Rules and Regulations
1 Purpose: - To give exposure to students pursuing the law course to the Indian Court system &
Advocacy skills.
2. Date & Venue:- 7 May, 2022 – 8 May, 2022 at Faculty of Law and Governance , Jayoti Vidyapeeth
Women's University , Jaipur.
3. Team Composition and Eligibility Criteria:
I. Each team shall comprise of 3 members only, out of which two (2) will be Mooters and one
(1) researcher.
II. Arguments shall be in English only.
III. The competition is open for all Law students perusing five year and three years LL.B.
course.
IV. Male candidates can also participate but the ratio of participants should be 2:1 (2 female &
1 Male Participant)
V. Each University/Institute shall be eligible to send one team. Team should not disclose
the identity of their institution in course of proceedings in the court rooms; such
disclosure shall invite penalties including disqualification.
VI. Each team shall be provided with the team code by draw of lots followed by exchange of
memorials.
Note: Accommodation + Fooding Lodging Facilities are available on chargeable subject to first
cum first serve basis.
One Day Room Charge - 1500/- inclusive Fooding + Lodging
Two Days Room Charge - 2500/- inclusive Fooding + Lodging
4. Registration:-
I. The registration form with all team details must be submitted online and also sent to the
university on or before 30 April, 2022
II. A Registration fee of rupees Rs. 2000/- is to be paid online or to be sent by way of Demand
Draft in favor of JAYOTI VIDYAPEETH WOMEN'S UNIVERSITY, Jaipur payable at
Jaipur along with the Registration form. The registration fee shall be non-refundable.

III. No change in the names of the participants shall be permitted after the receipt of the
registration form, except at the sole discretion of the organizers.
IV. After Receipt of the Registration form along with Demand Draft, the participating team
will be allotted a Team code which they are required to mention on their memorial.
V. Teams should clearly mention the participants' name, contact no. including year
/Semester of study in the registration form.
VI. Teams shall not mention any details about them except the team code on the memorial.
VII. Dress Code: - White Shirt and Black Trouser along with black coat and tie.
MOOT PROBLEM
Republic of Indica is a country which has various cultural and historical glories to its name and was
often nicknamed as the “Land of Culture”. People from various backgrounds lived in harmony and
abided by the laws of the land. In Republic of Indica, the majority of the population worshipped deities in
the personification of women as a symbol of Strength and Fearlessness. 'Ankara' is a State of Republic
of Indica with the highest literacy rate among all other States of Republic of Indica and the people
believed in the Equality between Men and Women in all spheres of life. Shalini was a young Advocate
who had just passed her college and started practicing. She was very ambitious about her work and always
worked for the poor and needy people free of cost. She was always the last one to leave her workplace and
often took her personal vehicle to travel home from workplace. One such night, on 17-01-2020 around
9:30 P.M. she was returning from workplace on her Scooty, where she noticed four men desperately
asking for help beside the highway. Out of generosity, she stopped her Scooty and two men told her that
they are tourists and one of their friends is lying injured at a distance. While she got down from her
Scooty, two of them accompanied her to a distant secluded place.
On her way, she realized that her phone was inside the Scooty, so she returned for taking the same and on
return, she found that her two-wheeler tyre was punctured. Shalini called her younger sister Nancy at 9:35
p.m. to inform that her Scooty had broken down and she was alone on the road. All of a sudden, the two
men, who had asked for help accompanied by two other men came towards her and started touching her
in a wrong way. She got scared and slapped one of them, to which the men became angry and then
dragged the girl to a distant place and raped her one by one. In the fear of not getting caught, the four men
put petroleum in her body and burnt her alive till she was dead and ran away towards the nearby village.
On 18-01-2020 the partially burnt body was found at an underpass on the Ankara-Bendakal National
highway by a farmer around 6:00 a.m. He informed the village Sarpanch, who alerted the local police.
After confirming that the victim was a female, the local police verified the recent women missing cases
and then, with the help of the handbag and the scarf, the family members were able to recognise her.
The Police started various investigation procedures and discovered a CCTV footage which was placed
near the highway for traffic control. By looking at the CCTV footage, the Police saw some faces where the
recording timing showed around 10:00 p.m. based on which, they started searching for the four men who
had run towards the village and started the enquiry. On 23-01-2020, based on its investigation, the Police
arrested, Javed, Rajesh, Naveen and Keshav. In the meantime, as soon as the news became viral, people all
over the country started protesting and the news became trending all over Social Media and people
demanded Justice for Shalini. People from various political background as well as Film Industry and
Media houses demanded speedy Justice and #KillTheRapists became viral all over the Country and the
Government took initiative for a speedy disposal of the case.
On 24-01-2020, the Police presented the four accused in front of the local Magistrate and requested for a
7 days remand for further investigation. Amidst the remand period, the entire Country protested with
candle light marches and various High-Profile Personalities also got involved in the protests. On 03-02-
2020, the Media flashed the news that the four accused had been shot dead by the Police while they were
being taken to the Court. The Investigation In-Charge in the Interview stated that Naveen and Keshav
snatched the revolvers from the Constables while they were being taken to the Court, jumped out of the
Police Van and fired two rounds in the air. Javed and Rajesh also followed them and tried to escape. The
Police claimed that they found no other ways and had to shoot down the four accused otherwise the
accused would have fled.
The killing of the accused in the alleged encounter was hailed by a section of people, the
families of the deceased and human rights groups alleged that the Police took law into its hands,
terming this as extra-judicial killing. In the Police Press Conference that followed, questions as to
how two of the four accused managed to get hold of the pistols in the presence of 10 Armed Police
Officers went unasked.
The families of the Four Accused also alleged that the police officers have framed the murder scene as
they had threatened them when they went to the police station. The families informed the reporters that
the police officers angrily made the statement to the families that the accused stand no chance of being
saved from death as the entire Nation was against their act.
As soon as the News became viral, the entire Country rejoiced and supported the action of the Police and
the same was called an “Act of Bravery” by various Political Leaders. But, an NGO named as “Saman
Adhikar” filed a Petition before the Hon'ble High Court of Ankara. The Hon'ble High Court of Ankara
after hearing all the arguments of the case held “The Police had no other option but to shoot the four accused failing to
which they would have fled and which would have triggered mass and widespread agitation throughout the Nation and the
Role of the Police would have been in question. Therefore, the Court finds the Act of the Police as an Act of Bravery and
sudden reflex to counter the situation which arose in front of them.”
Families of the four accused who were gunned down by the Police in an alleged encounter, have
approached the Supreme Court, seeking registration of murder case against the Police Officers
involved. Alleging that the youth were killed in a stage-managed gunfight, the families filed a
Writ petition under the provisions of Article 32 of the Republic of Indica's Constitution which
enables individuals to seek redressal for the violation of their Fundamental Rights.
The NGO, after the Judgment by the Hon'ble High Court, approached the Hon'ble Supreme Court on the
contention of violation of Human Rights as well as the violation of Fundamental Rights guaranteed under
the Constitution of Republic of Indica. All the petitions have been clubbed by the Hon'ble Supreme Court
of Republic of Indica and stands pending before the Hon'ble Supreme Court of Republic of Indica. The
case is listed before the Supreme Court for final hearing on May 7th -8th ,2022 . The respective Counsels are
expected to submit their considerations on the following issues:
1. Whether there is violation of Fundamental Rights of Accused persons?
2. Whether the Police can be accused for Extra-Judicial Execution?
3. Whether the Police can be accused for fake encounter?
4. Whether the Police can be accused for murder?
Note:
1. The laws of the State of Republic of Indica are in pari materia with the laws of India.
2. Participants shall prepare Memorials/Arguments for both sides i.e. Petitioner and
Respondent.
3. Participants are allowed to create other sub-issues also.
COMPETITION ROUND
There shall be three rounds; four teams will be selected for Semi-final round from the first round.
Final round shall be only between first and second winners of the Semi-Final Round.
First Round
I. In first round each team shall argue from both the sides (appellant and respondent).
II. The team shall be credited with a win in the first round if their round total is more
than opposing team.
III. The marks of each first round shall be the cumulative total of the marks of both the
mooters and the marks of the memorial of the side in which they are appearing.
IV. No team shall face each other more than once in the first rounds.
Semi-final Round/ Final Round
There shall be one first round, one semi-final and one final round. The marking criteria in
semi-final, final round shall be the same as that of the first round.
MOOT MEMORIAL
(I) All teams must submit Memorials /Written Submissions for both sides. (Appellant as well
as Respondent);
(ii) Participants are allowed to frame additional issues other than those provided in the moot
proposition, if desired;
(iii) All teams must submit typed Memorials for both sides and the Memorials must fulfill all the
following specifications;
(iv) Memorials must contain the following:
(a) Cover page / Cause title. (b) Index.
(c) Index of Authorities. (d) Statement of Jurisdiction.
(e) Synopsis of Facts. (f) Summary of Arguments.
(g) Arguments / Pleadings. (h) conclusion/prayer
(v) The moot memorial shall not exceed 40 pages including Arguments.
(vi) The Memorial shall be typed on A4 size page in Font type. Times New Roman, Font size :
12, 1.5 line spacing & 1 inch margin on each side. Blue Book pattern shall be followed.
(vii) The Cover Page of the Memorial must follow the following color scheme, Green for the
Applicant Cover Page and Yellow for the Respondent Cover Page.
(viii) The Memorial must be spiral bound only.
(ix) The Memorial must not contain any Annexure/Photographs/ Sketches/ Exhibits/
Affidavits etc.
(x) Memorials that do not comply with the abovementioned specifications will be penalized.
(xi) Two (2) hard copies + one soft copy on one (1)CD for each side (appellant and respondent)

must reach the organizers latest by 05 May 2022. No memorials shall be accepted after
the prescribed date.
(xii) Four(4) hard copies from each side (appellant and respondent) shall be submitted by the
teams on reaching at the venue of the Moot Court.
(xiii) Identification of any type shall be strictly prohibited.
Marking Criteria for the memorials
(I) Memorial from each side shall carry total of hundred (100) marks.
(ii) The following shall be the criteria for marking the memorials:

(iii) A penalty of two (2) marks for each side of memorial shall be entailed on each days default
in submissions of memorials.
Oral Submissions
(I) Each team shall comprise of two (2) Mooters, as has been specified earlier.
(ii) Court language shall be English only.
(iii) Each team will have a maximum of thirty (30) minutes to present their Oral Submissions
in First Round. No speaker will be permitted to address the Court for more than seventeen
(17minutes).This includes the time the speaker addresses the Court during the
rebuttal/sur-rebuttal. The maximum time for rebuttal/sur-rebuttal is five (5) minutes.
(iv) At the commencement of each session of Oral Submissions each team shall notify the
Court Officer as to the division of time between the 2 speakers.
(v) If any speaker continues to speak after the completion of her time, she shall entail penalty
which shall be upon the discretion of the judges.
(vi) The Final decision as to the time structure will be that of the bench judges.
(vii) During the course of oral submissions the participants cannot submit to the court any
material containing pictorial representation whatsoever. Further the participants will not
be permitted to make any audio/visual representation nor will they be allowed to use
personal computers, laptops and any other technical or mechanical device during their
oral submissions.
(viii) Speakers shall not be allowed to pass annexure to the judges; instead the teams may make
a compendium of annexure that shall be given to the judges before the start of
proceedings.
(ix) If at any instance a submission is made with any material in violation to the above clause
and if any picture, sketches, photos, cartoons, caricatures, audio film, video film,
projector-slide or a computer generated image is submitted or presented to court, the
teams shall be disqualified from the competition forthwith.
(x) During the course of the Oral Submissions speaker shall neither reveal her identify nor
the identity of their University /College by any means whatsoever.
Marking Criteria for the Arguments:
( Mooter and Researcher)
(I) Each Mooter & Researcher will be marked on a total of 100 marks by each Bench Judge.
(II) The following will be the Marking Criteria and the Marks allocated to each Mooter &
Researcher by each Judge in the Round:

(III) The decision of the judges as to the Marks allocated to any team shall be final.

1. There shall be a Trophy awarded to the Winning team of the Competition.
2. The winning team will also receive a cash prize of Rs. 20,000/-.
3. The Runner Up team will receive a cash prize of Rs. 10,000/-
4. The Best Mooter will receive a cash prize of Rs. 5,000/-.
5. The Best Memorial will receive a cash prize of Rs. 5,000/-.
6. The Best Researcher will receive a cash prize of Rs.5000/-
7. There will be Certificate for participation for all the students who will
participate in the Moot Court Competition.
