SUBJECT : Spot Report on Alleged Rape Incident

Reference: Blotter entry # 2001, page 802 dated August 30, 2017

1. At on or about 2300H of August 30, 2017, PAT Shella Marie C. David


received a report about a rape case at Ma. Jesusa Subd, Brgy Pooc Binan
City Laguna.

2. PAT Shella Marie C. David together with the team led by PSMS Thelma
Bagang and PCpl Bianca David WCPD PNCO left the police station and
went to verify the report and conduct an investigation.

3. Initial Investigation disclosed that at on or about 2000H of August 30, 2017


in Sta. Filomena Public Cemetery, MAISSY SOBRECASAY, victim, 14
years old, grade 7 student was raped by 8 suspects namely MARK
ANTHONY CAPINA y NADAL, BENJIE CORNEJO y MUMAR, RONNIE
LAUREOLA, VICTORINO HORNILLAS, WILFREDO HICANA,
LAWRENCE DESA, MCBOY CERVANTES and alias PAOPAO. The
victim went to a birthday party and was given an alcohol drink that caused
her to feel dizzy and to pass out. She woke up and passed out several
times and, in those times when she regained consciousness, she had
seen Mark Capina on top of her body and Benjie Cornejo on top of her
head. She begged the suspects to let her go home but the suspects said
to have one more sexual intercourse with the then birthday boy Mark
Capinay. The victim then again passed out and regained consciousness
and saw one of the suspects taking a video of her being raped.
4. The victim would have been transported to another location by Ronnie
Laureola for the other suspects when she regained awareness beside him
in a nipa hut but she was able to fought back and ran away.

5. According to CHRISTIAN, witness, the suspects planned the rape and


had used Marijuana. ANDREW, a witness and the care taker of the
cemetery stated that he had not seen anyone coming in the cemetery
because the cemetery gates was locked but he noticed the metal barriers
on the wall broken. He said that the suspects had likely destroyed it to
come inside the cemetery.

6. Currently, Mark Capinay and Benjie Cornejo are in the custody of Binan
City Police Station. The remaining six suspects are at large.

7. Progress report will follow.
