Frame the issues on the basis of the pleadings ol the parties noticed below and write
the judgment.
lir Bam, owner of a house situated within Gram Panchayat Makarwali, District Aimer,
Rajasthan, let out a portion of his house to Mr. Shyam on a monthly rent of Rs.2,000t on
1 .1 .200'1 . On 17.12.2011, Mr. Ram filed a suil lor possession against Mr. Shyam belore the
civil court, alter terminating the tenancy by way of a valid notice under Section 106 of the
Transter of Property Act, 1882.
Mr Shyam filed his written statement raising preliminary objection regarding jurisdiction
o, civil court in view of provisions of Rajasthan Renl Control Act, 2001. lt was conlended that
as he has entered into an agreement on 12.03.2009 with l\,1r. Ram lor purchase of the suit
house and paid a huge sum, the relationship of landlord/lenanl between lhem has ceased lo
exist. He claimed to be in possession of lhe suit house as a purchaser in pan performance of
the agreement dated 12.03.2009.
Mr Ram liled replication contending that the suil was maintainable before lhe civil
coun and Mr. Shyam has been paying the rent till July, 2011. He lurther contended that the
agreement dated 12.03.2009 is inadmissible in evidence as the same is unregistered and
unstamped.
