Affidavit of Possession of Title

AFFIDAVIT OF POSSESSION OF TITLE

I, FLORENDO B. NARAG, of legal age, married to JOSEPHINE D. NARAG and a


resident of 27 Maguigad St., Atulayan Sur, Tuguegarao City, after having been duly sworn
in accordance with law hereby depose and state - THAT;

1. On June 14, 2021, I and Martina T. Nadal entered into a Real Estate Mortgage
Contract whereby she borrowed a sum of money by way of loan from me in the total
amount of One Million Five Hundred Thousand (Php1,500,000.00) Philippine
Currency and as security for the said amount, Martina Nadal surrendered the
owner’s duplicate copy of Transfer Certificate of Title No. T-130159 registered under
the name of Romeo B. Valdepeñas including other pertinent documents related to
the said lot; in which she is now the absolute owner;

2. After perusal of the pertinent documents endorsed by Martina T. Nadal to me, I


noticed that the registered owner and Martina Nadal entered into a Deed of
Conditional Sale of House and Lot and an Acknowledgment Receipt for the
remaining balance of the aforementioned sale was being executed, however, said
parties did not enter into a Deed of Absolute Sale even after full payment of
consideration:

3. The Real Estate Mortgage Contract we entered into last June 14, 2021 already expired
but Martina T. Nadal failed to pay her obligation based on the said contract even
after we had given her extensions to fulfill her obligation;

4. In order to protect my interest, I need to execute such affidavit with the primary
purpose of preventing any malicious and illegal transactions of any interested
person particularly the execution and annotation of Affidavit of Loss claiming that
the physical title of the subject parcel of land as lost and/or destroyed.

IN WITNESS WHEREOF, I have hereunto set my hands this 15th day of September


2022 in Tuguegarao City, Cagayan, Philippines.
