Projects Pvt. Ltd., Hyderabad, vide Letter No. D-1/522/2017 dated 04.03.2017 EPC mode.
The Contract Agreement has been signed between M/s. SRK Construction & Projects Pvt.
Ltd., Hyderabad and the Chief Engineer National Highway (P.W.) Navi Mumbai on 14.02.2017
with Contract price of Rs. 283.51 Cr. Further Appointed date has been declared as
04.03.2017.

Scheduled Completion Date, the Contractor shall have ‘Achieved
completed construction in accordance with this
Agreement.
The intended date for achievement of Project Milestone |, II & Ill as per Schedule J was
30.08.2017, 26.02.2018 & 27.08.2018 respectively. However, the contractor could not achieve
the set forth milestone due to delay in Shifting of Utilities, Tree Cutting, COVID- 19 pandemic,
land acquisition etc. The Progress of Work is slow due to COVID-19, 1%, 2" & 3 wave. Despite
COVID-19 1%, 24 & 3° wave the contractor has done 82% physical progress of amount Rs. 232.6
Cr till November 2022.
5.Contractor’s Plea:
Vide Letter No. SRK/CWRP/A/NH-353E/2022/102, Dated 13.12.2022 above, EPC Contractor
has submitted proposal for EOT-IV of subjected work. Contractor has requested for extension
of time for 274 days due to OCCURRENCE OF FORCE MAJEURE EVENT of COVID-19.
6.Review of EOT Proposal:
i, The Authority had approved EOT-I of 484 days i.e. up to 30.06.2020 vide reference letter
no. 02 in the base of project length affected by the ECO Sensitive Zone & Social Forest,
Delay in Tree Felling, Utility Shifting (Water Pipe Line & Electrical), Delay in Land
Acquisition in realignment portion and also work stopped due to during Assembly Election.
fi, Authority had approved 2" EOT from 30.06.2020 to 31.12.2020 (Six Months) vide
reference letter no. 03 due to the first wave of Covid-19. The EPC contractor was willing to
complete the project in extended period but due to unexpected event of COVID -19 1%
wave, work had been hampered badly, more than 60% of abours and staff were infected
with COVID positive, so most of the labours and staff of the EPC contractor left the site
unexpectedly, Contractor face many crises like, non-liquidity of funds and staff who left at
site owing to scare from the Covid-19 pandemic. In pandemic most of the staff left the site
due to restrictions imposed by Government, despite during that period contractor work with
few workers continued and achieve the progress 7.63% of work amounting of Rs. 21.64 cr.
from March’ 2020 to Dec.’ 2020.
ifi, After that Authority had approved 3 EOT from 01.01.2021 to 30.06.2022 (Eighteen
\Months) vide reference letter no. 04 due to 2° Wave of Covid-19 pandemic, started in March
2021. During 2° Wave of Covid-19, most of the staff scared and again left the site due to
affected by the Covid-19 2 wave. In 2" wave of covid-19, EPC contractor continued the
work with few workers and achieves 11.86% progress of work amounting Rs. 33.62 cr. from
January 2021 to September’ 2021.
iv. After the 2nd wave pandemic, 3rd wave hit India so drastically as 1st & 2nd wave of
Covid-19, the new cases has increased exponentially since mid of January 2022 to till March
2022. Nearly all states of India are showing an upward trend with a rise in test positivity
rate (TPR). Most the staffs got scared again and started to leave the site. Again, EPC
Contractor was unable to continue the work in a smooth way. However, EPC Contractor
have achieved about 17.5% physical progress of amounting Rs. 49.31 Cr. from October 2021
to June’ 2022.
v. Further EOT-IV was granted from 01.07.2022 to 31.10.2022 due to COVID-19 vide letter
no. 2345 / Tender /2022-23, on dated 26.09.2022. In this period EPC Contractor have
achieved about 4% physical progress of amounting Rs. 11 Cr. from July’ 2022 to October
2022, despite serious illness of EPC Contractor Managing Director Mr. S. Ravi Kumar.
Despite COVID-19 pandemic, the EPC contractor has achieved about 43% of work
particularly from COVID-19 1% wave to till date and over all progress of 82% has been
achieved till date.
Now the EPC contractor is about to achieve the last Milestone-IV (100% of work),
therefore it is advisable to consider extension of time.
EE’s Conclusion:
The proposal submitted by EPC Contractor under 10.5 has been considered. The
contractor has submitted undertaking in form of supplementary agreement that he will not
claim any extra amount in form of delay damages on account of idle men and machinary and
other resources mobilized at project site or on any other account due to shifting of
milestones price adjustment of contract agreement payable in respect of the stage
payments certificates till the approved extension of time. In this particular work, issue of
tree cutting due to work vicinity in Tadoba Tiger reseve and social forest issues delayed in
providing hindrance free ROW to Contractor. There have been certain land disputes during
the construction of structures due to which the work was struck up. Also, there is a
stoppage in supply of murum due to NGT dated since 31.01.2022. Also contracting firm had
informed that their Managing Director, Mr.S. Ravi Kumar has been indisposed due to cancer
and this has resulted in breakdown of flow of financial decision. Thus, casting adverse effect
on progress of work. Mr. Ravi Kumar unfortunately died and now his successor has again
started the work which will be completed by 31.03.2023. Considering these facts, the
extension of time limit up to 31-03-2023 as submitted in work program by the contractor.Revised milestone details:
