1. INTRODUCTION

This refers to Part IIA (Malaysian Ship Registration – MSR) dan Part IIC (Malaysian
International Ship Registration – MISR), Merchant Ship Ordinance 1952 (MSO 1952).

2. COMPLIANCE REQUIREMENTS

2.1 Application for ship registration is a requirement for all ships to be registered in
Malaysia.

2.2 The applicant must submit an official application to the Registrar of Ships Office.

2.3 Ships that exempt from being registered are as follows :

a. Any ship not exceeding 15 tons nett used for for navigation on the rivers and coastal
waters of Malaysia.

b. Any vessel licensed under Section 475, MSO 1952.

c. Any local fishing vessel not exceeding 500 tons gross where such vessel is licensed
under any written law relating to fisheries.

2.4 Eligibility to register a ship is as follows :

a. Malaysian Ship Registration – MSR


(PORT KELANG / PENANG / KUCHING / KOTA KINABALU) :

The ship must be owned by a Malaysian citizen or if the corporate body needs to
meet the following conditions :

i. Established in Malaysia;
ii. Company headquarters in Malaysia; and
iii. The majority of directors and share partners (including voting partnerships) of the
company are held by Malaysian citizens who are free from any trust or obligation.
The majority in this regard is 51% subject to the changes set by the Minister.

b. Malaysian International Ship Registration – MISR (LABUAN) :

1. Must meet the following conditions :

i. Corporate body incorporated in Malaysia;


ii. Have an office established in Malaysia;
iii. The majority of shareholders, directors and partners of the company are
owned by foreign citizens. The majority in this regard is 51% subject to the
changes set by the Minister; and
iv. Have a paid-up capital of at least 10% of the value of the ship or RM
1,000,000.00, whichever is higher.

2. MISR Ship Manager appointment requirements :

The ship manager must be appointed by the shipowner before the ship
registration application is made. The conditions for appointing a ship manager
must comply with the following :

i. A Malaysian citizen having is permanent residence in Malaysia; or


ii. A company incorporated in Malaysia and having its principal place of
business in Malaysia.

3. MISR ship registration requirements :

3.1 No ships are allowed to be registered under MISR except as follows :

a. It is fitted with mechanical means of propulsion;


b. It is of not less than 1600 gross tonnage; and
c. The age of the ship is :

i. Not more than 15 years if it is a tanker or a bulk carrier; or


ii. Not more than 20 years if it is of a type other than a tanker or a
bulk carrier.

3.2 An annual tonnage fee of RM 0.30 per gross tonnage is compulsory for
ships registered under MISR.

4. METHOD OF APPLICATION

Application for provisional registration, permanent registration, extend registration validity


and deletion registration must be submitted to the Registrar of Ships Office where the ship
has been registered :

a. Marine Department Northen Region (Penang);


b. Marine Department Central Region (Port Kelang);
c. Marine Department Sarawak Region (Kuching);
d. Marine Department Sabah Region (Kota Kinabalu);
e. Marine Department Federal Territory of Labuan (Labuan) – MISR.

5. FEE SCHEDULE

a. Certificate of Survey (COS) – RM 100.00.


b. Carving & Marking Note – RM 30.00.
c. An annual tonnage fee of RM 0.30 per gross tonnage is compulsory for ships registered
under MISR.

6.1 Application For Provisional Registration

The applicant must submit an application to the Registrar of Ships Office where the ship is
registered and must be accompanied by the following documents :

a. Certificate of Approved Name (COAN).


b. Certificate of Survey (COS) – issued by Surveyor of Ship.
c. Application To Register A Ship form (M265/BPK/06-2019).
d. Application For Allotment Of An International Call Sign form (M253/BPK/07-2019).
e. Appointment / Cancellation / Change Of Ship Manager form (DK/BPK/03-2019).
f. Declaration Of Ownership And Nationality (M240/BPK/01-2019 (Rev.01)).
g. Original and a certified true copy – Identification Card / Passport; OR
h. Original and a certified true copy – Certificate of Incorporation.
i. Original – Memorandum of Agreement; OR
j. Original – Sale Purchase of Agreement; OR
k. Original – Bill of Sale; OR
l. Original – Builder’s Certificate.
m. Original – Deletion Certificate (if previously registered under foreign flag).

AND

If company register under Suruhanjaya Syarikat Malaysia (SSM) :

n. Memorandum and Article of Association.


o. Return of Allotment of Share (Form 24).
p. Return of Directors, Managers and Secretaries and Changes of Particulars (Form 49).

6.2 Application For Permanent Registration

The applicant must submit an application to the Registrar of Ships Office where the ship is
registered and must be accompanied by the following documents :

a. Original – Bill of Sale or Builder’s Certificate (if issued by foreign flag must be
certified by Notary Public).
b. Original – Deletion Certificate (if ever registered under foreign flag).
c. Carving & Marking report.
d. Certified true copy – International Tonnage Certificate 1969.

6.3 Application For Extend Provisional Registration Validity

The applicant must submit an application to the Registrar of Ships Office where the ship is
registered and must be accompanied by the following documents :

a. Application letter.
b. Original – Ship Registration Certificate (Provisional).

6.4 Application For Deletion Registration

The applicant must submit an application to the Registrar of Ships Office where the ship is
registered and must be accompanied by the following documents :

a. Application letter.
b. Original – Ship Registration Certificate.
c. Bill of Sale (if it involves Sales and Purchase).
d. Discharged of Mortgage with letter from bank (Mortgagor) or licensed financial
institutions (if there is a mortgage).

7. CLIENTS CHARTER

Process and issue a Certificate of Registration (Provisional), Certificate of Registration


(Permanent), extend registration validity and Deletion Certificate within 3 working days after
the complete application is received.

The Marine Department Malaysia will review the information submitted, however it is the
responsibility of the ship owner to ensure that all the information stated in the application form is
accurate. Any inaccurate information will cause delays in the application process.
