Nos: (632) 8924-6031 to 35 | Fax: (632) 8924-0109, (632) 8920-4417 Website:https/domb.govph | E-mall Address: bmbebmbgov.ph \\e MAY 10 2022 BMB Technical Bulletin No. 2022- 02 SUBJECT: GUIDE IN MAINSTREAMING THE INTEGRATED COASTAL MANAGEMENT (ICM) APPROACH TO THE LOCAL GOVERNMENT UNITS’ COMPREHENSIVE LAND USE PLAN (CLUP) Pursuant to DAO 2016-26, EO 533 and in order to ensure the mainstreaming of ICM approach into the CLUP and sustainable development of the country’s coastal and marine environment, this Technical Bulletin is hereby issued for the information of all NY concemed. \ Section 1. Basic Policy Itis the policy of the state to ensure the sustainable management of the country’s coastal and marine environment and resources by looking at the interconnectivity of ecosystems from the upland to the coastal and marine areas in order to promote the right to a healthful and balanced ecology in accord with the rhythm and harmony of nature. ‘Towards this end, it shall adopt integrated coastal management, hereinafter referred to as ICM, as a framework in regulating different human activities and ensuring a multi- stakeholder and -ridge-to-reef approach to ecosystem management, with due consideration to ecological connectivity and their impact on social and ecological systems. Section 2. Objective This Technical Bulletin shall guide the DENR Field Offices in extending Technical Assistance to the LGUs in mainstreaming ICM into the Department of Human Settlements and Urban Developments’ (DHSUD’s) 12-step CLUP development planning process. Section 3. Scope and Limitations The Technical Assistance to be extended by the DENR Field Offices under this TB shall be initially implemented in LGUs with river systems influencing NIPAS Marine Protected Areas and other conservation areas, as part of the DAO 2016-26. This will eventually be implemented nationwide following a set of considerations in prioritization to be identified in the preparatory phase outlined in Section 7. Wy REN wT RESTORATION wT maa e1r WD It is implied that the updating of the CLUP is LGU-led, and that the DENR Field offices will provide specific assistance consistent with their mandate, e.g., mapping, resource assessment, profiling, capacity building as outlined in Section 5 of this Technical Bulletin. Section 4. Definition of Terms For the purpose of this TB, the following definition of terms shall be used: Adaptation refers to the adjustment in natural or human systems in response to actual ot expected climatic stimuli or their effects, which moderates harm or exploits beneficial opportunities. Biological Diversity or Biodiversity refers to the variability among living organisms from all sources including, inter alia, terrestrial, marine, and other aquatic ecosystems and the ecological complexes of which they are part. Biodiversity consists of a variety of species, their genetic make-up, and the habitats to which they belong, Climate Change refers to changes in the mean and/or variability of climate properties that persist for an extended period typically decades or longer, whether due to natural variability or as a result of human activity. Coastal Area or Zone refers to a band of dry land and adjacent ocean space (water and ‘submerged land) in which terrestrial processes and uses directly affect oceanic processes and uses, and vice versa; its geographic extent may include areas within a landmark limit of one (1) kilometer from the shoreline at high tide to include mangrove swamps, brackish water ponds, nipa swamps, estuarine rivers, sandy beaches and other areas within a seaward limit of 200 meters isobath to include coral reefs, algal flats, seagrass beds and other soft-bottom areas. Comprehensive Land Use Plan (CLUP) refers to the document formulated by the cities and municipalities in consultation with its stakeholders, that defines or provides guidelines on the allocation, utilization, development and management of all lands within a given territory or jurisdiction accprding to the inherent qualities of the land itself and supportive economic, demographic, socio-cultural and environmental objectives as defined in Republic Act (RA) No. 11201, otherwise known as the “Department of Human Settlements and Urban Development Act” Ecosystems Services refer to the benefits people obtain from the ecosystems such as: provisioning which refers to the services that provide food, water, timber, and fiber; b. regulating which refers to the services that affect climate, floods, disease, wastes, and water quality; ¢. cultural which refers to the services that provide recreational, aesthetic, and spiritual benefits; and d. supporting which refers to the essential services such as soil formation, photosynthesis, and nutrient cycling. Integrated Coastal Management refers to the ridge-to-reef approach and natural resource and environmental ecosystem-based management framework which employs an integrative, holistic management approach and an interactive planning process in addressing the complex management issues of the coastal and marine areas, and the major goal of which is to attain sustainable coastal development, including the maintenance of the functional integrity of ecosystems through effective coastal and ‘ocean governance. Integrated Coastal Management Plan is a'plan formulated by the Local Government Units through the help of the DENR to holistically manage their resources. Reflected in the plan are the environmental resources present in the LGU such as but not limited to coral reef, mangroves, seagrass and others. The mitigation, conservation, protection and management are also embedded in the plan. : Interconnectivity- refers to the physical, socio-economic, and ecological linking of Protected areas, production areas, settlements development, and infrastructure development policy areas within a watershed. Legislated Marine Protected Areas- are marine areas established by Congressional legislation. Mainstreaming in CLUP- means extracting, summarizing, and synthesizing the elements of Integrated Coastal Management in the DHSUD’s 12-Step CLUP development process. ‘Marine areas - means the foreshore, seabed, and coastal water, and the airspace above the water: a) of which the seaward boundary is the outer limits of the territorial sea: b) of which the landward boundary is the line of mean highwater springs, except that where that line crosses a river, the landward boundary at that point shall be whichever is the lesser of, Municipal waters refer not only to streams, lakes, inland bodies of water, and tidal waters within the municipality which are not included within the protected dreas as defined under RA No. 11038 otherwise known as the “Expanded National Integrated Protected Areas System Act of 2018” (ENIPAS), public forest, timber lands, forest reserves, or fishery reserves, but also marine waters included between two (2) lines drawn perpendicular to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and a third line parallel with the general coastline including offshore islands and fifteen (15) kilometers from such coastline. Where two (2) municipalities are situated on opposite shores and with less than thirty 30) kilometers of marine waters between them, the third line shall be equally distant from the opposite shore of the respective municipalities. Other Effective Area-based Conservation Measures (OECM) - a geographically defined area other than a Protected Area, which is governed and managed in ways that achieve positive and sustained long-term outcomes for the in-situ conservation of biodiversity with associated ecosystem functions and services and where applicable, ‘cultural, spiritual, socio-economic, and other locally relevant values. State of the Coasts reporting system refers to an assessment tool for LGUs to be used in measuring the progress and benefits of ICM implementation. It allows the LGUs to document and measure the effectiveness and impacts of policy and management interventions in support of sustainable coastal development and evaluate progress towards local, national, and international targets for sustainable development. Watershed refers to a land area drained by a stream or fixed body of water and its ‘tributaries having a common outlet for surface run-off. Its a topographically delineated area of landform which rainwater can drain as surface run-off, via a specific stream or river system to a common outlet point. Zoning is the division of a city/municipality into zones or sub-zones (e.g. commercial, residential, industrial, institutional, agricultural, forest, ete.) according to present and Potential uses of land to maximize, regulate and direct their use and development in accordance with the Comprehensive Land Use Plan. It takes the form of a locally enacted ordinance which provides, among others, regulations affecting uses allowed or disallowed in each zone or sub-zone, conditions for allowing them, and procedures on evaluating deviations. Section 5. ICM Mainstreaming Process into the Comprehensive Land Use Plan (cur) 3 This section elaborates the phases of mainstreaming the ICM Approach into the CLUP. Each level has a set of activities to be undertaken with corresponding means of verification which is vital in monitoring the progress of mai ing. 5.1. Inception Phase. This phase entails the preparatory works and activities ‘in Mainstreaming the ICM approach to CLUP, and prioritization of LGUs for pilot-testing. The Inception Phase is centered on the creation of an enabling mechanism with the Local Government Unit. During this Phase, the following activities must be undertaken within the span of one (1) year period. 1. Creation of DENR Regional Composite Team with clear-cut tasks and outputs; ‘MOV: Special Order on the creation of DENR Composite team signed by the RED 2. Mapping of river systems influencing to NIPAS-MPAs with LGU coverage; MOY: Maps of river systems influencing the NIPAS MPA 3. Status of the LGU’s Comprehensive Development Plan (CDP), Comprehensive Land Use Plan (CLUP), and Integrated Coastal Management Plan (ICMP) (i.e. adopted, for updating, draft); ‘MOY: Filled-out form on the status of the LGUs" CLUP, CDP and ICM Plan 4.Ground validation of inventoried river systems to identify key threats and issues and ENR Profiling; ‘MOV: Ground-truthed maps and filled-out ENR profile form. 5. Notify the LGU on the result of the Inception Phase; MOY: Letter to the Chief Executive of the LGU containing the findings and recommendations. 6. Identification of LGU to be prioritized for ICM mainstreaming following these criteria: Number of river systems and severity of consequences of threats 4and challenges. Prioritize LGUs that have more river systems influencing the PA and the urgency to address the threats/challenges, ‘Status of ICM plan, Prioritize LGUs that have updated, adopted and implemented ICM plans. Status of CLUP. Prioritize LGUs that have outdated CLUP or are currently updating their plans. LGU Partnership. Prioritize LGUs that have ‘strong linkage and partnership with DENR Region and development partners. In addition, prioritize LGUs that have MENRO/City ENRO Availability and accessibility of data. Prioritize LGUs that have ‘maintained and updated databases. MOV: Memorandum to the BMB Director containing the name of LGU to be prioritized based on the criteria for prioritization. 5.2. Mainstreaming Phase. This phase provides the specific technical assistance to be given by the DENR Field Offices following the 12-step CLUP development process as outlined in Volume 2 of the CLUP Guide Books. Sustained phase. The following criteria is required to categorize that the CLUP of LGU is already ICM-responsive, to wit: 1. Legal basis adopting the updated CLUP with ICM elements; 2. A Monitoring and Evaluation Plan developed by the LGU to assess the effectiveness of identified ICM-related strategies outlined in the CLUP; 3. State of the Coast report of the LGU submitted to the DENR 4. Documented ICM best practices using any format and/or platform available (Le. print, digital media) Regular updating of the ICM-responsive CLUP; and 6. Replication of the process df mainstreaming to the adjacent LGUs. Section 6. _ Implementation Arrangements. The implementation of this TB covers the process of mainstreaming the ICM Approach into the CLUP. This requires multi- coordination among DENR, LGUs and other concerned agencies/institutions. The implementation of the ICM- responsive CLUP shall be the mandate of the Local Government Units per Local Government Code 1991. In order to provide coordinated, efficient, and effective implementation of this TB, the CENRO, PENRO, Regional Offices, and the BMB shall have the following roles and responsibilities: 1. Be actively involved as a member of the LGU’s Planning team responsible in the formulation and updating of the CLUP; 2. Provide technical assistance to the identified and prioritized ‘municipality/city governing bodies (See Section 5 for the TA, and Section 7 for the considerations for prioritization); 3. Monitor the progress of TAs in the mainstreaming of ICM and provide progress reports with recommendation; 4. Provide capacity development support in LGU in the mainstreaming of ICM, contingent on trainings and capacity needs assessment by the DENR BMB; 5. Submit to PENRO bi-annual progress report with action taken and recommendations; and 6. Provide close coordination with the counterpart concemed agencies/institutions and LGU’s M/CPDC 6.2 PENRO 1. Provide technical assistance to the CENRO in mainstreaming ICM to the LGUs’ CLUP; 2. Provide capacity development support to CENRO in the mainstreaming of ICM, contingent on trainings and capacity needs assessment by the DENR BMB; Monitor and evaluate reports submitted by the CENRO and provide recommendations; Consolidate CENRO reports with actions taken and recommendations, and submit to RO bi-annuab progress report; and Be actively involved as a member of Provincial Land Use Committee (PLUC). 6.3 Regional Office (RO) 1 2 Provide technical advice to the CENROs and PENROs in mainstreaming ICM to the LGUs’ CLUP; Provide capacity development support to CENROs and PENROs in the mainstreaming of ICM to LGUs’ CLUP contingent on trainings and capacity needs assessment by the DENR BMB; ‘Monitor and evaluate reports submitted by the PENROs; Consolidate PENRO reports and submission to BMB of bi-annual progress report on the status/progress of mainstreaming ICM; Analyze and process consolidated reports from the PENRO and provide recommendations from the consolidated reports; and Be actively involved as a member of the Regional Land Use Committee (RLUC). 6.4 Biodiversity Management Bureau (BMB) 1; 2 Section 7. Provide guidance to the Field Offices in mainstreaming ICM to the LGUs’ CLUP; Conduct trainings and capacity needs assessment for the DENR Field Staff, and provide capacity development programs on the mainstreaming of ICM to LGUs’ CLUP; Enhance ICM database networked to the CMEMP and BMB database; Monitor and evaluate the consolidated reports submitted by the ROs and provide analysis and recommendations; and Submit Annual National Progress Report to the Secretary of DENR in mainstreaming ICM to LGUs CLUP. Monitoring and Assessment ‘The BMB shall monitor and assess the phases of progress of the ICM Mainstreaming into the CLUP by the DENR Field offices based on the activities and its means of verification provided in each phase in Section 5. The monitoring tool is attached as Annex 3 to guide all concerned DENR Offices. Section 8. Funding ‘The DENR BMB and Field Offices shall allocate necessary funding to support the execution of this TB under the DAO 2016-26. Section 9. Separability Clause If any provisions of this TB shall be held invalid or unconstitutional, the other Portions or provisions hereof which are not affected shall continue in full force and effect. Regular updating of the ICM-responsive CLUP; and 6. Replication of the process of mainstreaming to the adjacent LGUs.
