INTERNAL RULES OF PROCEDURE


SECTION 1. Declaration of State Policies and Objectives – the state recognizes the vital
role of the youth in nation-building, and thus, promotes and protects their physical,
moral, spiritual, intellectual and social well-being, inculcates in them patriotism,
nationalism, and other desirable values, and encourages their involvement in public and
civic affairs. Towards this end, and the state shall establish adequate, effective,
responsive, and enabling mechanisms and support system that will ensure the
meaningful participation of the youth in Local Governance and National Building.

SECTION 2. Composition- The Sangguniang Kabataan Federation of Manolo Fortich shall


be composed of SK Federation President as the presiding officer and the twenty-one (21)
SK Chairpersons.

SECTION 3. POWERS, FUNCTIONS AND DUTIES. The powers, functions, and duties of
the SK Federation members shall be in accordance with the provision of R.A 10742 and
the Joint Memorandum Circular No. 2017-01 of the Department of Interior and Local
Government (DILG), Commission on Election (COMELEC), and the National Youth
Commission (NYC).

RULE I
POWERS AND FUNCTIONS OF THE PEDERASYON

SECTION 4. The Panlalawigang. Panlungsod and Pambayang Pederasyon shall have the
following functions:

1. Formulate policies as may be necessary to carry out the goals and objectives of the
Pederasyon;

2. Formulate and adopt its own Internal Rules of Procedures (IRP) which shall
prescribe a set of rules to serve as guidelines of the Pederasyon Officers and the
Committees in the discharge of their official functions, duties and responsibilities,
particularly on internal organization; date, time and venue of regular or special
session or meeting: parliamentary procedures; payment of pederasyon dues and
such other rules and regulations that may be adopt by the pederasyon that are not
contrary to existing laws, ordinance, this JMC and other government issuances;

3. Formulate, implement and coordinate programs, projects and activities particularly


those that are beneficial to the members of the Pederasyon and/or the general
welfare of the youth;

4. Initiate and implement programs designed to enhance the social, political,


economic, cultural, intellectual, moral, spiritual and physical development of the
SK and Katipunan ng Kabataan (KK) members;

5. Create committees as it may deem necessary to effectively carry out its powers and
functions and implement its programs and objectives;

6. May conduct fund raising activities, if necessary;

7. Establish liaison and linkages to different youth organization and youth serving
organizations in their respective jurisdiction for collaborative efforts towards youth
development;

8. Undertake fund-raising projects and activities to support the Pederasyon programs,

9. Strengthen the rapport and camaraderie among the members of the Pederasyon,
SK and KK;

10.Discuss and decide vital issues affecting the Pederasyon;

11. Appropriate and administer its own funds; and

12.Ensure that the Sangguniang Kabataan officials within their jurisdiction undergo
the mandatory and continuing capacity development trainings as mandated by
Section 27 of Republic Act No. 10742.

RULE II
POWERS AND FUNCTIONS OF THE PEDERASYON

SECTION 5. POWERS AND FUNCTIONS OF THE PEDERASYON- The functions and


duties of the Pambayang officers shall be as follows:

1. THE PRESIDENT- He/She shall be the highest officer of the Pederasyon in


his/her respective jurisdiction. As such, he/she shall:

a. Implement, execute and enforce the objectives and goals of the Pederasyon;

b. Render annual report before the end of January of each year to the
Pambayan na Pederasyon ng mga SK, as the case may be;

c. Sign contracts, agreements, acts and deeds for and in behalf of the
Pederasyon with the concurrence of a majority of all the Pederasyon officers;

d. Preside over regular and/or special session or meeting of the Pederasyon at


least once in every quarter, or as often as necessary at a date, time and place
as specified in the IRP of the Pederasyon;

e. Convene the Local Youth Development Council (LYDC) and preside over its
meetings, as prescribed under RA 10742 and its IRR;

f. Take the lead in the initial drafting of the Local Youth Development Plan
(LYDP) and upon finalization by the LYDC, submit the LYD to the concerned
Local Chief Executive for inclusion in the Local Development Plan and
subsequent endorsement to the concerned Sanggunian for approval;

g. Ensure that LYD gives priority to the programs, projects and activities for
the youth, especially, anti-drug abuse programs, as well as those that
promote meaningful youth participation in nation building, sustainable
youth development and empowerment, equitable access to quality education,
environmental protection, climate change adaptation, disaster risk reduction
and resiliency, youth employment and livelihood, health, gender sensitivity,
social protection, capability building and sports development;

h. Certify and endorse all Pambayang Pederasyon activities. Provided, that if


the president will not certify and endorse such activity, the accrued expenses
of the participants during the said activity cannot be charged to the SK
Pederasyon funds; and

i. Perform such other functions as may be authorized by law, ordinances and


other issuances.

2. THE VICE PRESIDENT- The next highest officer of the Pederasyon. As such,
he/she shall:
a. Discharge the functions of the President in case the latter dies, resigns,
becomes physically incapacitated or is suspended or removed from the office;

b. Assist the President in the implementation of programs, projects, and


activities of the Pederasyon;

c. Perform such other functions as may be assigned to him/her by the


President.

3. THE SECRETARY- The Secretary shall:


a. Certify officers and members of the Pederasyon;

b. Record the minutes of the Pederasyon meetings;

c. Keep all administrative records and official documents of the Pederasyon, as


well as, the updated record or profile of all the Pederasyon officers and
members, copy furnished DILG and NYC, Ccontaining the following
information:
i. Name;
ii. Address;
iii. Place and date of birth;
iv. Sex;
v. Civil status;
vi. Citizenship;
vii. Occupation; and
viii. Other information as may be prescribed by laws or ordinances.

d. Send notice of regular and special session or meeting of the Pederasyon;

e. Cause the posting of all resolutions and actions of the Pederasyon in


conspicuous places and/or through non-traditional media i.e. Facebook,
Twitter, etc.; and

f. Perform such other duties and functions as may be assigned to him/her by


the President.

4. THE TREASURER - The Treasurer shall:


a. Keep custody of all financial documents and inventory of all properties of the
Pederasyon;

b. Receive, collect and disburse funds and dispose the properties of the
Pederasyon, under the authority of the President, in accordance with the
Local Government Code of 1991 and existing rules of the Commission on
Audit (COA);

c. Issue official receipts for any sum of money or properties received by the
Pederasyon;

d. Maintain depository accounts with banks, in the name of the Pederasyon,


preferably government-owned, located in or nearest to their respective areas
of jurisdiction;

e. Maintain separate books and depository accounts, respectively, for each


fund in their custody or administration under the prescribed rules and
regulations of the Commission on Audit;

f. Prepare and submit to their respective Pederasyon Presidents, on or before


the fifteenth (15th) day of July of each year, a certified statement, covering
the income and expenditures of the preceding fiscal year, the actual income
and expenditures of the first two (2) quarters of the current year, and the
estimated income and expenditures for the last two (2) quarters of the
current year;

g. Render a written accounting report of all Pederasyon funds and properties


under his custody and other accountable officers of the Pederasyon at the
end of each calendar year;

h. Ensure that the accounting report, as well as the books of accounts,


financial documents and cash shall at all times be made available to the
members of Pederasyon and shall be open for inspection by COA; and

i. Perform other official duties assigned by the President and such other
functions as may be authorized by law, ordinance and government
issuances.

5. THE AUDITOR - The Auditor shall:

a. Examine and audit periodically the books of the SK Pederasyon, its assets
and liabilities and require the production of the supporting documents;

b. Inform the Pederasyon Officers immediately of any transaction inimical to


the Pederasyon, and do such acts or propose such measures that shall
protect the interest of the Pederasyon; and

c. Perform such other official duties as may be assigned by the President,


existing laws or government issuances.

6. THE PUBLIC RELATION OFFICER (PRO) - The PRO shall:


a. Establish relations or contacts with mass media, NGOs, Youth and Youth
Serving Organizations;

b. Disseminate information about the objectives and activities of the


Pederasyon and other information beneficial to the youth; and

c. Perform such other official duties as may be assigned to him by the


President.

7. THE SERGEANT-AT-ARMS: The Sergeant-at-Arms shall:


a. Maintain order and discipline during sessions/meetings and activities of the
Pederasyon; and

b. Perform such other functions and duties assigned by the President.

RULE III
SESSION/MEETING/QUORUM

SECTION 6. SESSION OF THE PEDERASYON- The Pederasyon shall meet once (1) in
every ____ _______________ of the month, at (time) __________________. Emergency meeting
shall be called by the presiding officer with a notice prior, or by a majority of the members
of the SK Federation.

In case the regular session falls on a public holiday; the next working day shall be the
regular session, unless the latter is declared a public holiday, the regular session shall be
held on the following working day.

SECTION 7. QUORUM. A quorum is the number of members required to be able to


transact official business. To determine quorum, the following shall be observed:

1. A majority of all the Officers of the Pederasyon shall constitute quorum to transact
official business and to validly act on every decision that the Pederasyon shall
make;

2. No business shall be transacted by the Pederasyon if there is no quorum;

3. No resolution shall be passed unless approved by a majority of the members


present;

4. Should a question of quorum be raised during session, the Pederasyon President


concerned shall immediately proceed to call the roll of the officers and thereafter
announce the results; and

5. The President of the Pederasyon at all levels, upon proper motion duly approved by
the officers present, shall declare the session or meeting adjourned for lack of
quorum.

SECTION 8. PEDERASYON CONGRESS/ASSEMBLY. - There shall be a Pederasyon


Congress/Assembly at all levels once a year to be composed of all the youth in the
municipality to be held on the celebration of the Municipal Linggo ng Kabataan.

ORDER OF BUSINESS

SECTION 10. The order of the calendar of business of the Sangguniang Kabataan shall be
as follows:
a. Call to order
b. Invocation
c. Singing of the National Anthem and Manolo Hymn
d. Roll call and determination of quorum
e. Privilege Hour
f. Approval of the Order of Business
g. Entertainment of Visitor
h. Reading, correction if any, and approval of the minutes
i. Calendar of Business: Unfinished Business and Business for the Day
(agenda)
j. Other Matters
k. Adjournment

RULE VI
DEBATES/DECORUM/MANNER HAVING THE FLOOR

SECTION 11. Whenever a member of this Sangguniang Kabataan Federation wishes to


take the floor, he shall raise his right hand and respectfully address the Chair as,
“Mister/Miss Presiding Officer”, for recognition, which consent and recognition shall be
necessary before taking the floor.

If two or more members wish to take the floor, the Presiding Officer shall recognize the
one who first raises his right hand to seek recognition.

SECTION 12. No member of the Sangguniang Kabataan Federation shall interrupt or


interpolate the member who has the floor without the latter’s consent, which may not be
obtained except through the chair.

RULE VII
PRIVILEGE HOUR

SECTION 13. Special Report, consisting of one (1) hour during session any SK Federation
member may address the body on any matter of public interest.

SECTION 14. RULES ON SPECIAL REPORT

1. That any member of the Sangguniang Kabataan Federation who would like
to avail of the privilege time on any subject of public nature or interest shall
rise and seek recognition of the Chair before addressing the body in session.

2. When two or more members rise for recognition by the Chair, the first to rise
shall be recognized. At this juncture, the Chair shall request the member
who seeks recognition from the Chair to state what question of the privilege
he will bring to the attention of the Sangguniang Kabataan Federation and if
such question involves public nature or interest the chair, motu proprio,
shall recognize him.

3. The member so recognized to address the body during the privilege time
shall continue to rise during the privilege time allotted to him and shall
speak for not more than ten (10) minutes.

4. The member concerned, shall in the course of his privilege speech, limit or
confine his piece to his stated subject and shall never deviate therefrom nor
sort to name-calling, mudslinging, innuendos and other unparliamentary or
derogatory remarks against the dignity and/or reputation of any public
officials or private citizen or of any entity or institution. He shall, at all time,
maintain proper decorum befitting the dignity, integrity, and reputation of a
member of the body. If at this juncture, the speaker deviates from his stated
subject or resort to unparliamentary or derogatory remarks. If said speaker
continue to ignore the warnings, the Chair shall direct the speaker to take
his seat and to order the striking out of records such remark.

5. If the ten minutes allotted to him were not enough, he shall immediately
thereafter, request the Chair for extension of not more than five minutes.
Likewise, at this juncture, the Chair shall refer the request to the body for
approval without debate. If approved, the Chair shall advice the speaker to
continue his privilege speech.

6. While the speaker is delivering his privilege speech, no other member shall
interrupt or interpolate said speaker until he has finished his speech,
except, on question of point of order.

7. After the privilege speech of the speaker, any other member or members of
the Sangguniang Kabataan Federation may seek clarifications to him but in
no case shall such interpellation exceed a period of ten minutes. If the
member feels that there is a need to give a response or to amplify the subject
matter, he may do so if the Chair will recognize, provided, that the 1-hour
privilege time is not yet exhausted. If the privilege speech of any member
calls for some action of the Sangguniang Kabataan Federation, the

speaker before closing his speech, may without debate, notify the body of his
intention to have the matter included in the agenda, or any member other
than the speaker may likewise notify the body for the inclusion of the same
in the agenda.
Debate on the merits or demerits of the measure sought to be included in the
agenda shall be made only during the consideration of the same in the
agenda.

8. If after the period of interpolation, the 1-hour privilege time has not yet
expired, any other member may seek recognition to avail the remaining
unused privilege time, with the right to continue in the next regular session,
if he/she has not finished his speech within ten minutes time allotted to
each member under these rules.

9. Preferences in reservation in the next regular session shall be in the


following order:

a. The member who has notified the Chair of his intention to deliver rejoinder
or remarks on the matter taken up by the speaker or speakers in the
previous session.

b. The member who availed of the remaining unused privilege time and was
not able to finished his speech arising from the expiration of the 1- hour
privilege time.

c. A member who has not yet availed of the privilege time during the last two
regular sessions.

RULE VIII
AMENDMENTS

SECTION 15. These rules may be amended at any regular session by a two-third (2/3)
vote of the Member of the Sangguniang Kabataan Federation; provided, that notice of the
proposed amendment has been given at the session previous to the one at which said
amendment is to be considered.

SECTION 16. No provision of these rules which is prescribed by, statutory law or any
other higher authority may be amended or revised.

RULE IX
VOTES AND VOTING

SECTION 17. METHODS OF VOTING. Unless a different method is prescribed by the


Sangguniang for a particular measure, voting shall be either one of the following methods:

1. By voice (viva voce)


2. By raising of hand(or show of hand)
3. By rising

4. By ballot or
5. By nominal voting (or roll call)

SECTION 18. ABSTENTION. Indubitably, a member of this Sangguniang is representing


the people and not necessarily his own self and as such he should be required to make a
stand, one way or the other, on every issue or measure submitted for decision of this
body. Hence, it is hereby made as a general rule that no member of this Sangguniang
shall abstain from voting.

(Note: Abstention, if ever allowed to a member, shall not be considered in computing the
majority vote. Since abstention is not a vote, it does not count either way. Mere silence
and abstention are not the equivalent of affirmative votes nor of negative votes.)

This rule does not apply in voting for elective positions, if a member is qualified.

RULE X
DISCIPLINARY ACTION

SECTION 19. GROUNDS FOR DISCIPLINARY ACTIONS

1. Any SK Pederasyon Officer may be disciplined, suspended, or removed from


office, after due notice and hearing, on any of the following grounds:

a. Abuse of authority;

b. Commission of any offense involving moral turpitude or an offense


punishable by at least prision mayor (6 years and 1 day to 12 years)
imprisonment;

c. Failure to perform official duties and functions as Pederasyon Officer;

d. Commission of any violations cited in the respective IRP of the


concerned Pederasyon; and

e. Such other grounds as may be provided under the Local Government


Code of 1991, this JMC and all other applicable general and special
laws.

2. In addition to the above-mentioned grounds, the Pederasyon President in


any level, may be disciplined or suspended from the office, on any of the
following grounds:

a. Failure to conduct regular Pederasyon session or meeting, as specified


in the respective IRP of the Pederasyon, without a justifiable cause;

b. Failure to hold regular meeting with the LYDC for at least once in
every quarter without a justifiable cause;

c. Removal as president of the lower Pederasyon shall automatically


result to his/her removal as officer of the higher Pederasyon; and

d. Any SK Pederasyon President, who is validly removed as such, shall


likewise be removed as an ex-officio member of the Sangguniang
Panlungsod/Bayan or Sangguniang Panlalawigan, as the case may
be. Conversely, removal of any SK Pederasyon President as ex-officio
member in the sanggunian in which he/she sits in such capacity
shall ipso facto result in the loss of his/her presidency in the SK
Pederasyon.

RULE XI
PENAL PROVISIONS

SECTION 20. PENALTIES DURING REGULAR SESSIONS

1. That all members are required to be present at the Session Hall (any other place
so designated for the purpose) at least, thirty minutes (30 min.) before the
scheduled time at 8:00 in the morning every second (2 nd) Wednesday of the
month (or any other day in case the session falls on a holiday, and or special
session). Any member who would be late 15 minutes of the scheduled time
would automatically be fined Fifty Pesos (P50.00).

2. That, as an addendum to section of this rules, wherein all members are


required to wear formal attire (with collar) during session. Non-wearing a formal
or the agreed attire will automatically be fined Fifty Pesos (P50.00).

SECTION 21. ALL COLLECTIONS TO ACCRUE TO THE TRUST FUND OF THE


PEDERASYON NG MGA SANGGUNIANG KABATAAN OF MANOLO FORTICH, BUKIDNON
TO BE CREATED FOR THE PURPOSE. – All fines will be collected will accrue to the Trust
Fund of the Sangguniang Kabataan Federation will be created for the purpose. And all
expenditures to be charged against, or drawn from it, will be decided by the majority of
the members of the august body.

RULE XII
TRANSIORY PROVISIONS

SECTION 22. TERM OF OFFICE. - All officers of the Pederasyon ng mga Sangguniang
Kabataan at all levels shall assume office immediately after proclamation and after
rendering the oath of office.

They shall remain in office until such time that their legal successors shall have been duly
elected and qualified or unless sooner removed from office for a cause, permanently
incapacitated, dies or resigns from office.

Official records, including administrative documents, financial records and inventory of


properties of the Pederasyon shall be properly turned-over to the incoming Pederasyon
officers.

RULE XIII
SUPPLEMENTARY RULES

SECTION 23. The Rules of Procedures Parliamentary Practices of the Legislative Bodies of
the Philippines and Parliamentary Rules by Ordain shall serve as the supplemental guide
when the same are not incompatible with its rules and standing order under.

RULE XIII
EFFECTIVITY

SECTION 24. This Internal Rules and Procedures shall become effective upon approval
and ratification of majority of the Sangguniang Kabataan Federation of Manolo Fortich.
