It has come to our attention that the EPA and US Army Corps of Engineers is soliciting comments on the Site
Management and Monitoring Plan for Arecibo Harbor, Mayagüez Harbor, Ponce Harbor,San Juan Harbor, and Yabucoa Harbor
Dredged Materials Disposal Sites.    The deadline for comments is the first of June. 

The decondenal ocean dumping plans reference multiple locations and a federally funded NOAA-NMFS consultation for which the
public has no access to for review in order to issue more informed comments into this record. 

Further, the plan includes five major ports, the dredge disposal of which is not limited to the disposal sites themselves, but also in
defining paths the scow barges take as well as meaningful and cost effective implementation of oversight and compliance measures to
ensure planning constraints are adhered to.   

Two disposal sites fall within the three mile boundaries that enjoy a three dimensional designation of waters designated as critical
habitat for corals.  

All disposal sites involve the passage of scow barges through designated critical habitat waters.  

In the case of the Arecibo plans, it is likely those plans could involve past legal precedent from nourishment or re-nourishment
projects associated with past dredging operations. 

This complex decondonal plan would benefit from coastal zone consistency certification and we ask that the Planning Board of Puerto
Rico consider requesting separate plans for each of these sites as site specific stakeholder input is needed to make the best plans, and a
site specific approach is the best way to insure this participation. The planning time frame is one in which climate change related
impacts are likely to occur.  

Failure to include input from regional stakeholders could also result in stakeholder conflicts down the road that could pose a threat to
future federal funding.
