DEED OF TRANSFER OF RIGHTS
WITH ASSUMPTION OF MORTGAGE
KNOW ALL MEN BY THESE PRESENTS:
This Transfer of Rights with Assumption of Obligation made and executed by and
between:

of legal age, Filipino and resident of _________________________________________
___________________________________________, Philippines (hereinafter known as
the “TRANSFEROR”);
- and -
______________________________, married to ________________________
of legal age, Filipino and resident of _________________________________________
___________________________________________, Philippines, (hereinafter
referred to as the "TRANSFEREE");
WITNESSETH:
WHEREAS, the herein TRANSFEROR is the true and lawful owner of a house
and lot which he acquired from the Home Development Mutual Fund (HDMF/Pag-Ibig)
covered by the Transfer Certificate of Title No. _________________ of the Registry of
Deeds for the Province of Laguna, situated at _________________________________
_______________________________________, containing an area of ___________
(__________) SQUARE METERS.
WHEREAS, the TRANSFEROR bought the above stated parcel of land through
Housing Loan at the Home Development and Mutual Fund (HDMF)/Pag-Ibig Fund
through installment and he is paying the monthly amortization at the HDMF/Pag-Ibig;
WHEREAS, the TRANSFEROR desires to sell and the TRANSFEREE agrees to
buy the aforementioned property;
NOW THEREFORE, for and in consideration of the foregoing and the mutual
covenants and stipulations hereinafter set forth, the parties hereto have agreed,
stipulated and covenanted and hereby agree, stipulate and covenant as follows:
1. Purchase Price - The total purchase price shall be _______________________
__________________________PESOS (Php._______________) and the same
shall be paid upon execution of this contract;
2. Delivery - The subject property shall be delivered to the possession of the
VENDEE upon payment of the above-mentioned amount;
3. Assumption of Liability - The TRANSFEREE is willing to pay its monthly
amortization at the Home Development and Mutual Fund (HDMF)/Pag-Ibig upon
execution of this instrument. However, all penalties due to HDMF/Pag-Ibig prior
hereof shall be shouldered by the TRANSFEREE;
4. Warranty. – The TRANSFEROR hereby warrants the peaceful possession of the
TRANSFEREE on the property, free from all liens and encumbrances may
hereinafter develop against the subject property;
5. Binding Effect. - The instant Agreement shall be binding not only on the parties
herein, but also on their heirs, assigns and successors-in-interests;

2. To make payments relative to said loan for arrears, if any, as well as the
monthly amortization for the loan in his/her/their own name;

4. To withdraw from or cancel contract/s entered into by me/us, or by
himself, in connection with the loan and receive refunds or other amounts
arising therefrom, if any;
5. To receive copy of letters, papers or documents pertinent to the loan
which should have been furnished to us by the HDMF/Pag-Ibig;
6. To sell, mortgage, lease or in any manner dispose of the mentioned
property;
7. To compromise or settle judicially or extra-judicially matters concerning
the loan which is secured by the above-mentioned property;
8. To secure, receive and/or demand for the owner’s duplicate copy of the
title to the abovementioned property when the same is ready for release;
9. To sign, execute and/or deliver any and all documents pertaining to the
above-matters;
10. To make sign for in our name/behalf, to do such acts and things requisite
and necessary to fully accomplish the above-power granted and authority.
HEREBY GIVING AND GRANTING unto my said Attorney-in-Fact full power and
authority to do and perform all and every act requisite or necessary to carry into effect
the foregoing authority, as fully to all intents and purposes as I might or could lawfully do
if personally present, with full power of substitution and revocation, and hereby ratifying
and confirming all that any of my said attorney-in-fact or his substitutes shall lawfully do
or cause to be done by virtue hereof.
