BETWEEN BRISAD INTERNATIONAL NIGERIA LIMITED of Plot 729 Life Camp
Abuja, (hereinafter called "The Donor" which expression shall where the context
so admits includes his heirs, executors, legal/ representatives & assigns) of the
first part.
IN FAVOUR OF:
KUSHYAK NIGERIA LIMITED of No. 17 Yamusa Street, Ungwan Pama Sabon Tasha
Kaduna, Kaduna State. (hereinafter called "the Donee" which expression shall
where the context so admits includes his heirs, executors, legal/representatives &
assigns) of the second part.
WHEREAS:
By Letter of Certificate of occupancy (hereinafter called the "PROPERTY") granted
by The Honourable Minister FCT Abuja and described as PLOT No. 1058 Cadastral
Zone B18 of Sector Centre D Gudu District Abuja, with file no; MISC 53052
measuring about 5.128.54 Sqm, Approximately became vested in the Donor.
NOW THIS POWER OF AITORNEY WITHNESSES THAT:
THE DONOR HEREBY IRREVOCABLY APPOINTS AND CONSTITUTES KUSHYAK
NIGERIA LIMITED "THE DONEE" OR "ATTORNEY" his true and lawful attorney to
do all or any of the following:-
1. To take possession of the property described in the recital above.
2. To assign, mortgage, charge etc the entire interest therein without
unlawful interference by the DONOR or his executors or assigns however
called.
3. To sue and be sued in respect of the said plot with a proviso that the
DONOR shall indemnify the DONEE against any defects in title herein
conveyed.
4. The DONEE covenants with the DONOR to pay henceforth to the
appropriate authorities all the fees, rents and rates and to perform and
observe the covenants, provisions conditions and stipulations contained in
the current laws affecting the property.
5. The DONOR HEREBY DECLARES AND CONFIRMS that his POWER OF
ATTORNEY is granted for a valuable consideration the receipt whereof he
hereby acknowledges and shall FOREVER BE IN FORCE AND REMAIN
IRREVOCABLE.
6. That there is no other POWER OF ATTORNEY executed in respect of this
property by the DONOR.
IN WITNESS WHEREOF the parties have hereunder set their hands and seal the
day and year first above written.
