AN ORDINANCE REGULATING COCKFIGHTING, THE ESTABLISHMENT,
OPERATION AND MAINTENANCE OF COCKPITS AND THE BREEDING OF
WILLIAM C. EVANGELISTA GAMECOCKS IN THE MUNICIPALITY OF BANSUD, ORIENTAL MINDORO

WHEREAS, cockfighting has been and still is a popular, traditional and
customary form of recreation and entertainment among Filipinos during

WHEREAS, in order to regulate cockfighting in the municipality, the

NOW, THEREFORE, BE IT ENACTED, by the Sangguniang Bayan of


Bansud, Oriental Mindoro, in session assembled, that:

Section 1. Title. This Ordinance shall be known as the “Cockfighting
Ordinance of 2021” of the Municipality of Bansud, Oriental Mindoro.

SB Member general welfare of the inhabitants of the municipality, to ensure and support
the preservation and enrichment of culture while enhancing local income and
productivity.

SB Member Section III. Coverage - This Ordinance shall govern the issuance of
franchise and license on the establishment, operation and maintenance of
cockpits and ownership thereof. It also provides for the regulation of

SB Member jurisdiction of Bansud. It shall apply to all persons, whether natural or
juridical, residents or not, and in all places within the jurisdiction of the
Municipality of Bansud, Province of Oriental Mindoro.

SB Member Section IV. Definition of Terms – As used in this Ordinance, the terms
below shall have the meanings ascribed to them in this section. Any words or
terms not defined shall be given their plain and customary meanings, unless

a) Cockfighting (Sabong) – means the commonly known game

b) Cokpit (Sabungan) – means the commonly known game arena


provided with one or more gates or doors or points of entrance and

c) Cockfight (Soltada) – refers to the actual fight or physical combat of

Bayan to hold cockfighting on days other than Sundays or legal

j) Pit Manager - refers to a person who professionally, regularly and
habitually manages a cockfight, who may or not be the owner of

k) Referee (Sentenciador) – means a person who matches and
oversees the progress of the cockfight and decides its result by
announcing the winner or declaring a draw or non-contest game

l) Bet Manager (kasador) – refers to a person who calls and takes care
of bets from owner of both gamecocks and those of other bettors’

m) Bettor – refers to a person who participates in cockfighting and with

technique of arming fighting cocks with gaffs on either legs

who actually releases the fighting cocks for actual fight and combat in
a cockpit

government engaged in the promotion, holding and the celebration
of specially programmed cockfighting like local and international

s) Cocker (Aficionado) - refers to a person who participates and bets in

legislation which logically arranges, prescribes, defines and apportions

u) Franchise - refers to a right or privilege granted by the municipal

v) Commercial breeding of gamecocks – means any personal or juridical

(5) fighting cocks.

Section V. Ownership, Operation and Management of Cockpits

The following persons or entities may own, operate or manage cockpit:

a) Filipino citizens not otherwise prohibited by law;

b) Cooperative or corporation, the capitalization of which is one
hundred percent (100%) Filipino-owned, formed, organized, or

licensed for the purpose.

Section VI. Establishment of Cockpits

Only two (2) cockpits may be established, maintained and operated in
the Municipality of Bansud. Provided, that the second cockpit cannot be
established without complying with the number of inhabitants allowed by law
for the establishment of the same which at present is One Hundred (1oo)

cockpits already existing and actually operating and which fully comply with
the requirements with respect to site, location and construction, not in excess
of the number herein allowed, shall be given priority in the granting of license

Section VII. Site, Local and Security of Cockpits

operated within a radius of one hundred (100) linear meters from any
existing residential or commercial areas, hospitals, school buildings,
churches or other public buildings;

b) No two (2) cockpit licenses or franchises may be issued or granted to
one and the same person;

SKMF President c) No two (2) cockpits may be constructed and operated within a
distance of less than one (1) kilometer from each other and within
the same political district of the municipality;

IPM Representative d) No cockpit may be constructed in any barangay without first securing
a clearance or permit from the barangay concerned;

e) All cockpit arenas shall provide spacious parking area for vehicles of

accidents;

f) All cockpit owners, operators or licensees shall employ the services

of trained security guards to ensure peace, order and safety among
all participants and stakeholders of cockfighting.

Section VIII. Term of Franchise

Sangguniang Bayan for the same period after compliance with all the
conditions for renewal as provided herein;

SB Member Section IX. Requirements for Granting of Franchise

1. New Franchise – every application for a new franchise to operate and

(a) Location and vicinity plan of the cockpit including the parking area;

duly certified as to compliance that the cockpit building and facilities
are constructed in accordance with the provisions of the National

(c) Approved Locational Clearance by the Deputized Zoning


Administrator certifying that the areas/location of the cockpit

conforms to the Zoning Ordinance of Bansud;

(d) Certification by the Deputized Zoning Administrator that there are


no existing residential or commercial area, hospitals, school

within a radius of one hundred (100) linear meters from the cockpit
building;

SB Member (e) Official receipts showing payments of municipal taxes, fees and
other levies prescribed by the Revenue Code of Bansud and other
impositions by the national agencies and other departments

(f) Clearance from the Punong Barangay concerned allowing
construction of said cockpit in his/her barangay.

ABC President 2. Renewal of Franchise – Every application for the renewal of a franchise
shall be submitted to the Sangguniang Bayan not later than January 20
of every year. It shall be accompanied with following documents:

(a) Official receipts showing payment of municipal taxes, fees and
other levies as prescribed by Revenue Code of Bansud and other
related ordinances;

(b) Certification by the Municipal Engineer that the building housing
the cockpit is free from any material, structural or other defects, or

fire hazards and that the building is fit for cockfighting purposes;

(e) Health Certificate to employees and operator issued by Municipal
Health Office in the preceding year.

Section X. Limitation on the Issuance of Cockpit Franchise

CRISPIN E. CABRAL a) No franchise shall be issued to any person who has been previously
SB Member convicted by final judgment of a crime involving moral turpitude or
offense against property;

NILO E. ROLDAN b) No franchise shall be granted to any person without first securing a
SB Member permit from the Punong Barangay concerned, where the cockpit is
located;

RONALD H. CLOSA c) No franchise shall be granted to any person who is related within the
SB Member fourth degree of consanguinity or affinity to an existing holder of a
franchise and who is actually maintaining and operating a cockpit at
the time of filing the application;

d) No franchise shall be granted in violation of the Zoning Ordinance of
the municipality, and other applicable laws or regulations;

e) No cockpit shall be allowed to operate without the proper registration
certificate from the Office of the Municipal Mayor;

f) No two (2) franchises shall be granted to the same person, cooperative

g) No franchise shall be granted above the requirement of one cockpit for

Section XI. Registration of Cockpits

After the franchise has been granted by the Sangguniang Bayan it shall

be the duty of the franchisee/licensee/grantee to register the cockpit with the
Office of the Municipal Mayor within thirty (30) days from issuance of the
franchise. The Office of the Municipal Mayor shall register the franchise and

All existing cockpits established, maintained and operated in the


Municipality of Bansud, Oriental Mindoro prior to this Ordinance shall register

Ordinance and every year thereafter;

IPM Representative Registration Certificate not later than January 20 of every year. Previously
granted franchises shall also be covered by this requirement.

a) Certified copy of the resolution of the Sangguniang Bayan granting

a) Copy of the approved location or vicinity plan of the cockpit;

cockpit building, parking area and existing facilities such as restrooms,
faucets and water system;

SB Member e) List of all duly licensed officials operating and maintaining the cockpit,
registered with the Mayor’s Office not later than January 20 of each
year.

Section XII. Uniform of Cockpit Officials
SB Member

Duly registered cockpit officials/employees shall use a uniform shirt


with or without collar, with their respective names and positions printed in big
CARLITO M. DE CASTRO bold letters at the back and the name of the cockpit in front. They shall also be

required to use an identification card (ID), issued by the cockpit
owner/licensee which they shall always display in front while officiating
cockfighting during authorized cockfights.

Cockpit officials/employees who are not wearing the prescribed
uniform shall not be allowed to participate/take part in any cockfighting
activity. The owner/licensee/franchisee, or operator/manager of the cockpit

SB Member gaffer, referee, bet taker (llamador) promoter, bet manager and pit manager
who is not registered or has no Mayor’s Permit.

Cockfights may be held only in licensed cockpits during Sundays and
legal holidays, not otherwise prohibited in this Ordinance; Provided that, no

d) All Saints Day (November 1)

h) Rizal Day (December 30)

Section XIV. When to Allow Special Cockfighting

Special cockfighting shall only be allowed on the following occasions
upon authority by the Sangguniang Bayan; Provided that, no cockfighting
whether regular or special hackfights including derby shall be allowed in one

a) On occasion of the town fiesta, within the week of January annually for
not more than Three (3) consecutive days and not more than once a

b) Three (3) consecutive days during a provincial, municipal, agricultural,
commercial or industrial fair, carnival or exposition for a similar period

c) For entertainment of foreign dignitaries, tourists or returning Filipinos


commonly known as Balikbayans; Provided that, only one (1) permit

may be issued for the same purpose in a calendar year by the

days;

SB Member d) For the support of local fund-raising campaign for charitable purposes
as may be authorized by the Municipal Mayor in consultation with the
Municipal Social Welfare and Development Office;

SB Member e) For duly approved fund-raising activities in connection with barangay
fiesta celebration and other purposes.

Section XV. Resolution/Permit Required for Special Cockfights

No special cockfight including national or regional cockfighting derby
shall be allowed unless authorized through a resolution of the Sangguniang
Bayan and after payment of the corresponding special permit fee.

Application for such special cockfight shall be filed in the Office of the
Sangguniang Bayan, at least ten (10) days before the event. Such application
letter must be duly signed by the owner, operator or licensee of the cockpit

SB Member recommendation or letter endorsement by the Municipal Mayor to the
Sangguniang Bayan to authorize the holding of such special cockfight.

(1) No person shall accept any bet without the corresponding money at
his disposal to respond to the bet in case he loses;

SB Member (2) No person shall talk to, interfere with or in any way obstruct the act of
the handler (soltador) while the latter is releasing his fighting cock;

while the latter is overseeing the cockfight in progress or when he is in
the act of rendering his decision in consummated cockfighting match;

(4) No person under the influence of liquor shall be allowed to enter the
cockpit premises;

(5) No person except the referee, handlers and such other authorized

cockpit arena (rueda) while a cockfighting is in progress;

(6) No person shall be allowed to participate or deal with other gambling

a) Inside the cockpit or within its premises;
b) Outside the cockpit at a distance of fifty (50) linear meters from the
cockpit arena or building.

(7) No person shall be allowed to carry firearms, bladed, or any deadly
weapon, either for personal or official use/reason, unless authorized by
law;

(8) No operator, owner or licensee of a cockpit shall employ or allow to
participate in a cockfighting activity any gaffer, referee, bet taker,
promoter, bet manager or pit manager who has not secured a

(9) Smoking shall be strictly prohibited within the cockpit premises;

Provided that, it shall only be allowed within the designated smoking
SB Member area in an open space outside the cockpit building;

(10) No person less than eighteen (18) years of age (minor) shall be

(11) No person shall be allowed to sell any kind of liquor inside the cockpit

The owner, operator, licensee, grantee or franchisee and/or the
violator/s shall be held liable for any violation after due court proceedings,

with corresponding penalties of fine or imprisonment as provided in Section
SB Member XXIV of this Ordinance.

Section XVII. Commercial Breeding of Gamecocks of Fighting Cocks

No person shall be allowed to breed fighting cocks for commercial or
business purposes without first registering with the Office of the Municipal

Section XIX. Power or Authority to Grant and/or Revoke
License/Franchise

Charitable Purposes

SB Member owner, operator or licensee shall report, on a daily basis, the receipts from
gate or entrance and ringside tickets and the total commission (plazada) for
the day.

SB Member After the cockfighting event for charitable purposes, the cockpit
owner, operator or licensee shall turnover to the authorized representative of
the receipt charitable institution or organization, the share of the proceeds as

percent (40%) to the recipient charitable institution/organization.

a copy of the daily financial report and the financial summary of the cockfight
