I, Vedpal s/o Sh. Hawa Singh r/o Malik

Colony, Sonipat age __ years, do hereby

solemnly affirm and declare as under:

1. That the deponent has filed an application

for cancellation of anticipatory bail of

accused Rajesh s/o Ganga Dutt r/o vill.

Ridau, Distt. Sonipat.

2. That the address mentioned in the

application by the deponent is correct one

and beside this there is no address of the

accused known to the deponent. It pertinent

to mention here that the accused has also

mentioned the same address in his

anticipatory bail also.


3. That the Hon'ble Court of Sh. Rajesh Gupta,

the then Ld. ASJ, Sonipat granted

anticipatory bail to accused Rajesh vide

order dt. 02.08.2019 with condition that

accused shall make the payment of cheque

amount with interest within six month of

order. That the period of payment of six

months ordered by the Hon’ble Court of Sh.

Rajesh Gupta, the then Ld. ASJ, Sonipat has

already been lapsed but till date the

accused has not made payment to the

complainant.

I, Om Braham s/o Ramji Lal r/o Mohalla

Jatwara, Sonepat, do hereby solemnly affirm

and declare as under:

1. That the deponent alongwith other

appellants filed the present appeal against

the respondents which is most likely to be

succeed on the grounds mentioned therein

and the same is fixed for 03.07.2019 for

filing the affidavit to the effect that the

correct address of the respondent no. 2..

2. That at the time of filing of the appeal,

the appellants gave the address of the

respondent no. 2, which is mentioned in the

memorandum of the appeal, is last known


address of the respondent no. 2 to the

knowledge of the appellants.

3. That in the above noted appeal the

respondent no. 2 was served upon on the

above said address but the respondent no. 2

intentionally and deliberately with

malafide intention did not appear before

the Hon’ble Court and avoiding the court

proceeding.

4. That the presence of the respondent no. 2

may kindly be secured by way of substituted

service i.e. through publications on the

address mentioned in the memorandum of

appeal.

R/Madam,

The applicant/complainant most respectfully

submits as under:

1. That the above noted case is pending before

this Hon’ble court and the same is fixed

for today.

2. That the complainant filed the present

complaint against the accused person of

their last known address to the knowledge

of the complainant. The Hon’ble Court

summoned the accused persons and some of

the accused persons appeared before this

Hon’ble Court.

3. That vide order dt. 05.09.2014, the Hon’ble

Court of Ms. Ankita Sharma returned the


complaint to the complainant for filing

before the proper court in view of the law

laid down by the Hon’ble Supreme Court

(Dashrath Roop Singh Rathor v/s State of

Maharashtra). But after the amendment in

the Negotiable Instrument Act, the present

complaint again returned to the Hon’ble

Court for proper adjudication.

4. That in the above noted complaint the

accused person served on the address

mentioned in the complaint by the

complainant and some of the accused persons

appeared before the Hon’ble Court, but now

the accused no. 1 to 3 with the purpose to

harass the applicant/complainant and with

malafide intention did not appear before

this Hon’ble Court and avoiding the court

proceeding.

It is therefore prayed that necessary

action may kindly be taken against the


accused no. 1 to 3 to secure the presence

of the accused before the Hon’ble Court in

the interest of justice.

Churu(Rajasthan). But neither police is
arresting him in the present case nor the
accused has appeared before the police
authority, whereas the crime in the present
FIR is very serious one.
It is therefore prayed that the
accused Naveen Kumar Meena restrained from
mark his presence in his Duty Register from
the receiving of this complaint and copy of
the same sent to official of the accused
Naveen Kumar Meena mentioned below and
further necessary action also may kindly be
taken against the accused in the interest
of justice.
