Sector-19D, Vashi, Navi Mumbai 400705 and Pursohottam Gashe residing at

Respected Sir,

1. I am presently residing at the address as mentioned hereinabove. I am


working as food vendor at chunabhatti

2. I am systematically cheated by Mr. Wasim Mukadam proprietor of K.V


C o n s t r u c t i o n a n d Pursohottam Gashe o n p r e t e x t o f s e l l i n g a f l a t n o – 1 0 1
K.V. complex, Arjunwadi Ghansoli Village, near VED Hospital,
Ghansoli, Navi Mumbai- 400701 admesuring abt 350 Sq.ft and defrauded
me for an amount of INR 5,00,000/- (Indian Rupees Five Lakhs Only)
He has committed cheating, criminal breach of trust, the facts of the
matter are as follows.

3. I state that most of the Meetings, Inducement, Criminal breach of Trust


and/or cheating caused by said Mr. Wasim Mukadam proprietor of K.V
C o n s t r u c t i o n a n d Pursohottam Gashe h a v e b e e n d o n e w i t h i n t h e
Jurisdiction of Chunabhatti Police Station, Chunbahatti and hence
present Complaint is file in the Chunabhatti Police station.

4. FACT OF CASE:

a) I state that on 7th September, 2017, a person by name Mr. Wasim


Mukadam proprietor of K.V Construction, has approached me along with
m y r e l a t i v e N a m e l y M r . Pursohottam Gashe . A t m y r e s i d e n c e a n d D u r i n g
our meeting, said Mr. Wasim Mukadam proprietor of K.V Construction
has informed me that he is in to business construction and selling flat at
c h e a p r a t e f o r l o w e r i n c o m e g r o u p p e o p l e a n d f u r t h e r informed me that he
is going to construct a building at K . V . c o m p l e x , A r j u n w a d i G h a n s o l i
Village, near VED Hospital, Ghansoli, Navi Mumbai- 400701 under the
same scheme after taking all necessary permission from concern
a u t h o r i t y . The said M r . W a s i m M u k a d a m p r o p r i e t o r o f K . V C o n s t r u c t i o n
a n d Pursohottam Gashe has offered me a flat at flat no 101 in the said building
at consideration of INR Rs 9,45,000/- initially I was hesitant to the offer but
my relative namely Pursohottam Gashe forced and convince me stating he has
the sole selling rights in the said project and assure me of full guarantee of
money in case of any problem in the said project.

b) Thereafter, the repeatedly they kept on insisting on buying the said flat
a n d on 8 t h November, 2017 in presence of Mr. Pursohottam Gashe said M r .
W a s i m M u k a d a m p r o p r i e t o r o f K . V C o n s t r u c t i o n has sold the said flat n o –
101 K.V. complex, Arjunwadi Ghansoli Village, near VED Hospital,
Ghansoli, Navi Mumbai- 400701 admeasuring abt 350sqft to me through
n o t a r y r e g i s t e r M e m o r a n d u m o f U n d e r t a n d i n g d a t e d . Accordingly, on term
of paying Rs 5,00,000/- till completion of construction and thereafter pay Rs
4,45,000/- on possession and execution of register sale agreement. Therefore In
furtherance of said MOU i paid 2,50,000/- (Two lakh fifty thousand Rupees)
through cheque no 224787 drawn on Canara Bank dated 08/10/2017 on
execution of said MOU and balance payment was decided to be paid on
progress of the construction Slab wise and thereafter I paid 2,50,000/- (Two
lakh fifty thousand Rupees) in five installment as follows

i. INR Rs. 50,000/- was paid through cheque no 224790 drawn on Canara
Bank dated 19/12/2017.
ii. INR Rs. 50,000/- was paid through cheque no 224791 drawn on Canara
Bank dated 12/03/2018.
iii. INR Rs. 50,000/- was paid through cheque no 126444 drawn on Canara
Bank dated 03/09/2018.
iv. INR Rs. 50,000/- was paid through cheque no 126446 drawn on Canara
Bank dated 16/10/2018.
v. INR Rs. 50,000/- was paid through cheque no 126455 drawn on Canara
Bank dated 22/01/2019.

5. I state that as promised that said building will be constructed after obtaining all
the necessary permission from concern authority, but whenever ask for the said
document of the the permission and and sanctioned plan said M r . W a s i m
Mukadam proprietor of K.V Construction would give some or the other
reason and would escape from giving such details and constantly kept on
s a y i n g t h a t t h e s a i d f i l e i s i n p r o c e s s . However, shockingly and
surprisingly, he never showed the said document.

6. I say that on date December, 2019 when I went to see the progress of the
c o n s t r u c t i o n o f s a i d b u i l d i n g shockingly and surprisingly I learned that the
said flat was sold to some other person and the said flat is also occupied by the
said person.

7. I state that in spite paying all the installment as an when demanded the
said Mr. Wasim Mukadam proprietor of K.V Construction sold the flat to
some other person thereby committing the act of cheating and defrauding
for a tune of Rs. 5,00,000/- which was my life saving. I am completely
devastated by such as act of Mr. Wasim Mukadam proprietor of K.V
Construction

8. Thereafter, when meet Mr. Wasim Mukadam proprietor of K.V


Construction, During the meeting, it was revealed to me that said Mr.
Wasim Mukadam proprietor of K.V Construction has dishonestly
misappropriated the funds from me and sold the said flat to some other
person and also threatened me and my husband of dire consequences if
we make any complaint against him .
9. I say that thereafter; I was persistently following up with said Mr.
Wasim Mukadam proprietor of K.V Construction to return the amount of
Rs.5,00,000/- which he misappropriated by defrauding me on the pretext
of selling the said flat. However, he avoided my phone calls and meeting
me. Therefore, I informed him that if he will not pay my aforesaid
amount then I will file complaint against him with local police station
for cheating and commission of Criminal breach of Trust to the tune of
Rs.5,00,000/-. In order to avoid a complaint/criminal proceeding he paid
me Rs.1,00,000/- and assured me for due payment in short period.

10. I state that after the month of September, 2020, said Mr. Wasim
Mukadam proprietor of K.V Construction has totally ignored me, my
messages, phone calls and gave me a warning that he will cause harm to
me and family. Thus, I realize that said Mr. Wasim Mukadam proprietor
of K.V Construction has not only cheated me but also committed the
offence of criminal breach of trust and offence of threatening to harm
me, if I demand my money back.

11. Thus, I request to take my complaint against said Mr. Wasim Mukadam
p r o p r i e t o r o f K . V C o n s t r u c t i o n a n d Pursohottam Gashe f o r i n d u c i n g m e t o
p a y h i m a n a m o u n t o f R s . 5 , 0 0 , 0 0 0 / - (Rupees Twenty Five lakhs) for
purchasing a flat in the building constructed by him and deceived me to perform
in accordance with his scheme. However, he sold the said flat to some other
person a n d f r a u d u l e n t l y m i s a p p r o p r i a t e d t h e s a i d a m o u n t t o t h e t u n e o f
R s . 5 , 0 0 , 0 0 0 / - (Rupees Five lakhs). H e n c e , I h e r e b y w a n t t o l o d g e a n F I R
under section 420, 406,409 of the IPC.
