Under instruction of my client, Ms. Vinita Choudhary, Add: 64, Sunder Nivas, opp.
God Bhraman samaj, Marwar junction, Rajasthan- 306401, we, representing the limited legal
rights, as Advocates, have to address you the legal notice under consumer protection act for
poor internet service-
 You are the proprietor of the Softnet Netsol company. Softnet Netsol is the internet
service provider company based on above mentioned address. My client states that
she has been using your broadband service since 01.05.2022 vide account no
BB0007740729 with the registered mobile number 8432031852. On 28.04.2022 she
paid the said consideration of Rs. 6500 for UL B10 60 Mbps 12M plan of 60 Mbps
speed. My client came across the advertisement on Instagram on April 2022 which
claimed 60 Mbps speed @423/month.

 My client on seeing such a good plan inquired about the same by going to your main
office and agreed for the aforementioned plan only when my client was assured that
she will be provided 60Mbps speed and in case of any inconvenience they will look
after it. You promised 60Mbps speed which after a few weeks was never delivered to
my client till the date of sending this notice. The issues related to speed were brought
into your notice through mail and your mobile application. My client till date has
filed 10 complaints but the customer service replied that there is no need to lodge any
complaint. There are some technical issues which will be resolved within 2 to 3 days
but it never happened. You have failed to take necessary measures to look after the
complaint filed by my client.

 My client has not received the speed she was promised even after filing many
complaints. It is your duty to provide uninterrupted internet service which you failed
to provide or refused to provide. On 07.06.2022 when my client went through your
mobile application to file a complaint there was no option to raise a complaint. That
your act of closing the complaints and not giving an option to our client to raise a
complaint clearly shows the intention that you want to cheat my client as whenever
you're helpline contacted they said that there is no need to register any complaint as
there is some technical issue and internet connection would be resolved soon. Such
replies were vague and were made with the intention of cheating my client.

 You have committed deficiency in service since my client took the connection on the
aforementioned date, that you have failed or refused to provide the promised speed
and also failed to provide uninterrupted service to my client. The 60Mbps speed
promised by you was not served and later on 15.06.2022 the speed was reduced to 1
Mbps, the screenshot of which has been mailed on your registered email id
[email protected]. It was promised after filing the complaint they would resolve the
issue within 24 to 48 hours but as always there was no solution provided to my client
instead the speed was reduced to 0.08 Mbps where normal surfing was also not
possible.

 Through the advertisement you have deceived and cheated my client. That my client
wanted an amicable and peaceful resolution for which my client had requested your
numerous times to resolve the issue but you have failed or refused to provide the
promised speed and an efficient service to our client which has led to harm and
mental agony to my client.

 However, I believe that good sense will prevail upon you and you will try to avoid
the cost and hazards of litigation which may be an unwarranted litigation in
circumstances of the case. Also, the reputation of your broadband service will be
spoiled. It's better that you resolve my client issue within a week so that you don't
have to face any legal consequences or my client is willing for a refund of the full
amount that is Rs. 6500 and Rs. 4000 for mental agony that you have caused to my
client by your deficient service to my client.
