1.0 COURSE DESCRIPTION

Since we are all products of families and/ or potential participants in the creation of family, the
subject of family law that exposes us to the rules and social realities that govern the family
system is undoubtedly extremely pertinent. Family Law 1 mainly introduces students to the
understanding of the concept of the family, its characteristics in traditional as well as post-
modern or contemporary societies. Students are also introduced to the different types of
marriages, the legal effects of marriage and then the subject of divorce and its legal effects.
Although the class discussions are premised in Uganda's legal, policy and social economic
context examples may be drawn from different countries both in terms of law, practices and
jurisprudence. Students are further encouraged to also make reference to the international
and regional instruments that have been ratified by Uganda and relevant to the protection and
promotion of rights of persons within the institution of the family.

2.0 OBJECTIVE OR AIMS OF THEC COURSE

At the end of this course, it is expected that students will appreciate the following:

 The concept of the family as a basic unit of society challenged by the dictates of
patriarchy, religion, gender dynamics and the law

 Understand notions like breach of promise to marry, domicile, void and voidable
marriage and approbation of marriages

 Recognise the different types of recognized marriages in Uganda and the pre-requisites
for their formalisation/ solemnisation, the legal effects of marriage and

 Explain the law relating to divorce, judicial and mutual separation as well as the
discourse around matrimonial property rights.

3.0 EXPECTED LEARNING OUTCOMES

At the end of this course students are expected to achieve the following
 Acquired attitudinal change from highly patriarchal perspectives to recognition of
equality of both men and women
 Students are equipped with the skills and knowledge to act judiciously and
 Become advocates of social justice and transformation in the family having appreciated
the gender injustices in the society
 Developed skills in research and writing
 Improved their communication and public speaking skills

4.0 LEARNING METHODS

Class instructions will employ various methodologies to ensure learner centered learning,
interactive class session and build the students research, oratory, problem solving and critical
thinking skills. The clinical methodologies will include:

 Role plays (where possible)
 Simulations/ Hypothetical problems
 Case studies
 Debates
 Moot/ Mock trials
 Documentaries (if equipment is available)
