WORK PLACEMENT AGREEMENT
This agreement must be present at the address where the work placement is completed.
The Work Placement Provider is responsible for informing the Trainee about the relevant national laws, rules and
regulations related to visas, resident permits, work permits, health and liability insurance and all other legal
matters related to the work placement and stay abroad of the work placement Trainee. The Work Placement
Provider will, within reasonable means, assist the Trainee in obtaining all required legal documents and permits
related to the work placement.

HAVE AGREED AS FOLLOWS:
ARTICLE 1. DEFINITIONS
Avans University of Applied Sciences : the institution (university of applied sciences) based on Stichting Avans
that upholds it.
Study programme : a bachelor’s programme at Avans University of Applied Sciences as
included in the Central Register of Higher Education Study Programmes
(CROHO).
Work placement counsellor : the lecturer of the study programme who is responsible for supervision
and assessment.
Work placement coordinator : the supervisor from the study programme who monitors the work place-
ment processes.
Work placement plan : a plan formulated by the work placement trainee in which the learning
and working activities that the work placement trainee will perform
during the work placement have been laid down in consultation with the
study programme and the work placement provider.
Industry liaison officer : the employee of the work placement provider who supervises the work
placement trainee during the work placement.
Work placement : a period of vocational training which forms an essential part of the
curriculum.
Work placement provider : the organisation providing the work placement.

Work placement trainee : a student enrolled in a study programme at Avans University of Applied
Sciences with whom a work placement agreement is signed. The compul-
sory components of the work placement are described in the applicable
study guide, the Education and Examination Rules of the study
programme and usually in the work placement memorandum and/or
work placement rules.
The terms student and work placement trainee refer to both male and female students and work placement
trainees.
ARTICLE 2 DURATION OF THE WORK PLACEMENT
The work placement activities take place in the following periods:

If this period cannot be realised due to unforeseen circumstances, a different or additional period will be agreed
upon in mutual consultation.
ARTICLE 3. WORKING HOURS
The daily working hours of the work placement trainee are determined in consultation with the work placement
provider.
The student is required to be present 40

ARTICLE 4. STATUS OF THE WORK PLACEMENT TRAINEE
1. The work placement is aimed at expanding the knowledge, skills and experience of the work placement trainee
within the framework of the study programme. The purpose of this work placement agreement is therefore
not meant to be an employment agreement for the purposes of Article 7:610 of the Dutch Civil Code and is not
intended as such.
2. The work placement trainee remains enrolled at Avans University of Applied Sciences for the duration of the
work placement.
3. The work placement is completed under the supervision and responsibility of the study programme in which the
work placement trainee is enrolled.
4. The work placement may not result in any restrictions on the future employment of the work placement trainee
at other institutions/companies.
ARTICLE 5. PURPOSE AND CONTENT OF THE WORK PLACEMENT
1. The work placement is an integral part of the study programme. An extensive description of the purpose has
been included in the Education and Examination Rules and/or in the work placement rules.
2. The content of the work placement is described in the work placement plan that has been included as an
annexe.

ARTICLE 6. SUPERVISION
1. 4
At least _____ supervision meetings will take place in the context of supervision.
2. The final assessment will take place according to the guidelines of the work placement rules at the end of the
work placement.
3. The industry liaison officer has a weekly progress meeting with the work placement trainee.
4. There are work placement review days during which the work placement trainee visits the study programme.
5. The work placement trainee meets the reporting and feedback requirements as stipulated in the work
placement rules.
ARTICLE 7. ASSESSMENT
1. The industry liaison officer will draw up an assessment recommendation in accordance with the relevant
guidelines.
2. The work placement counsellor will draw up the final assessment in accordance with the guidelines defined
in the work placement rules.
3. All evaluations and assessments will be discussed with the work placement trainee.
4. The examiner is responsible for the final assessment of the work placement. The examiner is the work
placement counsellor of the study programme.
ARTICLE 8. REIMBURSEMENT
1. The work placement trainee will X will not receive a work placement salary.

3. Avans University of Applied Sciences is not liable for the costs incurred by the work placement trainee in
connection with the work placement, not even if the work placement takes place abroad.
ARTICLE 9. LEAVE
1. Taking leave days must be in agreement with the work placement provider, whereby it should be noted that
the remaining leave days/hours will not be paid if they have not been taken during the work placement period,
unless the work placement trainee has not been given the opportunity by the work placement provider to take
the leave days. If the work placement institution is closed around public holidays, these will be counted as days
of leave of the work placement trainee.
2. The rules for special leave and the Work and Care Act apply as they apply to employees of the organisation
providing the work placement. Requests for extra leave can only be granted by the industry liaison officer after
consultation with the work placement counsellor.
3. If the work placement trainee takes more leave than the number of days of leave agreed upon, the work
placement period pursuant to Article 2 will be extended by this period.
4. No days of leave need to be taken for educational activities such as preliminary examinations and resits and
work placement review days.

A work placement salary is defined as income from work, which implies, for tax purposes, an employee relationship on the basis
of which wages are paid and social security contributions (including payroll tax) are deducted. Under employment law there is no
employee relationship and there is no employment contract.

Travel or expense allowances are not considered to be income. The work placement provider will not deduct any payroll tax or
contributions from a travel or expense allowance.

ARTICLE 10. ILLNESS AND SPECIAL CIRCUMSTANCES
1. In case of illness the work placement trainee must notify the industry liaison officer of the work placement
provider and the work placement counsellor of the study programme on the first day of illness.
2. If it appears that the work placement tasks must be suspended as a result of long-term illness, the work
placement trainee must contact the work placement counsellor and/or the work placement coordinator as soon
as possible. The work placement counsellor and/or the work placement coordinator will make arrangements for
the continuation or discontinuation of the tasks and the conditions agreed upon. These are set in writing as a
supplement to the work placement agreement.
3. Given paragraphs 1 and 2 of this Article, the sickness absence protocol of the work placement provider

ARTICLE 11. COMPLIANCE WITH THE GENERAL RULES AND INSTRUCTIONS OF THE WORK PLACEMENT
PROVIDER
1. The work placement trainee will observe the code of conduct and rules and instructions as these apply to the
staff of the work placement provider in the interest of order, safety and health.
2. The work placement trainee must also follow the instructions of the industry liaison officer in accordance with
the applicable rules as stipulated in the first paragraph.
ARTICLE 12. CONFIDENTIALITY
1. The student will maintain the confidentiality of data that the company has designated as confidential or that
the student could reasonably have understood to be confidential.
2. Confidentiality implies that:
a. The student will only use this data within the work or research that results from the assignment.
b. The student will not disclose any data that the company has designated as confidential to any third party. If
the data is still necessary for a report and/or presentation related to the assignment, the student will
anonymise this data.
c. The student will visibly state on a report or presentation that it is ‘confidential and not for citation’. Under
this condition, the use of a report or presentation for the assessment by students (peers) and lecturers within
Avans University of Applied Sciences does not count as disclosure to third parties.
3. The duty of confidentiality is valid up to one year after the student deregisters from the study programme
at Avans University of Applied Sciences of which the assignment forms a part.
4. If the company believes that the student has breached the obligation of confidentiality, it will hold the
student to account. Avans University of Applied Sciences may also hold the student accountable for this
behaviour in the event of an intended violation.
ARTICLE 13. COPYRIGHT AND OTHER INTELLECTUAL PROPERTY
1. The intellectual property rights under which, but not exclusively, copyright for the products and end
products produced during the period referred to in Article 2 is vested in the work placement provider unless
otherwise agreed.
2. The work placement provider hereby grants the work placement trainee and the educational institution
permission to reproduce and publish the end product (which in any case includes the final
dissertation/graduation work) in an anonymous form in print and/or digital form, as part of the
HBO-Kennisbank, online or offline and for internal and external use, exclusively for educational
and research purposes, unless otherwise agreed. In this respect, Article 12 applies explicitly.

ARTICLE 14. COSTS AND LICENSES FOR SOFTWARE USAGE
1. Software programs made available by Avans University of Applied Sciences for educational use may not be used
for commercial purposes.
2. Insofar as the work placement provider and/or the work placement trainee have commercial interests in the end
product, any extra costs incurred by the work placement trainee in the performance of the work (including soft-
ware costs and licensing obligations) will be borne by the work placement provider, unless otherwise agreed.
3. Avans University of Applied Sciences cannot be held liable for the costs referred to in the second paragraph.
ARTICLE 15. DISPUTES
1. In the event of problems during the work placement, the work placement trainee and the industry liaison
officer will first try to solve these problems in consultation with each other.
2. Disputes between the work placement trainee and the industry liaison officer will be submitted to the work
placement counsellor.
3. If the industry liaison officer, the work placement counsellor and the work placement trainee cannot resolve
the dispute this will be submitted to the work placement coordinator.
1. The Work Placement Provider is liable for any injuries or damages the Trainee may suffer personally during all activities
performed under the authority of the Work Placement Provider;
2. Avans carries comprehensive accident insurance for its students abroad. This accident insurance is limited to the time spent
abroad for Avans study programmes. As such, it provides only limited cover and does not apply to additional personal time
spent abroad. Trainees who are registered in the Mobility Database of Avans are automatically offered suitable but limited
travel and liability insurance at Avans’ expense. Students who are either not registered in the Mobility Database or require
more extensive coverage are personally responsible for taking out private accident, travel and liability insurance. It is the
responsibility of the Trainee to ensure that this insurance is adequate for the purpose and duration of his stay abroad.

ARTICLE 16. INSURANCE/LIABILITY
1. Under current national legislation, the Work Placement Provider is liable in the first instance within
the Company-Trainee relationship.
2. Avans Considers the Work Placement Provider to be liable for damages caused by subordinates,
including trainees, tot third party.
3. The Trainee must use his own private general liability insurance if the Work Placement Provider’s liability
insurance does not provide any or insufficient cover under the current national legislation. It is the responsibility
of the Trainee to ensure that his general liability insurance is adequate for the purpose and duration of his stay
abroad;
4. If no cover is obtainable from the aforementioned insurance policies, the Avans comprehensive general liability
insurance may apply as a “safety net” for compensation of damages caused by the Trainee and for which the
Trainee is formerly held liable or for which by law Avans may be held liable. This insurance covers damages to
items belonging to, or under the control and/or responsibility of the Work Placement Provider, during and in
connection with the Work Placement. Damages caused by or with vehicles, including motor vehicles, are by
definition excluded from the Avans comprehensive general liability insurance.
ARTICLE 17. TERMINATION OF THE WORK PLACEMENT AGREEMENT
1. A work placement ends:
a. At the end of the period stipulated in Article 2;
b. As soon as the work placement trainee deregisters as a student at Avans University of Applied Sciences;
c. Upon mutual agreement of the parties;
d. Upon the death of the work placement trainee;
e. In case of bankruptcy, suspension of payment or dissolution of the work placement provider.
2. The work placement provider has the right to terminate this agreement immediately, having heard the views of
the industry liaison officer and the work placement trainee concerned:
a. If, in the opinion of the work placement provider, the work placement trainee repeatedly and despite
warning fails to comply with the rules or instructions of the industry liaison officer and/or otherwise behaves
in such a way that the work placement provider cannot reasonably be expected to continue to cooperate
with the work placement.
b. If the work placement trainee does not comply with their duty of confidentiality towards the work placement
provider pursuant to Article 12.
The work placement provider will immediately notify the work placement counsellor of a decision as referred to
under a and b through the industry liaison officer.
3. The study programme has the right to terminate this agreement immediately and to recall the work placement
trainee, having heard the views of the work placement counsellor and the work placement trainee concerned:
a. If, in the opinion of the study programme, the work placement does not meet the educational objectives
or otherwise does not take place in accordance with what has been agreed in this agreement or the work
placement trainee cannot reasonably be asked to continue the work placement with the work placement
provider.
b. When regulations with regard to privacy and undesirable behaviour are violated.
The study programme will immediately inform the industry liaison officer of such a decision through the
work placement counsellor.
4. The work placement trainee is entitled, following consultation with the industry liaison officer and the work
placement counsellor, to terminate this agreement immediately if the work placement trainee cannot
reasonably be expected to continue the work placement.

ARTICLE 18. RESOLUTIVE CONDITION
The agreement is concluded under the resolutive condition that the student meets the conditions to be admitted to
the work placement no later than at the start of the work placement period. The exact conditions for admission to
the work placement are mentioned in the applicable Education and Examination Rules and/or the work placement
rules.
ARTICLE 19. APPLICABLE LAW
National laws apply tot his agreement. The Work Placement Provider’s national and or Dutch courts may have
jurisdiction in the event of disputes.
ARTICLE 20. CONCLUDING PROVISION
If this work placement agreement conflicts with another agreement to be signed by the work placement trainee
with the work placement provider, this three-party agreement will take precedence.
