INTELLIGENCE’

RULES AND REGULATIONS

• ELIGIBILITY FOR PARTICIPATION

Participation is restricted to students currently pursuing their law degree. Law schools/colleges
recognised by the Bar Council of India are eligible to participate in the 11th Conficiendis
Legislativa National Legislative Drafting Competition, 2022.

• TEAM COMPOSITION

The team may comprise of a maximum number of 2 members. A maximum of 3 entries are
permitted from each institution.

• REGISTRATION

All interested teams who wish to register shall send the duly completed Registration Form (see
Annexure A) to [email protected] along with the Transaction details (screenshot of the
online payment) of Rs. 2,000/- (Rupees Two Thousand Only) as the registration fee.

The Participants have to register provisionally by sending an email to [email protected] by


10th December, 2021 before 11:59 PM.

The email should include -

1. Name of the institute,

2. Name of the participants, and

3. Contact details of the participants.

The last date for sending the soft copy of the registration form and proof of payment of
registration fee is 20th December, 2021 before 11:59 PM.

All the formalities have to be completed in order to confirm the participation.

• BACKGROUND NOTE
Several definitions of AI exist, and one author has suggested that the definition changes based on
the goals that are trying to be achieved with an AI system. India’s 18-member task force defines
AI as “the science and engineering of making intelligent machines, especially intelligent
computer programs”, with ‘intelligence’ being “the computational part of the ability to achieve
goals in the world”. Further, the NITI Aayog discussion paper classifies AI as “a constellation of
technologies that enable machines to act with higher levels of intelligence and emulate the human
capabilities of sense, comprehen[sion] and act[ion]”. AI can be simplistically classified as
technology that is created by a human, improved by a machine and has the power to disrupt

almost all aspects of human existence. The legal implications of AI in India are unknown at
present.
“Does the legal responsibility arising through an AI’s illegal action lie with the AI, its owner or
its user or operator?”
The time has come for the Indian government to begin carefully considering how CRIs pertaining
to the next generation of AI (ie, strong AI and superintelligence) should be treated in the patent
ecosystem. Fundamentally, we must address whether we believe that humans cannot replicate the
grand design of evolution on a piece of paper coded into a machine – and therefore strong AI and
superintelligence is beyond our capability – or whether we believe that basic knowledge,
intelligence and cognitive thinking are programmable into a machine that will then be able to
make independent decisions. It needs to be determined whether a machine with such capability
can be an inventor. Once this question is answered, the other aspects will eventually fall into
place. While we ruminate on the policy issues, a fascinating practical point to ponder is that if
artificial intelligence lives up to its hype and superintelligence in AI is achieved, then would not
the AI then be able to decide whether it has created patentable subject matter, review the prior art
and approve or reject its own application – and, if patented, find infringers with claim charts that
are indisputable? Will the very machines we create file, prosecute, defend, enforce and pay and
receive damages – thus taking all our jobs away? Needless to say, the road ahead is unknown
and intimidating.

• FORMAT OF THE SUBMISSION


Ø The language for the competition will be strictly English.
Ø The font used must be Times New Roman, size 12, line spacing should be set at 1.5, with one-
inch margin on each side.
Ø The font of footnotes must be Times New Roman, Size 10, single line spacing.
Ø Page numbers must be given at the Top Right-hand corner.
Ø The length of the bill should not exceed 30 pages.
Ø The cover page of the submission should include the Long Title of the bill along with the name
of the Author(s), with the author's designation.

• FORMAT OF THE DRAFT

The draft of the Legislation should be in the following format:

Ø The Enacting Clause
Ø The Short Title
Ø Extent and Commencement Clause
Ø Definitions
Ø The Operative Section
Ø Exceptions and Exemptions Clause
Ø Procedural Provisions
Ø Offences
Ø Penalties
Ø Provisions regarding Delegated Legislation

• GENERAL RULES

Ø The Participants have to send the soft copy of the registration form along with the proof of
payment by 20th December, 2021 by 11:59 PM.
Ø The Participants have to send the soft copy of the Legislative bill by 1st March, 2022 by 11:59
PM.
Ø Results will be declared on 15th March, 2022.
Ø All participants will receive a participation certificate.
Ø Entries sent after the deadline shall be disqualified.
Ø Any entry found to be plagiarized will be disqualified.

• PRIZES
Ø The Best Team - Cash Prize of Rs. 10,000/- and Certificates.
Ø The Runner Up Team - Cash Prize of Rs. 7,000 and Certificates.
Ø The Second Runner Up Team - Cash Prize of Rs. 5,000 and Certificates.
