Your Affiant has received numerous investigative related trainings, including Advanced Report Writing, Case Preparation and Courtroom Presentation, Field Training Officer, Introduction to General Investigations, Interviews and Interrogations, and several other courses. Furthermore, your Affiant has been involved in numerous investigations resulting in search warrants, Your Affiant, in her professional capacity, is the Lead Investigator assigned to MDPD Case number PD230601183473, in the investigation of the facts and circumstances surrounding the attempted murder investigation of [I :reinafer referred (o as “The Victim,” and in doing so has found the following information to be true to the best of her knowledge and belief. Because this Affidavit is being submitted for the limited purpose of establishing probable cause, your Affiant has not included every aspeet, fact, or detail of this investigation. Affiant On Monday, May 29, 2023, at approximately 12:17 p.m., the City of Homestead Police Department (HPD) uniform officers, along with Miami-Dade Fire Rescue (MDFR) personnel, were dispatched to a ShotSpotter alert call at 528 NW 3 Avenue, Homestead, Florida 33030. While HPD units were enroute, their police dispatch received a 911 call for service advising of an unknown white male, later identified as “The Victim,” suffering from a Gunshot Wound (GSW) to his head. Upon the emergency units’ arrival at the scene, they discovered “The Victim” lying on the ground, unresponsive, bleeding from his head in the front yard/driveway of the aforementioned residence. Subsequently, MDFR Air South transported “The Victim” to Ryder Trauma Center at Jackson South, located at 9333 SW 152 Street, Miami, Florida 33157. ‘The incident was documented under HPD case number: 23-033049. While at the hospital, “The Victim” was stabilized and transferred to the Intensive Care Unit (ICU). The medical staff advised law enforcement that “The Victim” was in critical condition and he was placed on life support. On Thursday, June 1, 2023, DETECTIVE DAVID MATA, Badge #331, of the HPD General Investigation Unit (GIU), contacted Jackson South’s medical staff to obtain an update on “The Victim's” condition. The medical staff advised him that “The Victim’s” family decided that they would sign a Do Not Resuscitate (DNR) order, and that they will be disconnecting “The Victim” from all life supporting instruments in the coming days, but he would remain on life support pending organ procurement. Next, HPD DETECTIVE MATA contacted MDPD Homicide Bureau and notified investigators about the on-going investigation. Subsequently, DETECTIVE MATA responded to the MDPD Homicide Bureau, located at 9105 NW 25 Street, Doral, Florida 33172, and met with “Your Affiant,” who ultimately assumed the lead role into the investigation. HPD DETECTIVE MATA conducted a briefing and informed “Your Affiant” that this case was documented under HPD case number: 23-033049, and during his investigation he earned the following: On Monday, May 29, 2023, at approximately 12:17 p.m., the City of Homestead Police Department (HPD) uniform officers, along’ with Miami-Dade Fire Rescue (MDFR) personnel, were dispatched to a ShotSpotter alert call at 528 NW 3 Avenue, Homestead, Florida 33030, While HPD units were enroute, their police dispatch received a 911 call for service advising of an unknown white male, later identified as “The Victim,” suffering from a GSW to his head. Upon the emergency units’ arrival at the scene, they discovered “The Victim” lying on the ground, unresponsive, bleeding from his head in the front yard/driveway of the aforementioned residence. Subsequently, MDFR Air South transported “The Victim” to Ryder Trauma Center at Jackson South, located at 9333 SW 152 Street, Miami, Florida 33157. During the 33030, hereinafter referred to as I stated that while “The Victim” was standing outside in the front yard of the residence, he was sitting in the driver seat of his vehicle, which was parked in the driveway of the residence, listening to music J Homestead, Florida 33030, hereinafter referred to fF stated that IE cquesied him to go inside of the residence and {i HR exited the vehicle and went inside the residence. MM furcher stated, moments later he heard multiple gunshots being discharged, in a fully automatic Affiant refed (02 RRR ses MI «i¢-< is vehicle and ran towards “The Victim.” Upon approaching “The Victim,” he observed him lying on the ground, unresponsive, and bleeding fiom a GSW to his head, IEEE then applied pressure on “the Victim's” GSW until emergency personnel arrived. IEEE stated that he and his family are part of a group called “La Familia” and that they have been having issues with members from “4" Street” gang. Hee that the issues have stemmed from previous shootings and homicides. I stated that members of “4 Street” killed approximately a year ago and that they also killed [MM on Saturday, May 27, 2023, documented under MDPD case number: PD230527176977. At that tim During the course of the investigation, HPD DETECTIVE MATA reviewed video surveillance footage from several houses in the area. A Ring Deorbell surveillance footage from “The Vietim’s” next door neighbor revealed that prior to the shooting, a newer model red in color Honda Accord that was equipped with distinct black/silver-colored rims and dark tinted windows, was casing the area, while “The Victim” was outside of his residence. Hereinafter, the red Honda Accord shall be referred to as, “Subject Vehicle.” Further review of the video depicted an unknown subject, hereinafter referred to as “Subject #1,” who was clad in a black ‘mask covering his face/head, a black zippered hoodie sweater, a white ‘T-shirt, black pants, and black shoes. “Subject #1” walked towards “The Victim’s” residence in a northbound direction Subject #1° stopped in front of 512 NW 3 situated just south of “The Victim’ ‘on NW 3 Avenue from 4 Street. Subsequently Avenue, Homestead, Florida 33030, whi residence and discharged multiple .40 caliber rounds from a fully automatic handgun towards “The Victim.” After the first volley of shots, when “Subj t #1” observed that “The Victim” collapsed onto the ground, “Subject #1” began running southbound on NW 3 Avenue towards NW 4 Street. Shortly thereafter, “Subject #1” (out of camera view) discharged the second volley of 40 caliber rounds from a fully automatic handgun, “Subject #1” continued to flee the scene on foot. Affiant An arca canvass was conducted following “Subject #1’s” direction of travel prior to and after the shooting and additional surveillance cameras were obtained and reviewed. Prior to the shooting, the additional video surveillance footage revealed the following: The “Subject Vehicle” was seen waveling westbound on NW 6 Street passing “The Victim's” residence, while “The Victim” was standing in the front yard, Later the “Subject Vehicle” was then seen traveling westbound on NW 4 Street toward NW 4 Avenue. Upon passing the intersection’s stop sign, the “Subject Vehicle” suddenly stopped west of the said avenue. “Subject #1” was then seen exiting the “Subject Vehicle” via the passenger side door. When “Subject #1” began walking eastbound on NW 4 Street towards NW 3 Avenue, the “Subject Vehicle” continued traveling westbound on NW 4 Street. After the shooting, additional video surveillance footage revealed the following: “Subject #1” is seen running eastbound on NW 4 Street from NW 4 Avenue. Video surveillance footage from VIP Towing, located at 322 NW 9 Terrace, Homestead, Florida 33030, then depicts “Subject #1” running on NW 4 Street, and finally entering [i Homestead, Florida, hereinafter reve red fo as “The Premises.” Further investigation into “The Premises” revealed that it is a known residence where “dth Street” gang members socialize. On Saturday, June 3, 2023, hoa icide investigators located and interviewed two (2) witnesses, hereinafter referred to as “Witness #1” and “Witness #2," who have been properly identified, but whose identities will teroporarily remain confidential due to their safety “Witness #1” provided a sworn statement advising that on Sunday, May 28, 2023, during the evening, he was at [EEE Homestead, Florida, hanging out at his friend's house. While ut this residence, a friend of his, whom he has known for over 10 year a PM i ics west naive Upon hs arrival, “Subject #1” stated that he was going to shoot and kill “The Victim.” “Subject #1” left the residence but returned shortly afier and advised that he could not complete the task because “The Victim” was not outside. “Witness #1” later left the residence, On Monday, May 29, 2023, “Witness f1” returned to his friend’s residence at [I HEB Homestead, Florida in the evening. While at the residence, “Subject #1” also returned and im,” “Witness #1” gave “Witness #1” confirmation that he had successfully shot the “The Vi confirmed that “Subject #1” is a known associate of “4th Street Gang,” and is known to carry a arm, and has seen “Subject #1” in the past with a firearm, ‘On Tuesday, May 30, 2023, “Witness #1” explained that “Subject #1” asked him to help ”, it should be noted that a Glock 23 is a 40 caliber firearm and him sell a “Glock 23 ghost gun the casings recovered on the scene were 40 caliber. Furthermore, this information was confirmed from a conversation seen from “Witness #1’s” Instagram social media account where “Subject #1” sent a ditect message to another person asking if they wanted to purchase the firearm, “Witness #1” advis that this is most likely the firearm that “Subject #1” utilized during the shooting. After interviewing “Witne #1,” homicide investigators interviewed “Witness #2.” “Witness #2” stated that he was also at [EEE Homestead, Florida, op Sunday, May 28, 2023, when “Subject #1” azived. “Witness #2” advised that “Subject #1” stated he was going to “get back TIN rcferring to “The Victim.” “Witness #2" then observed “Subject #1” leave the residence but they fell asleep, so they were unsure if “Subject #1” ever returned to the residence later that day. “Witness #2” stated they have known “Subject #1” for a few years, “Witness #2” stated that “Subject #1” is known to carry either a Glock 23 or a Glock 27, but the firearm is a .40 caliber, On Monday, May 29, 2023, “Witness #2” advised that sometime during midday, “Subject #1” arrived at his house wearing a black hoodie, dark pants and a black mask. “Subject #1” was out of breath, as if he had just finished running. “Subject #1” then stated, “I gotta go! I gotta get 7) outta here!” A red Honda sedan then arrived in front of Homestead, Florida, picked up “Subject #1,” and then fled east advised that “Subject 41” is good fiends witha male named I 0 esis at ' 10 estead, Florida, and drives fs On Saturday, June 3, 202 che victim was pronounced deceased at 3:05 p.m, The victim’s body was transported to the Miami-Dade Medical Examiner's for a post-mortem examination (ME. Case Number: 2023-01711). On Sunday, June 4, 2023, homicide investigators also met with FY ER sc tat sometime ducing the week after the shooting ocourred, “Subject #1” arrived at his residence of (IIIB orida city, Florida, grabbed some clothing and left the residence without advising where he w going. This was odd and out of his character because this is where they reside together. [BEEP scvised “Subject #1” does not have a cellular device or social media and she has not been able to contact him, / only communicates with “Subject #1” when he arrives at the residence in person On Sunday, June 4, 2023, search warrants were obtained and executed at HE onestead, Floride, ED vomestead, Ploride, ond Florida City, Florida, in an attempt to iocate evidence of the ongoing investigation, It should be noted that “ subject #1” was not at any of the three residences ané none of his associates know of his whereabouts as he is potentially fleeing and hiding from law enforcement, On Tuesday, June 5, 2023, Miami-Dade County Chief Medical Examiner, Dr. Kenneth Hutchins, conducted an autopsy of the victim. At the conclusion of the autopsy, Dr. Hutchins determined the victim’s cause of death to be a gunshot wound to the head and classified the manner of death as a homicide WHEREFORE, your Affiant requests an Arrest Warrant be issued for Monico Enrique Galban, W/M/19, DOB: 19/45/2003, ior one (1) count violation of Florida State Statute ta) Affiant Judge 782.04(1)(a)1_ 1% Degree Murder, and one (1) count violation of Florida State Statute 790.16 Discharging Machine Gun, which each constitute a felony of the first degree.
