SUBJECT: AMENDMENTS TO DAR ADMINISTRATIVE ORDER NO. 01,
SERIES OF 2020, ENTITLED “GUIDELINES SIMPLIFYING THE
LAND ACQUISITION AND DISTRIBUTION PROCESS ON CARP-
COVERED PRIVATE AGRICULTURAL LANDS”
PREFATORY STATEMENT
The Administrative Order (A.O.) No. 1, Series of 2020, entitled “Guidelines
Simplifying the Land Acquisition and Distribution Process on CARP-Covered
Private Agricultural Lands”, was issued in compliance to the directive of the
President to complete the land acquisition and distribution (LAD) process of the
remaining private agricultural lands (PALS) covered by Republic Act (R.A.) No.
6657, as amended, including tenanted rice and corn lands under Presidential
Decree (P.D.) No. 27 by June 30, 2022.
The aforesaid AO was likewise issued in accordance with Section 49 of R.A. No.
6657, as amended (Power to issue rules and regulations), in pursuit of the overall
mandate of the Department of Agrarian Reform (DAR) to implement the
Comprehensive Agrarian Reform Program (CARP) and other agrarian reform laws.
Corollary to this, Executive Order (E.0.) No. 405, dated June 14, 1990, provides
that the implementation of the CARP, particularly on the matter of acquisition and
distribution of PALs, may be conducted by streamlining certain administrative
procedures in land valuation and compensation.
The challenge of completing the LAD process in the remaining PALs has been a
common and recurring issue in the implementation of the program. Hence, the
DAR and the Land Bank of the Philippines (LBP) recognized the need to further
reduce and simplify the procedures and documentary requirements in order to
expedite the conduct of the field investigation and land valuation activities for
landholdings covered under the CARP.
Similarly, current developments in the operations of the DAR necessitate the
incorporation of amendments which greatly streamline the LAD process. These
being stated, the following amendments to A.O. No. 1, Series of 2020 are hereby
issued:

3.2. The joint field investigation (JFI) shall be conducted by the JFI Team,
which shall be composed of the DAR Provincial Office/DAR Municipal
Office (DARPO/DARMO) designated personnel, a member of the
Barangay Agrarian Reform Council (BARC), or in the absence thereof,
any authorized representative/member of the Barangay Council, land
owner (LO) or his authorized representative, potential ARBs,
representatives of the Municipal/Provincial Agricultural Office-
Department of Agriculture (MAO/PAO-DA), if there is an issue on the
landholding’s suitability for agriculture, and the Department of
Environment and Natural Resources - _Community/Provincial
Environment and Natural Resources Office (DENR-CENRO/PENRO), if
there is any issue as to the 18% slope.
The said JFI shall be conducted based on the approved survey plan
(ASP) or the advance survey plan (AdvSP) to verify the data/information
contained in the claim folder (CF) for the purpose of valuation of the
subject landholding.
SECTION 2. Section 3 of Admi
hereby amended as follows:

3.3.1 Based on the Field Investigation Report (FIR) and ASP/AdvSP, the
Land Bank of the Philippines (LBP) shall proceed to determine the
value of just compensation of the subject landholding.
Consequently, upon completion of the land valuation, the LBP shall
prepare and send the Memorandum of Valuation (MOV), together
with Land Valuation Worksheet (LVW), to DARPO for the
preparation of the Notice of Land Valuation and Acquisition
(NLVA). However, if the AdvSP was used in the initial valuation,
the NLVA shall be issued only upon the receipt of the ASP.
The LBP shall deposit/book the compensation proceeds, in cash
and Agrarian Reform (AR) Bonds, upon receipt of the Order to
Deposit LO Compensation together with a copy of the ASP from
the DARPO. It shall issue the Certificate of Deposit (COD) within
three (3) banking days from deposit/booking.
The COD, ASP, and other necessary documents shall be the basis
of the ROD to: 1) cancel the LO’s title for the landholding covered
under CARP, in case of total coverage; 2) issue Transfer Certificate
Page 2 of 10of Title (TCT)/Original Certificate of Title (OCT) in the name of the
Republic of the Philippines (RP); and, 3) issue title for the retained
area/non-coverable area, if any, upon submission of owner's
duplicate copy (ODC) of the LO’s title.
3.3.2 In case of discrepancy/ies between the ASP or AdvSP and the FIR,
the appropriate adjustment shall be made to conform with the
FIR.
For purposes of LO compensation, the amended/adjusted ASP
shall be submitted to the LBP for adjustment of the area covered
and the corresponding MOV.
SECTION 3. There shall be incorporated new provisions after subsection
3.5 of Administrative Order No. 1, Series of 2020, with the new
subsections to read as follows:
3.6 Pursuant to E.0. No. 129-A, dated July 26, 1987, the DAR shall be
responsible for the acquisition and distribution of landholding covered
under CARP. Therefore, the DAR shall ensure the accuracy and
completeness of documents required in the CF, with the assistance of
concerned government agencies and other stakeholders, for submission
to LBP in accordance with R.A. No. 6657, as amended by R.A. No. 9700
and pertinent laws and policies.
3.7 Further, as mandated by E.0. No. 405, dated June 14, 1990, the LBP
shall be primarily responsible for the determination of the land valuation
and compensation for all PALs suitable for agriculture under either the
voluntary offer to sell (VOS) or compulsory acquisition (CA)
arrangement as governed by R.A. No. 6657, as amended. Upon
submission of the CF by the DARPO, the LBP-Agrarian Operations Center
(AOC) shall review the completeness and sufficiency of the documents
in the CF. If in order, the LBP-AOC shall proceed with the processing of
the same to determine the value of just compensation of the subject
landholding pursuant to R.A. No. 6657, as amended. Otherwise, the
LBP-AOC shall return the CF to the DARPO, specifying the lacking
documents/inconsistent information, within three (3) banking days from
receipt of the CF.
The LBP shall process the CF, until the issuance of the MOV, within
twenty (20) days from receipt of the complete documents as indicated
in the CARPER LAD Form No. 48. (Checklist of Documentary
Requirements in the Claim folder for Transmittal to LBP)
3.8 The JFI Team shall accomplish and sign the Field Investigation Report
(FIR). The PARPO II shall certify the correctness of the data,
information, and land use/s per lot contained in the FIR and if the same
Page 3 of 10is consistent with the ASP or AdvSP, by affixing his/her signature in the
said FIR, based on the review and recommendation/s of the Chief
Agrarian Reform Program Officer-Land Tenure Security (CARPO-
LTS)/designated personnel of the DARPO.
3.9 In general, the generation of the Oath of ARBs and facilitation of the
signing and screening of the ARBs shall be undertaken after the issuance
of Masterlist/amended Masterlist of ARBs and prior to the submission of
the CF to LBP-AOC. In case of failure to undertake on the aforesaid
period due to unavoidable circumstances, the DAR shall prepare and
ensure that the Oath of the ARBs are duly signed and sworn to before
a City or Municipal Judge prior to the generation of CLOAs to the
concerned ARBs.
Pursuant to Supreme Court Resolution A.M. No. 20-09-141-RTC, the
conduct of Oath of ARBs may be facilitated through the use of video-
conferencing facilities.
3.10 The distribution and delivery of the ODCs of the registered CLOAs to
the concerned ARBs shall be in accordance with A.O. No. 6, Series of
2021, entitled “Statutory Obligation to Deliver the Agrarian Reform Title
to the Beneficiary” and Section No. 41 of PD No. 1529, on the ODC of
title.
SECTION 3. There shall be incorporated in subsections of Section 4 of
Administrative Order No. 1, Series of 2020, new operating procedures to

‘SERIES OF 2020, ENTITLED “GUIDELINES SIMPLIFYING
‘THE LAND ACQUISITION AND DISTRIBUTION PROCESS ON
(CARP-COVERED PRIVATE AGRICULTURAL LANDS”
PREFATORY STATEMENT
‘The Administrative Order (A.0.) No. 1, Series of 2020, ented “Guidelines
‘Simpliyng the Land Acquistion and Disirbution Process on CARP.Covered
Private Agricultural Lands", was issued in compliance to the directive of the
President to complete the land aoqusstion and distrbution (LAD) process
(of the remaining private agrcultural lands (PALs) covered by Republic Act
(RA) No. 6857, as amended, including tenanted rice and com lands under
Presidential Decree (P.D.) No. 27 by June 30, 2022
“The aforesaid AO was likewise issued In accordance wth Section 49 of RA
No. 6657, a8 amended (Power to Issue rules and regulations), in pursuit
of the overall mandate of the Department of Agrarian Reform (DAR) to
imnplement the Comprehensive Agrarian Reform Program (CARP) and other
‘agrarian reform laws.
Coralary to this, Executive Order (E.0.) No. 405, datod June 14, 1890,
provides that the Implementation of the CARP, paticularly on the matter
‘of acquisition and distribution of PALs, may be conducted by streaming
certain administrative procedures inland valuation and compensation. |
‘The challenge of completing the LAD process in the remaining PALS hes
‘been @ common and recurting issue in the implementation ofthe program.
Hence, the DAR and the Land Bank of the Phiippines (LBP) recognized
the need to further reduce and simplify the procedures and documentary }
requicements in order to expedite the conduct ofthe fel investigation and.
land valuation actives or landholdings covered under the CARP.
Simiary, curent developments in the operations of the DAR necessitate
the incorporation of amendments which grealy streamline the LAD process.
‘These being stated, the folowing amendments to A.0. No.1, Series of 2020
are hereby issued:
[SECTION 1, Section 3.2 of Administrative Order No. 1, Series of 2020,
‘entitled "Guidelines Simplifying the Land Acquisition and Distribution
Process on CARP-Covered Private Agricultural Lands” Is hereby
amended to read as follows:

SECTION 2, Section 3 of Adminitrative Order No. 1, Series of 2020, is
hereby amended as follows:
3.3.4 Based on the Field Investigation Report (FIR) and ASP)
‘AGVSP, the Land Bank ofthe Philippines (LBP) shall proceed
to determine the value of just compensation ofthe subject
fandholding. Consequenty, upon completion of the lend

the value of ust compensation ofthe subject landholding pursuant
to RA. No. 6857, 88 amended, Otherwise, the LBP-AOC shall
retum the CF to the DARPO, spectying the lacking documents!
