation and drainage canals including other water ways within the
municipal jurisdiction.
SECTION 11. It shall be unlawful to undertake fishing along irrigation canal, dams requiring
manipulations of irrigation structures resulting to obstruction and
diversion of irrigation water.
ARTICLE V
IMNPLEMENTING, MONITORING AND EVALUATION TEAM
SECTION 12. An implementing, Monitoring and Evaluation Team is hereby created composed
of representatives from the Irrigators Association, National Irrigation
Administration, Office of the Municipal Agriculture, in
coordination with the Philippine National Police/Barangay Police and
shall be places under the control and supervisions of the Municipal Mayor.
ARTICLE VI
PENALTIES FOR VIOLATIONS
SECTION 13. Any person/s violating section 5, 6, 7, 8,9 and section 10 under ARTICLE IV of the
said Municipal Ordinance shall be fined in the amount of TWO
THOUSAND FIVE HUNDRED PESOS ( P 2,500.00) or an imprisonment of not
more than 6 months but not less than 2 months.
ARTICLE VII
EFFECTIVITY AND IMPLEMENTATION
SECTION 14. This ordinance shall take effect immediately after its publication in at least
THREE (3) conspicuous places for THREE (3) consecutive weeks.
