CONTRACT AGREEMENT - CONSULTANTS

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Service is entered into by and between:

THE OFFICE OF THE BANGSAMORO WOMEN COMMISSION (BWC), a bangsamoro


government agency duly created by law and with official business address at
Bangsamoro Government Center, Governor Gutierrez Avenue, Rosary Heights VII,
Cotabato City, represented herein by MP HADJA BAINON G. KARON as
CHAIRPERSON, hereinafter referred to as the First Party;

And

HAZAR M. AHMAD married, of legal age, with postal address at BAAS Lamitan,
Basilan, hereinafter referred to as the SECOND PARTY;

1. That the SECOND PARTY agrees to devote his technical knowledge, training, and
skills under the contract of the FIRST PARTY as GBV Coordinator - BaSulTa
effective 1st of JULY 2022 to the 30th of September 2022 with monthly
compensation of Fifty-One Thousand Five Hundred Fifteen Pesos Only
(₱51,515.00) chargeable against the BWC funds for 2022. Notwithstanding the
fixed duration of this contract, the services of the Second Party may be
terminated earlier than the expiration date due to unsatisfactory performance
rating, unavailability of funds, early completion or discontinuance of the project,
or other justifiable reasons provided the notice should be given thirty (30) days
before the actual termination of the contract. The First Party reserves the right
not to renew the contract after expiration. In case of renewal or termination of
the contract, the Second Party shall be required to submit clearance from
money, property accountability including documents using for the purpose the
form being used by regular employees for purposes of administrative
expediency.

2. That the FIRST PARTY may, at its discretion and without change of emoluments
and other monetary privileges, shift SECOND PARTY to another assignment at
the same time perform the following functions:

a. Provide strategic direction and undertake analysis of GBV trends, and


gaps in services to better address needs;
b. Coordinate with the Local Government Units to support mainstreaming
of GBV and protection within assigned areas.
c. Initiate measures in providing resolution to identified potential
problems in the area;
d. Facilitate the compliance of BWC procedures as provided in the Manual
of Operations/Guidelines of the BWC.
e. Reviews, analyses and consolidates the MONTHLY, QUARTERLY and
ANNUAL reports to ensure their accuracy and completeness and
submits the same to BWC every 3rd week and 4th week of the month
respectively;
f. Work closely with the BCW project officers, Monitoring and Evaluation
Officer, and the Head of programs to ensure the achievement of the
program goals.
g. Comply with security protocols and policies;
h. Perform other related duties that may be assigned by the superior from
time to time.

3. The Second Party may travel subject to the exigency of service and approval of
the Head of Office. For authorized travel outside the usual work station, the
Second Party shall be allowed to collect actual traveling expenses (such as meals
expenses and transportation expenses) provided that the transportation is
supported by receipts and other proof of purchase and at a rate not exceeding
the rate authorized for regular employees.

4. The SECOND PARTY agrees to observe the same decorum as regular employees
and submits to be bound by the rules and regulations of the first party, Civil
Service Commission (CSC), and all other pertinent laws. Any violations merit
appropriate disciplinary action as provided in the Philippine Laws.

5. This Contract creates no employer-employee relationship with the First Party,


thus, services rendered under this agreement are not considered government
service. The Second Party is not therefore authorized to represent the first party
other than being a contract of service personnel. In the event any benefits or
privileges are granted, the Second Party acknowledges that the grant is purely
an act of liberality on the part of the First Party and does not in any way create
any obligation on the latter to continue providing the same nor does that change
the nature of the engagement as COS employee.

6. The Second Party acknowledges that he has read and understood this
Agreement and were explained in a language or dialect known to him in its
entirety with full knowledge of his rights under the law.

EMPLOYEE NON - DISCLOSURE AGREEMENT

The BANGSAMORO WOMEN COMMISSION, herein referred to as “BWC”, the


undersigned employee hereby agrees and acknowledges:

1. That during the course of my employment there may be disclosed to me certain


information from BWC; said information consisting of but not limited to:
Technical information: methods, processes, frameworks, compositions, research
projects, and publications.

a. Classified information: technical data in the possession of BWC that are


considered classified and/or confidential due to its implications on national
security consisting of but not limited to data concerning the mandates of the
BWC of the Bangsamoro Autonomous Region in Muslim Mindanao
(BARMM).

2. I agree that I shall not during, or at any time after the termination of my
employment with BWC, use for myself, or disclose or divulge to others including
data of BWC in violation of this agreement.

3. That upon the termination of my employment from BWC.

a. I shall return to BWC all documents and property of the same, including but
not necessarily limited to: tables, project proposals, statistical data, and all other
materials and all copies thereof relating in any way to BWC’s business, or in any
way obtained by me during the course of employment. I further agree that I
shall not retain copies, notes, or abstracts of the foregoing.
b. BWC may notify any future or prospective employer or third party of the
existence of this agreement and shall be entitled to full injunctive relief for any
breach.
c. This agreement shall be binding upon me and my personal representatives
and successors in interest and shall inure to the benefit of the BWC, its
successors, and assigns.
