ADOPTING THE
HSAC SCHEDULE OF FEES

\IIrEREAS, pursuant to Section r7 of RA 1r2o1 in relation to Section 3r.r of its


Implementing Rules and Regulations, the Commission shall sit en banc for purposes of
promulgating rules and regulations governing the hearing and disposition of cases before any
of its Divisions and Regional Adjudication Branches (RABs) as well as formulating policies
affecting its administration and operations;

WHEREAS, upon operationalization of the Human Settlements Adjudication


Commission (HSAC) in 2o2o, it adopted the HLURB Schedule of Fees under HLURB Board
Resolution No. 9tz, s. 2o13l, which also covers fees now imposed by the Department of Human
Settlements and Urban Development (DHSUD);

\ffIIEREAS, there is apparent need to promulgate a separate Schedule of Fees for


HSAC that specifically covers its processes;

\trHEREAS, at present, it is imperative to retain the rate of fees imposed under


HLURB Board Resolution No. 9tz, in view of the continuing difficulties suffered by the public
and our stakeholders due to the dire economic effects of the COVID-I9 pandemic;

\ilHEREAS' BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the


following fees shall be charged by HSAC:

l. Legal Fees

1. Filing Fee ? 1,440.00


2. Additional Fee for claims (for refund, damages,
attorney's fee, etc.)
1. Not more than P 20,000.00 P 173.00
2. More than ? 20,000.00 but less than ? 80,000.00 ? 576.00
3. ? 80,000.00 or more but less than P 100,000.00 P 864.00
4. P 100,000.00 or more but less than ? 150,000.00 P 1,440.00

Indigent or pautrrer-litigants are e:<empt from payment of legal fees, the following
shall be considered indigent persorxi:

a. Residents of Metro Manila whose net income is not more than ? t4,ooo.oo
per month;
b. Residents of other cities whose net income is not more than ? t3,ooo.oo
per month; and
c. Residents of the rqst of the country whose net income is not more than
? tzrooo.oo.

"Net Incorne" shall refer to the income of the litigant less statutory deductions.

"statrrtorlr deductions" shall refer


to withholding taxes, GSIS, SSS, Pag-Ibig, Health
Insurance and Philhealth premiums as well as mandatory deductions. Pension shall be
excluded in the determination of indigency.

Ownership of land or real property shall not by itself constitute a ground for
disqualification as an indigent litigant. The determining factor for indigenry shall be
the income of the litigant and not his or her ownership of real property.l

The following shall be accepted as proof of indigency, which shall be attached to the
ex-parte moton to litigate as pauper litigant when represented by private counsel, law schools'
duly accredited free legal aid program, and non-government organization or other civic
organizations advocating free legal assistance:

a. Latest Income Tax Return;


b. Certificate of Indigency issued by the Departrnent of Social Welfare and
Development (DSWD) or the CiplMunicipal Social Welfare Development
Office having jurisdiction over tthe residence of the applicant; or
c. Certificate of Indigency issued by the Barangay Chairman having jurisdiction
over the residence of the applicant.

The fees or charges shall be a lien on any judgment rendered in the case in favor of the
indigent litigant unless otherwise provided in the dispositive portion of the decision.

Government agencies and its instrumentalities are exempted from paylng legal fees.

Local Government Units (LGUs) and Government Owned or Controlled Corporations


(GOCCs) with or without independent charters are not exempted from paying legal fees.
