SUBJECT: Conservation of rare, threatened and endangered fishery
species
Pursuant to Sections 11 and 97 of R.A. No. 8550, this order on the conservation of rare, threatened and
endangered fishery/aquatic species is hereby issued for the information and guidance of all concerned.
SECTION 1. Definition. - As used in this Order, the following terms shall be construed as:
a. Rare. - Fishery/aquatic resources with small world populations that are not endangered or vulnerable at
present.
b. Threatened. - A general term which may be used to describe a fishery or aquatic species the population
of which is endangered, vulnerable or rare.
c. Endangered. - refers to the species, subspecies, including the eggs, offspring, parts and derivatives of
plants and animals listed in the CITES Appendices.
d. CITES. - The acronym for the Convention on the International Trade in Endangered Species of Wild
Fauna and Flora.
e. CITES Appendices - refer to Appendix I, II and III of the Convention which are lists of species of plants
and animals endangered by trade.
SEC. 2. Prohibition. - It shall be unlawful for any person, natural or juridical, to take or catch or cause to
be taken or caught the following fishery/aquatic species.

SEC. 3. Penalty. - Violation of this order shall hold the offender liable to the penalty of imprisonment from
twelve years to twenty years or a fine of one hundred and twenty thousand pesos, or both such fine and
imprisonment in the discretion of the court, including forfeiture of the catch subject of the offense and
cancellation of his fishing permit, if applicable.
SEC. 4. Repeal. - All orders, rules and regulations or parts thereof which are inconsistent with this order
are hereby repealed or modified accordingly.
SEC. 5. Effectivity. - This order shall take effect fifteen (15) days after its publication in the Official Gazette
and/or in two (2) newspapers of general circulation and fifteen (15) days after its registration with the
Office of the National Administrative Register.
