AN ORDINANCE ADOPTING THE LYRICS AND MUSIC OF THE SIWAWER


FESTIVAL SONG “DUR-ASEN, VINTAREN!” AS THE OFFICIAL SIWAWER
FESTIVAL SONG IN THE MUNICIPALITY OF VINTAR AND PROVIDING PENATY
FOR VIOLATIONS THEREOF

WHEREAS, Section 16 of Republic Act No. 7160 otherwise known as the Local
Government Code of 1991 mandates Local Government Units to ensure and support among
other purposes the enrichment and preservation of culture;

WHEREAS, the composition of the Siwawer Festival Song “DUR-ASEN,


VINTAREN!” has been composed by the people of Vintar, Ilocos Norte through the majestic
knowledge and help of Baby Rodel Sabino R. Daquioag, a resident of Vintar, Ilocos Norte;

WHEREAS, serving as an inspiration to the people of Vintar, Ilocos Norte and the
song depicts the true meaning of “Renewed Unity and Cooperation”, the Sangguniang Bayan
of Vintar deemed it proper to ADOPT the song “DUR-ASEN, VINTAREN!” as the Official
Siwawer Festival Song;

NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED BY


THE SANGGUNIANG BAYAN OF VINTAR, ILOCOS NORTE THAT:

Section 1. Short Title. – This ordinance shall be known, as the “SIWAWER FESTIVAL SONG
“DUR-ASEN, VINTAREN!” ORDINANCE” in the Municipality of Vintar.

Section 2. Scope. – This ordinance shall be played in all events and programs related to Siwawer
Festivities during the yearly Siwawer Festival Celebration in the Municipality of Vintar, whether
within or outside of the territorial jurisdiction of the Municipality.

Section 3. Definition of Terms. - The following terms and phrases when used under the
Ordinance shall mean as follows:

1) Festival Song – refers to the official song of the yearly Siwawer Festival Celebration in
the Municipality of Vintar which shall be played in all es and programs related to
Siwawer Festivities.

2) Lyrics – the words of a song.

3) Music – it is the art or science of harmonic sounds, melody, musical score of a


composition.

Section 4. The Lyrics and Music of the song “Dur-asen, Vintaren!”. – as coined and adopted
by the committee mandated to create the Siwawer Festival Song must always be sang in original
language (iloko) in which it was composed and have the following lyrics;

a. The lyrics and music of the song is composed by Baby Rodel Sabino R. Daquioag,
resident of Vintar, Ilocos Norte.
Section 5. Adoption. – The Siwawer Festival Song “DUR-ASEN, VINTAREN!” is hereby
adopted as the Siwawer Festival Song of the Municipality of Vintar, Province of Ilocos Norte.

Section 6. Amendment or Modification. – The Siwawer Festival Song “DUR-ASEN,


VINTAREN!” can be amended by its lyrics and music after thorough consultations in parts only
and the context of the song shall not be destroyed by the amendments. It shall not be modified,
unless, by enactment of an Ordinance modifying the same; and/or any modification shall be
made for approval of the original composer or by the Culture and Arts Board and only once
every ten (10) years, unless otherwise provided by law or ordinance.

Section 7. Implementing Office. – The Office of the Municipal Tourism shall be tasked to carry
out the implementation of the provision of this ordinance. It shall be responsible in the
circularizing and enhancement of the musical arrangement of the song, including audio-visual
and cinematographic presentation of the official Siwawer Festival Song. Further, digital/video
copies shall be distributed to 33 barangays.

To fully implement the use of the official Siwawer Festival Song, the rights and ownership
reserved to the composer shall be transferred to the Local Government Unit of Vintar.

Section 8. Prohibited Acts on the Usage of the Siwawer Festival Song. – it shall be
prohibited to:

a. By any act or omission change the lyrics and rhythm of the official siwawer festival
song with the intention to dishonor or ridicule upon the official festival song;
b. To sing or play the festival song for mere recreation, amusement, or entertainment
purposes, either in stage or social media sites;
c. To display the festival song whether its title or lyrics for business purposes;
d. To print, paint or attach the lyrics full or partial on any articles of merchandise, except
upon for LGU government official representations;
e. To plagiarized the lyrics of the Official Siwawer Festival Song; and
f. Any other circumstances of similar acts analogous to those above-mentioned.

Section 9. Penalty. – Any person or persons who by acts or omission violates the provision of
this ordinance shall be penalized by:

1. First Offense - Reprimand and fine of Php500.00


2. Second Offense - Php1,000.00
3. Third and Succeeding Offense - Php2,500.00 or an imprisonment of not
less than one (1) month nor more than
six (6) months, or both at the discretion
of the court.

Further, if committed by LGU Vintar officials or employees shall be imposed by a fine of


Php2,500.00 or an imprisonment of not less than one (1) month nor more than six (6) months,
or both at the discretion of the court. Furthermore, the penalty under this ordinance shall not
prejudice the filing of any separate administrative, civil and criminal liability.

Section 10. Separability Clause. – Any provision held to be invalid or declared


unconstitutional, all other provision hereof which are not affected thereby shall continue to be
in full force and effect.

Section 11. Repealing Clause. – All ordinances, rules and regulations or parts thereof
inconsistent with or in conflict with the provisions of this ordinance are hereby repealed or
modified accordingly.

Section 12. Effectivity. – Following the province of Ilocos Norte's Sangguniang


Panlalawigan's approval, this ordinance will go into effect.
